    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On April 26, 2023, licensee designee, Ms. Candice Davies called and self-reported an incident. Child A's Mother saw child care staff member 1 yank Child A (male, 4 years old) by the coat, leaving a mark on his neck. '/2 On April 27, 2023, I received an incident report and picture of Child A's neck. The picture was taken by Child A's Mother on April 24, 2023. I reviewed the picture and noticed red marks located on Child A's neck, below his left ear. The red marks are raised and slightly red in color. According to the incident report, "Incident on April 24, 2023. On April 25, 2023. Ms. Davies was notified by CCSM 2 that CCSM 3 was upset about a situation. At that time CCSM 3 stated that she spoke to Child A's Mother who was upset that CCSM 1 had yanked Child A's coat at pick up and left a mark on his neck... At 9:00 am, Child A's Mother called and left a message to return call. At 12:00 pm, Ms. Davies called Child A's Mother to ask about what had happened. Child A's Mother stated that she was running late to pick up Child A. Child A was the last one and alone at the time of pick up. Child A's Mother stated she was in her car when she saw that Child A was standing between CCSM 1 and CCSM 3. CCSM 1's body language was frustrated. Child A's Mother stated she then saw CCSM 1 whip Child A back with physical force by his jacket. Child A was just chewing on his coat standing alone. When Child A's Mother got to the sidewalk to pick up Child A, CCSM 1 saw her and bolted inside the building to hide from her. Child A's Mother spoke to CCSM 3 who said that CCSM 1 was irritated with Child A because he is CCSM 1's hot button. CCSM 1 is frustrated with Child A. Child A's Mother stated that Child A had a mark on his neck made from the zipper. Child A's Mother then got in her car and called the classroom. CCSM 1 answered and said that Child A was not standing where she wanted him to, so she jerked him back in line forcibly. Child A's Mother stated that she then talked to CCSM 3 the following morning and CCSM 3 stated that CCSM 1 is mean to Child A. Child A frustrates CCSM 1 because he has attention deficit hyperactivity disorder (ADHD). Ms. Davies let Child A's Mother know that she would talk to the staff and see if there was footage and that this was not our policy... At 1:00 pm, Ms. Davies met with CCSM 3 to discuss the incident. CCSM 3 stated that they were outside at dismissal. She overheard CCSM 1 say, "That's disgusting, Child A" and, "Stand by me." CCSM 3 said Child A was between her and CCSM 1. CCSM 3 saw Child A's Mother pull up. CCSM 3 walked up to Child 3 A's Mother and asked how the doctor went. Child A's Mother seemed off. Child A's Mother asked what Child A was doing when she pulled up. CCSM 3 said Child A was chewing on his coat. CCSM 1 had gone inside as she always does after all the children are gone. CCSM 3 went inside. The phone rang and CCSM 1 answered. It was Child A's Mother. CCSM 3 heard CCSM 1 say, "Hit by the door" and "sorry" multiple times. CCSM 3 said when she spoke to Child A's Mother in the morning, Child A's Mother stated she saw CCSM 1's demeanor and that CCSM 1 yanked Child A and threw him down. CCSM 3 said that was not how Livingston Educational Service Agency (LESA) approaches children and that she'll let her supervisors know. CCSM 3 said she did not confirm anything with CCSM 1 but listened as that is usually what parents want. They want their voice to be heard. CCSM 3 stated that Child A's Mother said Child A repeatedly said that he doesn't like CCSM 1 or CCSM 3. CCSM 3 said that is hurtful as they have worked really hard on relationships. CCSM 3 said that she has had no concerns over the past years with CCSM 1 CCSM 3 stated she had no concerns that evening leaving the building." On April 27, 2023, I completed a face-to-face interview with Ms. Davies. Ms. Davies was not at the child care center during the incident. She was informed by CCSM 2 on April 25, 2023 that Child A's Mother was upset that CCSM 1 yanked
