    R 400.8125(1) · R 400.8125(1) Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times. I

    On March 25, 2021 I spoke with Child C, D, and E's Mother on the telephone. She stated that on March 9, 2021 she noticed that there were scratch marks along the left side and back of Child C's neck. Child C and Child D (female, age 9) informed her that on March 8, 2021 Child F had held him and scratched him during a game of "one-ball" in the gymnasium during the after-school program at the child care center. She said she emailed the center program director, Rebecca Belka on March 9, 2021 about the incident and detailing additional concerns. One concern was Child C and Child D have told her that they are being bullied by Child F. The second concern was questioning whether staff are providing appropriate supervision. Child C, D, and E's Mother explained that on March 9, 2021 she received a response from Ms. Belka letting her know that she had spoken with the school age child care staff member about the concerns and would put steps in place to ensure appropriate supervision. She said that on March 12, 2021 she sent a second email to Ms. Belka informing her that Child C had been to the doctor due to the scratches becoming infected, as well as reiterating her concerns about bullying and asking for a plan to be provided on how Child C would be kept safe while in care at the center. Child C, D, and E's Mother informed me she did not receive a response from Ms. Belka after this email. Child C, D, and E's Mother stated that she had photos of the scratches and marks on Child C's neck taken on March 9, 2021 and then again on March 12, 2021. I asked Child C, D, and E's Mother to send me photos of Child C's neck and emails she sent to Ms. Belka. She sent the requested documents the same day. The emails and photos are on file with this report. On March 29, 2021 I made an on-site inspection at the child care center. I spoke with program director, Rebecca Belka, child care staff members Joseph Kornoelje, and Madelynn Kornoelje, and Child C. Mr. Kornoelje stated he is the child care staff member assigned the school age before and after school program at the center. He informed me that he did not see an incident on March 8, 2021 where Child C had been injured. He was not aware that Child C had been injured. Child C did not cry, he did not notice any marks, and no children approached him letting him know that Child C had been hurt. He said he saw the scratch on March 10, 2021; he stated the scratch was red and "looked bad." At arrival on March 10, 2021 Child D "came in yelling, 'stay away from [Child F], he'll scratch you'." He is not aware of any children "seeing the incident." I asked Mr. Kornoelje about behavior issues with Child C and Child F. He stated that both children "don't listen" and he tries to keep them separated. He has observed Child C "push" other children. Child F "likes to tease the little ones." Both Child D and Child F will "take things from other children." There are some written notes concerning behaviors on file for Child C, Child D, and Child F. The behaviors vary and "depends on the day." He said that he does not feel that the behaviors exhibited are beyond normal, and he would not consider them as "bullying" behaviors. He does not feel that Child C is being targeted by any other children in care. No children are currently on behavior plans. Mr. Kornoelje stated 3 there was an incident that occurred approximately two weeks ago where he noticed that Child H (female, age 5) was holding her neck. When he asked her why she was holding her neck, Child G told him that Child D had "squeezed her neck bone." He explained that Child D and Child H had gone into the storage closet to get some supplies. When he asked Child D about it, she denied squeezing Child H's neck. He did not notice any marks or redness on Child H's neck. He informed Child H's parents about the incident. He is not aware of any other parents having any concerns about behaviors or supervision.     On March 17, 2021 I received a voicemail from program director, Rebecca Belka informing me that a child had been injured while in care and had received medical attention. She stated in the voicemail that she would send an incident report with the details of the incident. On March 24, 2021 I emailed Ms. Belka requesting the incident report, as I had not received it. On March 24, 2021 I received the incident report from Ms. Belka via email. On March 25, 2021 I spoke with Child C, D, and E's Mother on the telephone. She said she emailed Ms. Belka on March 9, 2021i nforming her that Child C had been injured while in care. On March 12, 2021 she sent an email to Ms. Belka informing her that Child C had been to the doctor due to the scratch being infected. On March 30, 2021 I spoke with Ms. Belka on the telephone. She stated that she was notified of Child C being injured on March 9, 2021 via an email from Child C, D, and E's Mother. She confirmed that she received an email on March 12, 2021 that contained information that Child C had received medical attention for the scratch received on March 8, 2021 while in care.

    On March 17, 2021 Ms. Belka called the department to report that Child C had received medical treatment due to an injury that occurred while in care. On March 24, 2021 I received the incident report from Ms. Belka via email. The incident report was not received within 72 hours of the verbal report.
