    On 03/12/2021, I spoke to the complainant on the phone who stated they did not have any further information regarding the allegations at this time. On 03/12/2021, I called and spoke to Child A's mother via telephone, and she stated Child A was enrolled at Kindercare-Oceola from October 2020 to March 5, 2021 in the Toddler 2 classroom. Child A's mother stated that Child A has very sensitive skin, and she spoke to the program director Beth Grundman and lead caregiver Kayli Solberg and gave them both ideas on what type of diapers and wipes to use on Child A, and to change him more consistently. Child A's mother did not state if she provided any diapers or wipes personally. The center has always provided diapers and wipes for the children. Child A's mother stated that Ms. Grundman told her she would come in the Toddler room every hour and personally change Child A so that he was consistently being changed. However, this did not happen. Child A's mother stated that the center told her that Child A had bowel movements all day long and this is what was causing the diaper rashes. Child A's mother stated Child A did not have bowel movements all day at home. She never spoke about the type of food he ate or change of his diet. Child A ate the food from the center and did not have any specific directions about changing that. Child A did not seek medical treatment for the bowel movements or rash. She stated that she has pictures of the diaper rashes. Child A's mother stated she did not feel that Child A was being changed enough and that Child A never had these types of rashes at home. Child A's mother stated one day(she did not know the specific day), app the child care center uses for parents to see what times a child eats, has bowel movements and the child's sleep patterns showed Child A was only changed one time throughout the full eight hours Child A was there. She stated it happened multiple times that it only showed a couple diaper changes for Child A throughout the day. Child A's mother disenrolled Child A due to this, as she did not think they were changing his diaper enough and causing him to have blisters and sores all over his butt. On 03/14/2021, Child A's mother emailed documentation from the Kindercare App and pictures of Child A's butt with sores. The first picture is undated, and I am unable to tell when it is from. The picture shows Child A has a rash mark on his left thigh area where it appears it is not in the 3 diaper area. The app documentation that was sent as a screen shot shows Child A was changed at: 8:30 AM- bowel movement 9:45 AM- bowel movement; Ms. Solberg communicated that Child A's butt was red and she used the wipes and cream from home. She stated Child A is happy and does not appear to be upset by the redness. 10:49 AM- wet; Ms. Solberg communicated the redness looked better, and more cream and cornstarch were applied. 11:50 AM- wet; Ms. Solberg communicated that the irritation mark looks like it could be coming from his jeans. 2:01 PM- wet 3:22 PM- wet; Ms. Solberg communicated about the spot of the thigh not looking any worse. 4:36 PM- wet. The second picture shows a diaper rash of a child's butt and is from January 7, 2021. The rash appears to be on the inner part of his bottom on both sides. It is red; however, the picture is very dark, and I am unable to see exact redness. I did not see any blisters. This app documentation shows Child A was changed at: 8:32 AM- bowel movement 9:27 AM- bowel movement 10:37 AM- wet 11:26 AM- wet. Child A took a nap from 12:20 — 1:52 PM on this day. Child A's mother stated Child A was not changed in the afternoon at all on this day. I was not provided his time in and time out by Child A's mother. The third picture shows two pictures of a child's diaper rash on his butt from February 11, 2021. The diaper rash is on both sides of his bottom and in the inner part of his bottom. It is red and blotchy without blisters. This shows Child A was changed at: 8:22 AM- bowel movement

    On 02/17/2021, I spoke to program director Beth Grundman via telephone regarding the allegations that Child A had been grabbed by a staff member while in line for the bus. Ms. Grundman stated a few months back (she did not recall the exact date) in the morning, while the school age children were waiting to get on their bus to be taken to school, Juanita Griffee asked Child A to move to the back of the line due to her behavior. The incident was not documented due to it "not being a big deal" and no one was hurt, touched or upset about the situation. Child A had proceeded to get on the bus and go to school and the day continued. The next day, Child A's mother had asked Ms. Grundman about the situation due to Child A coming home and telling her that Ms. Griffee had grabbed her arm hard and she did not like it, and when she asked Ms. Griffee to stop, she did not. Ms. Grundman stated she asked Ms. Griffee about it, and she denied ever grabbing Child A. She said that all she had done was ask her to go to the end of the line due to not listening, and Child A walked to the end on her own. Ms. Grundman stated she then spoke to Child A about the situation, and Child A stated that she did not get hurt or harmed when Ms. Griffee asked her to walk to the end of the line. Ms. Grundman stated that due to an incident that occurred on 02/12/2021, Child A is no longer enrolled at the center and she feels this could be retaliation due to that. Ms. Grundman stated that she is currently quarantined for the week and will not be at the center for any onsite inspections. She stated she can be contacted via telephone for any follow ups or further questions. On 02/18/2021, I made an onsite inspection at Kindercare Learning Center and interviewed multiple staff members. First, I spoke to preschool lead caregiver Jennifer Aaro who stated she sometimes works with Child A. Ms. Aaro stated she was not in the room or outside with Ms. Griffee when the alleged incident occurred and did not have any information about it. Ms. Aaro stated she works with Ms. Griffee often though and stated that she has never seen Ms. Griffee be aggressive with any children or put her hands on a child to force them to do something. Next, I spoke to Juanita Griffee and she stated that she does not work in the classroom that Child A is in; however, in the morning, she takes the children that are school agers to the bus, and this is when she is with Child A. Ms. Griffee stated that the incident with Child A was about a month ago; she too could not remember the date and stated, "Things always just blend together when you work every day here". She stated that she was walking the Varsity class (School agers) out to the bus in the morning, Child A was kicking another child in line and was asked to stop. Child A did it again and then Ms. Griffee stated she asked Child A to go to the end of the line. Child A was given a few chances to go and she refused to go. Ms. Griffee stated she walked over to Child A and then guided her to the end of the line. She denied ever grabbing her arm or squeezing her arm at any time. She stated she just 3 put her arm on her shoulder and walked with her to the end of the line. Child A never cried, said that she was hurt or complained of being in pain. Ms. Griffee stated the only time Child A whined was when she was asked to move to the end of the line. Child A has a distinct sound she makes when she does not want to do something and that is all she did. Ms. Griffee stated when any child acts out in line, the rule is they must go to the end of the line. She stated all the children know this and have had to do it when they get in trouble. Ms. Griffee stated she usually just has to give a hand motion and the children will just move to the end of the line without her having to say a word or ask anything of them. Ms. Griffee stated no one spoke to her about the incident and did not think it was ever an issue to be brought up again. She stated Child A did not cry or

    On 02/17/2021, I spoke to Ms. Grundman via telephone regarding the allegations. Ms. Grundman stated that all of the allegations stemmed from an incident that had happened last Friday, 02/12/2021. She stated that the children in the Varsity classroom were all doing their valentines projects after rest time (around 1:00 PM) and Child A was observed for 45 minutes acting out and being disruptive to the classroom. Ms. Grundman stated she asked Child A multiple times to go do her project, and Child A continuously refused to do so. Ms. Grundman called Child A's mother to come get her due to the behavior, and Child A's mother told her to sit Child A in a chair until 3:30 PM when she could come get her. Ms. Grundman told Child A's mother that this was not possible, and they could not sit a child in a chair for that length of time. Child A's mother then "went off on her" and said that she pays good money for Child A to attend and she had to work so they needed to figure it out. Ms. Grundman stated that she knew Child A's mother was upset at having to come get Child A; however, Child A did not have her ADHD medication on this day and did not feel that it was Child A's fault for her behavior; she just could not control herself. She stated that Child A was very upset, throwing blocks, chairs and hurting herself. Ms. Grundman stated she only called Child A's mother due to the fear of Child A really hurting herself or another child. Ms. Grundman stated Child A's mother made some very harsh comments to her, and due to the language, anger and threats that were made, the center chose to disenroll Child A. Ms. Grundman stated that she did not feel they could provide Child A with the appropriate care she needed if Child A's mother felt the way she did. She stated they have documented everything through email involving this situation and she emailed me a copy for the file. I reviewed the emails on 02/17/2021 between Child A's mother and Ms. Grundman. The emails stated an apology from Child A's mother for yelling and saying the words she said to Ms. Grundman in the center, and that she will make sure Child A has her medication at all times when she is at the center. Child A's mother refused to talk about anything via email and wanted to only speak to Ms. Grundman via telephone, 5 even after Ms. Grundman stated all conversations needed to be documented and through email was best. In my phone conversation with Ms. Grundman, she stated the incident that was alleged regarding Child A being video recorded by a staff member is false. She stated this incident occurred last summer (date and time was unknown). Ms. Grundman stated that she will look to see if she can find any documents based on this allegation; however, she reviewed all video footage and at no point saw Lead Caregiver Jennifer Aaro video tape Child A acting out. She stated she spoke to Child A's mother about the incident, and Ms. Aaro also spoke to Child A's mother about it. Ms. Grundman stated she could not remember the exact incident but knew that it was based around Child A not wanting snack when it was snack time but then wanting a snack when they were going outside. Ms. Aaro brought a snack outside for Child A; however, this was "not good enough" for Child A, and she began having a temper tantrum that escalated and she could not calm herself down. Child A's mother was called to come get her due to Child A wearing herself out completely due to being so upset. Ms. Grundman did not have any further information about this at this time and stated again she will look for any documents regarding this incident. Ms. Grundman stated she has copies of incident reports from over the past years dealing with Child A's behavior and stated she would print out copies of each report for me to have during my onsite inspection. Ms. Grundman stated she would not be at her facility for an onsite interview due to being quarantined but could be reached by phone at any time for more questions. Ms. Grundman ema
