    R 400.8182 · R 400.8182 Ratio and group size requirements. (3) In each room or well-defined space, the maximum group size and ratio of caregivers to children, including children related to a staff member or the licensee, shall be the following: (a) For infants and toddlers, there shall be 1 caregiver for 4 children and a maximum group size of 12.

    On April 12, 2023, I completed an unannounced on-site inspection. I interviewed child care staff member (CCSM) 2 and CCSM 3. Program director, Ms. Beth Grundman was absent. CCSM 2 said she received a telephone call from Child B's Mother on April 11, 2023. According to CCSM 2, Child B's Mother said she was in the toddler 1 classroom to pick up Child B. The children were outside, lining up at the door. Child B's Mother saw CCSM 1 pull on a child's hoodie and yelled at him. The incident occurred around 4:15 p.m. CCSM 2 said Child B's Mother did not know the name of the child involved. CCSM 2 believes the child was Child A. CCSM 2 said she spoke with CCSM 1 who said she didn't recall the incident. CCSM 2 said CCSM 1 has changed her story a couple of times. CCSM 2 said she received an email from CCSM 1 on April 11, 2023, regarding the incident. During the interview, I received a copy of CCSM 1's email to CCSM 2. The email indicated the following, "CCSM 3 was going in to get a tissue for one of the kids nose then came back out and she took care of the kids nose then she went inside to throw it away then came back out. Then we got the kids to line up and she went for the door and it was lock she said she was going to unlock it from the inside. At the time I was trying to keep 8 kids in line and either Child A or Child C got out of line so I grabbed the hood gently. I didn't mean to grab him by the hood. I was just trying to keep him in line. Then I walked him back to the line and got down at his level 3 and said that he need to stay in line and then Child B's Mother open the door to get Child B." CCSM 2 said CCSM 1 has been placed on administrative leave. I asked if there were any security cameras on the playground and CCSM 2 said, no. CCSM 2 said she hasn't had any issues with CCSM 1 being inappropriate with the children. However, CCSM 2 has assisted and coached CCSM 1 with appropriate language and active supervision. I interviewed CCSM 3 who is a child care staff member in the toddler 1 classroom. The toddler playground is located immediately outside the classroom. She and CCSM 1 were on the playground with eight children. The door leading to the classroom was locked. CCSM 3 said she used the preschool classroom exit door to get back inside the building. Once inside the building, she went to the toddler 1 classroom to unlock the door. CCSM 3 said she did not witness the incident between CCSM 1 and Child A. CCSM 3 has concerns regarding CCSM 1 being inappropriate with the children. She had informed CCSM 2 previously that CCSM 1 is rough and abrupt with the children. According to CCSM 3, she and CCSM 1 were in the classroom with the children on April 11, 2023. There was one sensory bin for one child, and the other children were waiting for their turn. CCSM 3 said there were no other activities open. There were seven children standing around the table, watching one child play with the sensory bin. CCSM 3 said two children started to push to get a closer look at the bin. CCSM 1 took the two children and forced them to sit next to her on the carpet for at least 10 minutes. CCSM 3 said she usually has table toys out for the children. However, CCSM 1 didn't want to have other toys or areas open. When I asked if this happens often, CCSM 3 said she doesn't know. CCSM 3 said she doesn't usually work with CCSM 1. CCSM 1 works alone in the Infant Classroom. I spoke with CCSM 2 and provided technical assistance regarding having more toys available for the children. CCSM 2 said the child care center has more than enough toys. CCSM 2 said she'll make sure to speak with the child care staff members to ensure the toys are available for all the children. On April 24, 2023, I called and spoke with CCSM 1. CCSM 1 said she was outside on the playground with the children while CCSM 2 went inside the building to unlock the door so they could get in.
