On April 21, 2022, I made an unannounced onsite inspection to the child care center. I interviewed Regina Fancher, program director. Prior to this visit, Ms. Fancher made me aware of the child care center's plans to upgrade the outdoor play area and that they had hired a contractor to complete the work. Upon my arrival, we viewed the outdoor play area. The contractor had already started pulling up the old black top and had taken down most of the old fence. Part of the new fence was installed. Some of the old playground equipment was still piled up waiting to be discarded. During this transition, the child care center was using a local park for outdoor play. This park was approved as an alternative outdoor play area when the center was originally licensed on September 18, 2015. On April 27, 2022, I met Fire Safety Inspector Gerald Rodabaugh, Fire Safety Inspector Dave Boomer, and Leo Allaire, Assistant Fire Chief for Delhi Township, at the child care center for reasons completely unrelated to this investigation. But while they were onsite, they looked over the outdoor play area, which was not yet 2 completed, and felt the new fence and gate would be better for evacuation and presented no fire hazards. Santrece Roberts, licensee designee and co-owner Trent Roberts were also present for this inspection. The outdoor play area upgrade and finished May 23, 2022. Rubber mulch covers the area the young children will play and there is still a cement area available for when the children use riding equipment. During my telephone interview with the Complainant, concern was expressed for the condition of the playground. It was stated that the fence was in poor condition and the gates barely worked, the equipment was in poor condition and placed on a black top surface. I informed the Complainant that the center contracted a construction company to tear out the black top and build a fence. This was in progress at the time of the complaint. Ms. Roberts also purchased new equipment. The construction project was delayed due to weather but was now complete. The Complainant had not seen the outdoor play area prior to the date of the complaint and has not seen it since. The Complainant did not know the outdoor play area was in the process of being renovated but was happy to hear it was safe for the children. During the exit conference with Santrece Roberts, I expressed appreciation regarding the time and effort that went in to renovating the outdoor play area.

(13) All pieces of playground equipment that have an elevated playing or climbing surface, regardless of the height of the playing or climbing surface, must be surrounded by a shock absorbing surface and meet the guidelines defined by the Consumer Product Safety Commission (CPSC) Handbook for Public Playground Safety, which is available at no cost at www.cpsc.gov. This handbook is also available for inspection, and distribution at no cost, at the Michigan Department of Licensing and Regulatory Affairs, Bureau of Community and Health Systems, Child Care Division, 611 West Ottawa Street, Lansing, MI 48933. On January 26, 2021, I interviewed Regina Fancher, kro ram director. She was unaware of any concerns that Child L was being hit by I also interviewed Dori Stehle, staff member. Ms. Stehle has not seen anyone hitting any of the children and understood that she is a mandated reporter. 2 Child L's Mother stated that on January 25, 2021, she asked to see videos from December 17, 2020 and January 22, 2021. She claimed that she was informed that the videos were erased. The video cameras at the child care were 0 a statement in the complaint that Child L had a bump on head and "erewas no explanation for it mother was not notified. On February 3, 2021. and I interviewed , Dori Stehle, Amy Duckert, and Georgia Owens,"astaff members. We,Paso"in rviewed Reotna Fancher, program director and Santrece Roberts and Trent Roberts, owners. said she has never hit a child at the child care center and was surprise d saddened that someone accused her of hitting a child. She stated that it was not true. She has not observed any staff members hitting or mistreating Child L or any other children. If she observed this type of behavior, she would immediately report it to Ms. Fancher. She also knew about mandated reporting laws. Dori Stehle has never seen anyone hit Child L. She said the center has a discipline policy and you cannot use physical discipline. Ms. Stehle said she would report any abuse or neglect to management and call into Children's Protective Services. Amy Duckert is a substitute child care staff member. She has been a substitute in the room and knew Child L. She has never seen Child L or any other child care child abused or neglected. Ms. Duckert stated that she never saw any bruises or injuries on Child L. She stated that Child L is a quiet, well-behaved child. Ms. Duckert knew she was a mandated reporter. Georgia (Josie) Owens said she has never seen or heard about any staff member harming a child. She does not believe any of them would hit a child for any reason. Ms. Owens knew that she is a mandated reporter_ Owners, Santrece Roberts and Trent Roberts, and program director, Regina Fancher, all denied ever hitting a child care child. They have also not had staff members report to them that other staff members have been abusive to the children. I informed Ms. Roberts and Ms. Fancher that the staff knew about mandated reporting and that they had to report it as soon as possible. They were unsure how to make contact with Children's Protective Services. Ms. Roberts agreed that she would post the reporting telephone number in the office and kitchen. She would inform all staff where the telephone number was located and where the required reporting form could be located in the office.
