    On April 25, 2023, program director and licensee designee, Ms. Candice Davies self-reported an incident. She submitted an incident report to the department. According to the incident report, "Child A's Mother stated that on Friday during a bath, Child A (male, 4 years 1/2 old) was bending over tickling his knees. Child A said, "Let's be quiet and not make a sound." Child A's Mother was concerned and asked who tickles him. Child A said child care staff member (CCSM) 1 tickles me. Child A's Mother asked if CCSM 1 tickles anywhere else; Child A stated that CCSM 1 tickles his bummy. Child A then stated that CCSM 1 also tickles my penis. Child A's Mother said that is not good- I will need to talk to CCSM 1. Child A said don't tell CCSM 1. Child A's Mother proceeded to tell Child A that it was her job to keep him safe. Child A's Mother stated that Child A said this happens in the morning and in the bathroom. Child A's Mother said that if she looked at his behavior as a child who has been abused- behaviorally he has acted different since Christmas. It could be a misunderstanding. Child A is usually a goofy child, but he wasn't goofy when he said this- he was more serious. That he has a telltale sign of lifting his upper lip when he is lying, and he didn't lift his lip." 3 On April 27, 2023, I completed an unannounced on-site inspection. I interviewed Ms. Davies, CCSM 2 and CCSM 3, separately. CCSM 1 was absent during the inspection; she was placed on administrative leave. Ms. Davies said she had a meeting with Child A's Mother and Child A's Father via Zoom on April 24, 2023. According to Ms. Davies, Child A's Mother said she was bathing Child A when she noticed that he was in a squatting position, tickling his knees. Child A's Mother thought it was weird and asked Child A who tickled his knees. Child A said CCSM 1. Child A's Mother said she asked Child A if CCSM 1 touched him anywhere else and Child A said his "bummy." Ms. Davies said the "bummy" is referring to Child A's buttocks. Ms. Davies said Child A's Mother did not indicate the date when the incident occurred. However, it is believed that it occurred in the morning in the bathroom. There are bathrooms located in the hallway across from Child A's classroom. Child A is in the GSRP (Great Start Readiness Program) classroom. Ms. Davies said when it's time to take the children to the bathroom, the child care staff members split the children into two groups. One group stays in the classroom with one child care staff member while the other group goes to the bathroom with two child care staff members. The children all use the girls' bathroom. One child care staff member stands in the hallway by the bathroom entrance and the second child care staff member is inside the bathroom. Ms. Davies said there are security cameras in the hallway. She is pulling video footage to see if CCSM 1 has ever taken Child A to the bathroom. Ms. Davies does not know if a detective has been assigned to the case. However, a forensic interview is scheduled for May 3, 2023, at the child advocacy center, LaCasa. I interviewed CCSM 2 who said she works in the classroom with CCSM 1 and CCSM 3. They have a total of 16 children in the classroom. CCSM 2 said she and the other child care staff members take the children to the bathroom in the morning around breakfast time, recess, free choice, before and after lunch time, after naptime, or when needed. CCSM 2 said 95% of the time, she, CCSM 1 and CCSM 3 all take the children to the bathroom. However, there are times when only two child care staff members take at least eight children to the bathroom. CCSM 2 said the bathroom is located across from the classroom. When they take the children to the bathroom, one child care staff member stands outside the bathroom door, while the second child care staff member goes inside the bathroom with the children.
