On 09/21/2022, I made an unannounced on-site visit to the center. I explained the allegation to licensee designee/program director Ms. Amanda DeLisle. Ms. DeLisle believed the allegation was in reference to an incident that occurred on 08/08/2022 between Child A and child care staff member Mr. Tyler Lorenz. It was her understanding that Child A had been placed in a crib because he had hurt another child when he had thrown a toy at them. While in the crib, Child A attempted to climb out. When Mr. Lorenz noticed him climbing out of the crib, he tapped Child A on his bottom and told him no. Child A's Mother called Ms.DeLisle to discuss the matter with her and told her that she did not want to get anyone in trouble, but she thought Child A was upset and crying because Mr. Lorenz had hit him hard. After explaining to her what had happened, Child A's Mother said she just wanted staff to know that it is not okay to spank her child. Ms. DeLisle agreed with Child A's Mother and spoke to Mr. Lorenz about spanking and how it is never acceptable to use with children and that redirecting should be used instead. On 09/21/2022, I interviewed child care staff member Ms. Kim Lynn. She reported that she was not present the day the incident occurred. She has never seen Mr. Lorenz hit, tap or hurt a child. She stated, "He [Mr. Lorenz] is very kind." On 09/21/2022, I interviewed child care staff member Ms. Michelle Westerlund. She reported that she has never seen Mr. Lorenz hit, tap or tell a child no. "I think he [Mr. Loren] is good and doesn't get upset." On 09/21/2022, I interviewed child care staff member Ms. Sharon Randall. She stated that she has never seen Mr. Lorenz spank, tap or tell a child no. She has no concerns with how he interacts with the children and she stated, "He does really well." On 09/21/2022, I interviewed Ms. Kaylie Benson. She reported that she has never seen Mr. Lorenz spank, tap or tell a child no. She further reported that Child A is a child who likes to get into things; he climbs and sometimes hurts other children. Most of the time staff members will redirect him and on occasion will have to separate him so he does not continue hurting children. On 09/22/2022, I interviewed Child A's Mother. She stated that on the day the incident occurred, it was the end of the day and she had just walked into the center to pick Child A up. As she was standing at the gate to the infant/toddler room, she noticed that Child A was in a crib. When Child A saw her, he attempted to get out of the crib and that is when she saw Mr. Lorenz spank him on his bottom. Child A's Mother clarified that it was more of a swat than a spank. Mr. Lorenz used the open palm of his hand on Child A's diapered bottom, she could not hear the impact of his hand hitting Child A's bottom, there were no visible marks left on Child A and Child A did not appear to be hurt in any way after she took him home. Ms. DeLisle was not present at the center when this happened, so she called her to discuss the matter. Child A's Mother knows Child A is a bit "extra" and she can understand if he had done something, but she did not want Child A to be spanked by the child care staff 3 members. Child A's Mother was fine with how the situation was handled by Ms. DeLisle and since then she has not witnessed Child A being spanked or swatted on the bottom again. Child A's Mother also reported that in the past the crib had been used as a form of time out for Child A, but recently she not seen it being used in that manner. On 09/28/2022, I interviewed child care staff member Mr. Tyler Lorenz. Mr. Lorenz reported that he was working in the infant/toddler room along with child care staff member Ms. Dakotha Larive on the day the incident occurred. Child A was being aggressive and hitting another child with a toy. He picked Child A up and moved him away from the other child. Child care staff member Mr. Tyler Lorenz did not use appropriate care when he placed Child A into the crib as a means of separating him form the other child care children. On 03/09/2021, I received an incident report from program director and licensee designee, Ms. Amanda DeLisle. The report indicated that on the evening of 02/23/2021, Child A's Mother had contacted Ms. DeLisle by telephone. She reported to Ms. DeLisle that Child A (male, 3 years) told her that CCSM 1 had spanked Child B on the butt. Ms. DeLisle then telephoned Child B's Mother and informed her of the allegation. Child B's Mother stated that she would talk with Child B and let her know what he said about this. Child B's Mother called Ms. DeLisle back immediately and told her that Child B said no when asked if any teacher had spanked him but when he was asked if CCSM 1 spanked him, he said that CCSM 1 makes him feels sad and has spanked his butt. Ms. DeLisle confirmed through an email to me that she let CCSM 1 go the morning after her conversations with Child A's Mother and Child B's Mother the night before. We had previous conversations about this before the date of the incident report and before this investigation was opened. Ms. DeLisle had explained to me in those conversations that she really did not know if CCSM 1 had indeed spanked any child. However, things were not really a good fit with CCSM 1 and Ms. DeLisle had decided to let CCSM 1 go. Note: The center had a planned closure from 03/11/2021 until 03/24/2021. On 03/09/2021, I spoke with Ms. DeLisle by telephone due to the upcoming center closure and notified her that a special investigation had been opened. I spoke with Child B's Mother. She explained that Ms. DeLisle had called her and told her that another child had said that CCSM 1 had spanked Child B. Child B's Mother explained that she had asked Child B and then asked again over a few days. Child B stated that CCSM 1 makes him sad, but she actually spanked Child C (male, 3 years), and not Child B. Child B's Mother explained that she really would not doubt that Child B was spanked by CCSM 1, but Child B said over time that CCSM 1 spanked Child C. 3 On 03/22/2021, I spoke with CCSM 2. She stated that she really did not know anything about this situation. She was aware that CCSM 1 had been let go, but she wasn't really sure why she was let go. CCSM 2 stated that she has never spanked a child at the child care or seen any child care staff member spank a child at the child care. She has no concerns with the care and supervision of children at the center. I spoke with Child C, D, and E's Mother. She stated that Child C has not said anything about being spanked and she knew about this allegation because Ms. DeLisle had told her. Child C, Child D, and Child E liked CCSM 1. Child C, D, and E's Mother has no concerns with the center. She thinks Ms. DeLisle is absolutely amazing and seems to handle issues appropriately and with concern. On 03/24/2021, I spoke with Child A's Mother. She stated that Child A had said that he was never spanked at the center, but he has said that Child B and Child C were spanked by CCSM 1. Child A generally does not make things up and he has a wide vocabulary. Ms. DeLisle is awesome and she trusts everything about the center. On 03/31/2021, I conducted an on-site inspection and interviewed all child care staff members that were present. CCSM 2 stated that she does not have any information about spanking and she has never seen a child spanked at the center. CCSM 3 stated that she has never seen a child spanked at the center. She was aware that Ms. DeLisle had let CCSM 1 go and she is aware of the allegation. CCSM 4 stated that she knew that CCSM 1 had been let go, but she had no direct knowledge of CCSM 1 ever spanking a child and she has never seen any child spanked at the center by any child care staff member. Ms. DeLisle and I reviewed the allegation. We discussed that she had let CCSM 1 go after hearing about the possible spanking incident. Ms. DeLisle explained again that things had not been a great fit and there had been problems before this allegation with CCSM 1. She explained that whether

Ms. DeLisle did not ensure in each room or well-defined space, the ratio of caregivers to children for preschoolers 30 months of age until 3 years of age was 1 caregiver for 8 children. On 03/31/2021, I observed 9 children in the Preschool Room from 1:56-2:05pm cared for by CCSM 2 only. One child was under three years of age. Therefore, another child care staff member was needed.
