    On 08/18/2023 The complainant stated that on 08/16/2023 from 9:00 am to 10:00 am the children were outside on the playground at the center. The complainant observed CCSM 5 grab Child A by the arm and shove her. Child A did not fall down but started to cry. CCSM 5 was yelling at Child A by name telling her “you need to go over there” and 2 “you are not being very nice today and I am not dealing with you today.” Child A was upset and crying. The complainant was not sure if there was another CCSM present or if another caregiver observed the incident. On 08/23/2023, CCSM 1 stated that she just started working at the center last week, 08/14/2023, and it was her second time working in the toddler classroom. She has not heard anyone yelling at the children or witnessed anyone grabbing the children. She was not working in the toddler classroom on 08/16/2023. On 08/23/2023, CCSM 2 stated that she was not working in the toddler classroom on 08/16/2023; she has mainly worked in the preschool classroom. She has not heard of any incident with Child A, and she has no knowledge of CCSM 5 or CCSM 6 yelling at or grabbing Child A or any child at the center. CCSM 2 was a sub in the toddler classroom today. CCSM 5 and CCSM 6 are the staff that were working in the toddler classroom on 08/16/2023. On 08/23/2023, CCSM 3 stated that she has no knowledge of CCSM 5 or CCSM 6 yelling at or grabbing Child A or any child at the center. On 08/23/2023, CCSM 4 stated that she has no concerns about CCSM 5 or CCSM 6 and she has not heard anyone yelling at the children or witnessed anyone grabbing the children. On 08/23/2023, Ms. Fagan stated that she has had no concerns about CCSM 5 or CCSM 6 that work in the toddler classroom. On 08/16/2023 she was made aware of the allegations by a Howell Police Officer. Ms. Fagan did not think that she was required to contact licensing when she learned of the allegations from the police officer. She was present at the center during the time of the alleged incident, and she did not hear or observe the toddler caregivers being inappropriate with the children nor has she ever observed them being inappropriate and she has never spoken to CCSM 5 or CCSM 6 about yelling at or grabbing the children. Child A did not have any visible marks or injuries. On 08/23/2023, I observed the toddler classroom outside on the playground. The CCSM’s were appropriate with their interactions with the children. They did not yell or grab the children. CCSM 5 and CCSM 6 were not present during this inspection. On 12/07/2023, CCSM 5 stated that she did not at any time grab or yell at Child A outside on the playground nor would she ever yell or grab a child. On 12/07/2023, I left a voicemail and sent a text message to CCSM 6, and I did not receive a return call or text message. On 12/07/2023, Child A’s Mother stated that she received a phone call from the Howell police officer who informed her that there had been an allegation alleging that a caregiver had been observed pushing Child A to the ground outside on the playground. 3 She was informed first by the officer and then by Ms. Fagen. Child A did have a bruise on her left arm, but she did not know how or when it occurred. She did not believe that Child A was injured at the center. Child A does not attend the center anymore because of the high staff turnover and not because of the allegations. Child A’s Mother did not have any concerns about the care that Child A was receiving at the center.

    R 400.8155(5) · R 400.8155(5) Child accidents and incidents; child and staff illness. (5) A center shall have a written policy detailing when children, staff, and volunteers will be excluded from the center due to illness.

    On March 8, 2023, I called and spoke with the Complainant. The Complainant said the child care staff members (CCSM) are expected to come to work sick because there are not enough child care staff members, and they are always out of ratio. The Complainant said child care staff members, CCSM 1 and CCSM 2, were fired because they were sick and refused to come to work. On March 9, 2023, I completed an unannounced on-site inspection. I interviewed CCSM 3, CCSM 4, CCSM 5, CCSM 6 and CCSM 7 who all said when they are sick, they stay home. They come to work with a cold, but if they are contagious, they are not forced to come in. I interviewed program director Amber Collins and asked Ms. Collins about the illness procedures for child care staff members. Ms. Collins said if child care staff members are feeling under the weather, they are expected to come to work as long as they're not contagious. If a child care staff member is sick at the center, they are sent home. Ms. Collins said they had child care staff members who called in all the time. A couple of child care staff members were fired recently because of their poor attendance. I asked Ms. Collins if the child care center had an illness policy for staff. Ms. Collins said, no. She and the child care staff members follow the children's illness policy. Ms. Collins contacted Ms. Fagan and confirmed that the staff follow the children's illness policy. I reviewed the center's children's illness policy, and it does not address the procedures for child care staff members who are sick. I provided technical assistance and consultation and informed Ms. Collins that the center must have a written policy detailing when staff and volunteers are excluded from the center for illnesses. On March 9, 2023, I called and spoke with Ms. Fagan. Ms. Fagan said she had to fire the last two child care staff members because they kept calling in sick. Ms. Fagan said if the child care staff member had a minor cold, they should be able to come to work. If they're vomiting or if they have a temperature, then they should stay home. She denied making staff work when they're sick. I informed Ms. Fagan that the child care center must have a written policy detailing when staff and volunteers are excluded from the center for illnesses. 4

    On March 9, 2023, I completed an unannounced on-site inspection. I interviewed program director, Ms. Amber Collins, and child care staff members, CCSM 3, CCSM 4, and CCSM 5. I interviewed CCSM 3 who said she works in the infant classroom with Ms. Collins. CCSM 3 said the children sleep on demand and are not forced to stay awake. When the children wake up, CCSM 3 said they change the children's diapers and let them play on the floor. CCSM 3 said she has never seen Ms. Collins force a child to stay in the crib. CCSM 4 and CCSM 5 both said they've never seen Ms. Collins force a child to sleep. CCSM 4 said during naptime, if a child sits up, Ms. Collins pats the children's backs to help them go back to sleep. CCSM 4 said Ms. Collins never pushes a child down. I interviewed Ms. Collins who denied holding down the children's heads and forcing them to sleep. Ms. Collins said the children sleep on demand. They try to accommodate parents and have the children maintain the same nap schedule from home. Ms. Collins said if a child wakes up during naptime, they offer quiet toys. During the inspection, I inspected the infant classroom and observed all children were asleep in the cribs. On March 9, 2023, I called and spoke with Ms. Fagan. Ms. Fagan said she has no concerns regarding Ms. Collins with the infants. She has never seen any inappropriate behavior between Ms. Collins and the children. Ms. Fagan said parents want their children to stay up and not sleep. However, they can't make the children stay up and allow the children to sleep on demand. The child care staff members are not making the children stay awake nor are they forcing the children to stay asleep. On March 10, 2023, I called and spoke with Child C's Mother and Child D's Mother. Child C's Mother and Child D's Mother both said they had no concerns regarding the interactions of child care staff members and the children, nor did they have any issues regarding naptime. Child C's Mother said Child C sleeps at least three to four times a day at the center which is consistent with his home schedule. On April 28, 2023, child care licensing consultant, Ms. Histed, and I completed an unannounced on-site inspection. During the inspection, I inspected the infant classroom and observed CCSM 8 with four children. CCSM 8 was on the floor playing with all four children. Ms. Histed and I interviewed Ms. Collins who said she's the program director and lead child care staff member for the infant classroom. However, she was assisting in the toddler classroom.

    On March 9, 2023, Ms. Fagan indicated that she was at the child care center on Tuesday, March 7, 2023. On March 9, 2023, CCSM 4, CCSM 5, CCSM 6 and CCSM 7 stated that Ms. Fagan was not at the center on March 7, 2023, when they were out of ratio. Ms. Collins, CCSM 4 and CCSM 5 also said Ms. Fagan encouraged them to lie when the licensing consultant is at the child care center. I received a written document on March 9, 2023, stating that "Kristie Fagan was not in the building of the Little Red Schoolhouse on Tuesday, March 7." The letter was signed by CCSM 3, CCSM 4, CCSM 5, CCSM 6, and CCSM 7. On March 10, 2023, I spoke with Child C's Father. Child C's Father said he dropped off Child C at the center at 7:30 a.m. on Tuesday, March 7, 2023. According to Child C's Father, Ms. Fagan was at the center because he recalls speaking to her.

    On May 3, 2023, I reviewed the Child Care Background Check (CCBC) system. CCSM 8 did not complete a comprehensive background check. CCSM 8 completed the comprehensive background check and was found eligible on October 8, 2020. However, CCSM 8 resigned and was disconnected from the CCBC system on January 25, 2022.

    On February 17, 2023, I called the Complainant, but the phone number was disconnected. I sent an email to the Complainant, but the email address was invalid. On February 17, 2023, I completed an unannounced on-site inspection. I interviewed program director, Ms. Amber Collins, and Child Care Staff Member (CCSM) 1, CCSM 2, and CCSM 3, separately. Upon my arrival, I observed the following: • The Toddler Classroom was out of ratio. Ms. Collins and CCSM 2 were in the classroom with twelve children. • In the Infant Classroom, there were two child care staff members, CCSM 1 and CCSM 3 with seven children. • The Preschool Classroom was closed. The child care center uses the Bright Wheel app to record children's attendance. During the inspection, Ms. Collins and I reviewed the Toddler Classroom's attendance dated February 17, 2023. I noted the following: • Child A (male, 22 months old) arrived at the center at 6:45 A.M. • Child B (female, 23 months old) arrived at the center at 9:05 A.M. • Child C (male, 28 months old) arrived at the center at 8:51 A.M. • Child D (female, 35 months old) arrived at the center at 6:12 A.M. • Child E (male, 30 months old) arrived at the center at 8:03 A.M. • Child F (female, 18 months old) arrived at the center at 6:36 A.M. • Child G (female, 29 months old) arrived at the center at 8:23 A.M. • Child H (male, 35 months old) arrived at the center at 9:05 A.M. • Child I (male, 33 months old) arrived at the center at 8:25 A.M. • Child J (female, 26 months old) arrived at the center at 7:55 A.M. • Child K (male, 21 months old) arrived at the center at 7:45 A.M. • Child L (male, 35 months old) arrived at the center at 6:12 A.M. I reviewed the child care staff members' attendance records for February 17, 2023 noted that Ms. Collins arrived at the child care center at 8:30 A.M., and CCSM 2 arrived at 6:00 A.M. 3 In the Toddler Classroom on February 17, 2023, I noted the following: • By 6:30 A.M., CCSM 2 was alone and in ratio with two children (Child D and Child L). • By 7:00 A.M., CCSM 2 was in ratio with four children (Child A, Child D, Child F, and Child L.) • By 7:45 A.M., CCSM 2 was out of ratio with five children (Child A, Child D, Child F, Child K, and Child L.) • By 8:25 A.M., CCSM 2 was out of ratio with nine children (Child A, Child D, Child E, Child F, Child G, Child I, Child J, Child K, and Child L.) • At 8:30 A.M., Ms. Collins arrived at the child care center. • Ms. Collins and CCMS 2 were out of ratio with nine children (Child A, Child D, Child E, Child F, Child G, Child I, Child J, Child K, and Child L.) • By 8:51 A.M., Ms. Collins and CCMS 2 were out of ratio with ten children (Child A, Child C, Child D, Child E, Child F, Child G, Child I, Child J, Child K, and Child L.) • By 9:05 A.M., Ms. Collins and CCMS 2 were out of ratio with twelve children (Child A, Child B, Child C, Child D, Child E, Child F, Child G, Child H, Child I, Child J, Child K, and Child L.) I spoke with Ms. Collins who admitted that the child care center has been out of ratio, off and on, for the last two to three weeks. She said they were out of ratio on February 15, 2023, because of staff resigning and illnesses. Ms. Collins said they closed the Preschool Classroom yesterday and today because CCSM 3 was sick, and they didn't have enough child care staff members. During the inspection, I reviewed the Infant Classroom, Toddler Classroom, Preschool Classroom, and child care staff members' attendance records for February 15, 2023. 4 Toddler Classroom (February 15, 2023): • Child A (male, 22 months old) arrived at the center at 6:41 A.M. and left at 3:20 P.M. • Child B (female, 23 months old) was absent. • Child C (male, 28 months old) arrived at the center at 8:07 A.M. and left at 4:44 P.M. • Child D (female, 35 months old) arrived at the center at 6:01 A.M. and left at 3:15 P.M. • Child E (male, 30 months old) arrived at the center at 7:30 A.M. and left at 3:23 P.M. • Child F (female, 18 months old) arrived at the center at 6:41

    On December 12, 2022, I completed an unannounced on-site inspection. I interviewed child care staff members, Ms. Amber Collins, Ms. Alexis A Lindig, Ms. Christine Magee, Ms. Alicia Brough, and Ms. Doris Meagher, separately. Licensee and program director, Ms. Kristie Fagan, and child care staff member, Ms. Natalie Doren, were absent. Upon my arrival, I observed three child care staff members in the Toddler Classroom with nine children, and two child care staff members with eight children in the Infant Classroom. I interviewed Ms. Collins who said the child care center uses the Bright Wheel app to record children's attendance. I reviewed the attendance records dated December 12, 2022, for the Infant Classroom and Toddler Classroom. I confirmed that there were nine children in the Toddler Classroom, and eight children in the Infant Classroom. I also reviewed staffs attendance record dated December 12, 2022, and noticed that only three child care staff members (Ms. Lindig, Ms. Magee, and Ms. Melinda King) were signed in. I asked all of the child care staff members to sign in on the attendance record. I interviewed Ms. Collins who works Monday through Friday from 9:00 A.M. to 5:45 P.M. Ms. Collins said there are twelve children enrolled in the Toddler Classroom, and that there is always three child care staff members present. She, Ms. Lindig, and Ms. Magee are in the Toddler Classroom. According to Ms. Collins, there used to be only eight children with two child care staff members in the Toddler Classroom. However, in September 2022, they increased it to twelve children with three child care staff members. Ms. Collins said there is no issues with ratio. Ms. Lindig is a child care staff member in the Toddler Classroom. She works Monday through Friday from 8:00 A.M. to 5:00 P.M. or 5:30 P.M., hours may vary. Ms. Lindig said they have twelve children enrolled but only seven or eight children are present on one given day. Ms. Lindig said she and Ms. Magee works alone in the Toddler Classroom, but if there are nine children or more present then Ms. Collins steps in to help. She has no concerns about ratio, and she said there's always enough coverage. Ms. Magee is a child care staff member in the Toddler Classroom. She works Monday through Friday from 7:45 A.M. to 4:45 P.M. Ms. Magee said there is usually twelve children on Monday and Wednesday, and eight children on Tuesday and Thursday. Ms. Magee said Ms. Collins comes in every day at 9:00 am and assists in the Toddler Classroom, if needed. According to Ms. Magee, Ms. Collins does managerial duties on Tuesday and Thursday, so she is not needed in the classroom. Ms. Magee said they are never out of ratio. Ms. Brough is a child care staff member in the Infant Classroom. She works Monday through Friday, and her hours vary from 6:00 A.M. or 8:00 A.M. to 6:00 P.M. Ms. Brough said there are ten children enrolled but most of them are part-timers. Ms. 7 Brough has no concerns regarding ratio and said Ms. Magee, Ms. Meagher and Ms. Doren are all available to assist in the classroom. Ms. Meagher is the child care staff member in the Preschool Classroom. She also assists in the Infant Classroom, if needed. Ms. Meagher has no issues with ratio and said they have never been out of ratio. Prior to leaving the center, I reviewed the staff's attendance records again and saw that all seven child care staff members signed in. On January 24, 2023, I completed an unannounced on-site inspection. I interviewed Ms. Collins and Ms. Doren, separately. Ms. Fagan was absent. Upon my arrival, I observed three child care staff members with nine children in the Toddler Classroom, and one child care staff member with eight children. The Infant Classroom was out of ratio. It was naptime and all the children were asleep. I asked Ms. Collins if there was another child care staff member in the Infant Classroom and she said, yes.     On January 24, 2023, the Infant Classroom was out of ratio with one child care staff member and eight children in care. Child care staff member, Ms. Meagher, left the classroom and went on break for an hour, 45 minutes in the building and 10-15 minutes outside in her car. The incident occurred during naptime.

    On December 12, 2022, I reviewed staff's attendance record dated December 12, 2022, and noticed that only three child care staff members (Ms. Lindig, Ms. Magee, and Ms. Melinda King) were signed in. During the inspection, I asked all the child care staff members to sign in on the attendance record. This was corrected on-site during the inspection.
