    R 400.1908 · R 400.1908 Capacity. (1) The licensee shall ensure that the actual number of unrelated children in care at any 1 time does not exceed the number of children for which the child care home is licensed, not more than 6 children for a family child care home and not more than 12 children for a group child care home.

    On February 17, 2022, I called and spoke with the Complainant who is concerned that Mrs. Colleen Orr is not at the child care home. The Complainant believes that Mrs. Orr leaves the child care staff member alone with the children while she goes shopping. Mrs. Orr goes to Frankenmuth and Jo Ann Fabrics. The Complainant said there are at least seven to eight children at the child care home. Four of the children are under the age of two years old. The Complainant believes one family lied about the child's age on the child information card to make him older. On February 17, 2022, I called and spoke with child care staff member, Ms. Julie Murray. Ms. Murray said she helps with coverage while Mrs. Orr takes her husband, Mr. Robert Orr, Jr., to his medical appointments. Ms. Murray lives in the neighborhood. She has a job as a nurse and only works at the child care home when her schedule permits or when Mrs. Orr needs help. Ms. Murray said she has only worked at the child care home on three occasions. She does not recall the exact dates but she worked one day in November and December from 6:30 A.M. to 11:30 A.M., and in January from 6:30 A.M. to 9:00 A.M. Ms. Murray said she was alone with four children. She has never seen more than four children at the child care home. On February 23, 2022, I completed an unannounced on-site inspection. Upon my arrival, I observed Mrs. Orr with Child A (male, 19 months old), Child B (male, 19 months old), Child C (male, 16 months old) and Child D (male, 8 months old) in the basement. 3 I interviewed Mrs. Orr who said she had three child care staff members, Ms. Emma Hess, Ms. Julie Murray, and Ms. Christy Buker. Ms. Hess works in the summer and holidays. Ms. Hess has been helping out at the child care home since Ms. Buker is no longer employed. Ms. Buker worked for approximately two months and her last day was December 8, 2021. Ms. Murray worked twice on November 29, 2021, and February 1, 2022. Mrs. Orr recalls being over capacity once during the summer. Her child care staff member, Ms. Buker, brought her son to the child care home. She had six children enrolled but now there's only four children enrolled. She denied being over capacity or ratio in December 2021. Mrs. Orr said she's always at the child care home. When Mr. Orr has a physician's appointment, she takes off a couple of hours to drive him and is usually back before noon. The children are with a child care staff member. She denied going to Frankenmuth and Jo Ann Fabrics during child care hours. Mrs. Orr said she went to Frankenmuth on a Sunday and to Jo Ann Fabrics and Michael's for art supplies. This occurred after hours when the child care is closed. Mrs. Orr said she went to the grocery store to pick up groceries. She was not gone all day and returned immediately to the child care home. She reiterated and said the children are with a child care staff member. Mrs. Orr said she used the Bright Wheel app to record attendance but she switched to Pro Care app about a month ago. She is in the process of scanning the old attendance records over to Pro Care. During the inspection, I reviewed the children's attendance records for December 1 through December 31, 2021: December 6, 2021 Child A (male, 16 months)- signed in at 8:00 A.M. and signed out at 4:00 P.M. Child B (male, 18 months)- signed in at 7:00 A.M. and signed out at 4:30 P.M. Child C (male, 14 months)- signed in at 8:00 A.M. and signed out at 3:45 P.M. December 8, 2021 Child D (male, 6 months)- signed in at 6:45 A.M. and signed out at 3:05 P.M. December 14, 2021 Child A (male, 17 months)- signed in at 8:46 A.M. and signed out at 3:58 P.M. Child B (male, 18 months)- signed in at 7:01 A.M. and signed out at 4:34 P.M. Child C (male, 14 months)- signed in at 9:07 A.M. and signed out at 4:15 P.M.     On February 17, 2022, I called and spoke with the Complainant. The Complainant said in the mornings during drop off time, parents park their cars in the driveway and text Mrs. Orr. If Mrs. Orr is at home, she would come outside to get the child(ren). If she's with Mr. Orr at the physician's office, she would call a child care staff member to get the child(ren). The children inside the house are left alone in the basement while the child care staff member runs back and forth from the house to the car. On February 17, 2022, I called and spoke with child care staff member, Ms. Julie Murray. Ms. Murray said parents are not allowed in the child care home due to COVID 19. When parents arrive at the home in the mornings, they stay in their cars and wait for a child care staff member to come outside. The other children are inside the house while a child care staff member goes out to get the child from the car. When asked who is inside the house with the children, Ms. Murray said no one. On February 23, 2022, I completed an unannounced on-site inspection. I interviewed Mrs. Orr who said during COVID, parents remained in their cars during drop off and pick up. The parents would send her a text message and she or a child care staff member would come out to get the child. Mrs. Orr admitted that the children were left alone in the basement. Mrs. Orr said the children were safe and placed in the pack 'n plays and chairs in the gated area. She changed her drop off and pick up procedures on February 21, 2022, to allow parents to come to the front door of the home. During the inspection, I observed parents arriving at the child care home. Child D's Mother waited at the front door while Child D gathered his belongings to go home. On March 22, 2022, I called and spoke with Child A's Mother and Child D's Mother. I left messages for Child B's Mother and Child C's Mother. Child A's Mother and Child D's Mother both said parents are not allowed in the child care home due to COVID. During drop off and pick up time, they sit in the car and wait for Mrs. Orr or a child care staff member. However, this changed a few weeks ago and they are now dropping off and picking up their children at the front door. On March 23, 2022, I received a telephone call from Child B's Mother who said she drops off and picks up Child B at the front door of the child care home. She used to wait in the car for a child care staff member to come out but that changed in February.

(b) Children of a child care staff member or child care assistant. (c) Children related to any member of the household by blood, marriage, or adoption.

    On February 17, 2022, I called and spoke with the Complainant. The Complainant said Mrs. Orr uses inappropriate language in front of the children. She uses profanity such as "shit" and "fuck." Mrs. Orr also makes inappropriate remarks to the children by saying things like, "You're gonna turn out just like your father and that's not a good thing." On February 17, 2022, I called and spoke with child care staff member, Ms. Julie Murray. Ms. Murray said she has never heard Mrs. Orr use inappropriate language. She has no concerns regarding the interactions between Mrs. Orr and the children. On February 23, 2022, I completed an unannounced on-site inspection. I interviewed Mrs. Orr who denied using profanity and inappropriate language. She also denied shaming or humiliating any of the children. Mrs. Orr said she spoils the children and that they are well-loved in her care. On March 22, 2022, I called and spoke with Child A's Mother and Child D's Mother. I left messages for Child B's Mother and Child C's Mother. Child A's Mother said she was grateful for Mrs. Orr. Mrs. Orr constantly introduces new toys and activities for the children. Child A's Mother said Mrs. Orr loves the children. Child A's Mother and Child D's Mother both said they had no concerns about the quality of care and interaction between Mrs. Orr and the children. On March 23, 2022, I received a telephone call from Child B's Mother who said she has no concerns and that she never felt Child B was unsafe with Mrs. Orr.

    On February 7, 2022, I called and spoke with the Complainant. The Complainant said parents are not allowed inside the child care home. In the morning during drop off time, parents park their cars in the driveway and wait for someone to come out to bring the child inside the home. This happens in the afternoon for pick up as well. The Complainant said it's usually one person that comes outside to the cars. The Complainant has seen at least two people at the child care home. Ms. Buker and Ms. Murray both said they completed the comprehensive background check. Ms. Buker doesn't remember her start date at the child care home. She only worked for a month or two from November until December 2021. Ms. Buker no longer works at the child care home. Ms. Murray lives in the neighborhood. She has only worked at the child care home on three occasions. She does not recall the exact dates but she worked one day in November and December from 6:30 A.M. to 11:30 A.M., and in January from 6:30 A.M. to 9:00 A.M. Ms. Murray said she was alone with the children while Mrs. Orr took_ to his appointments. On February 23, 2022, I completed an unannounced on-site inspection. Upon my arrival, I observed Mrs. Orr with four children in care. Mrs. Orr said Ms. Hess works in the summer and holidays. Ms. Hess has been helping out at the child care home since Ms. Buker is no longer employed. Ms. Buker worked for two months and her last day was December 8, 2021. Ms. Murray worked twice on November 29, 2021, and February 1, 2022. I asked Mrs. Orr if she had the consent and disclosure forms for the child care staff members. She said she cleaned up the basement and stored staff records in a bin. She does not know where they are located at the moment. Mrs. Orr said _ has an upcoming surgery and that the child care home will be closed. She will send the documents as soon as possible. On March 10, 2022, I received an email from Mrs. Orr. Mrs. Orr sent the consent and disclosure form for Ms. Murray and Ms. Hess. Ms. Murray's consent and disclosure form was signed and dated on December 1, 2021. Ms. Hess' consent and disclosure form was signed and dated on June 6, 2020. Mrs. Orr does not have the consent and disclosure form for Ms. Buker. On March 15, 2022, I completed an exit telephone conference with Mrs. Orr.
