R 400.1903 · R 400.1903 Licensee responsibilities. Responsibilities. (1) A licensee shall be responsible for all of the following provisions: (g) Report to the department within, 3 business days, any changes in the household composition or when any new or existing member of the household or child care personnel has any of the following: (i) An arrest. (ii) A conviction. (iii) An arraignment for an offense that if convicted would lead to that individual's ineligibility to be connected with a child care home. (iv) Is being investigated by the state department of health and human services for an allegation of child abuse or neglect. (v) Is under court supervised parole or probation. (vi) Has been admitted to, or released from, a correctional facility. (vii) Has been admitted to or released from a health facility or agency that was providing mental health or substance use disorder treatment services to the individual.

On 7/20/2022 I spoke to stated she and law enforcement have already been to the home. She indicated that interviews were conducted with the Ms. Mier, and other members. Ms. Mier agreed to close her child care until after the forensic interview is completed and further information about the allegations can be gathered. The forensic interview is scheduled for 8/10/2022. agreed to go out to the child care family home with me on 8/3/2022. She advised that she already informed Ms. Mier that child care licensing was notified and would be involved. On 8/3/2022 I completed an unannounced on-site inspection at the child care family home. did not attend the visit. I interviewed Michelle Mier. She stated that she has been closed for the past three weeks because of this allegation. She confirmed that MHM 1 is not staying in the home at this time and that there is a forensic interview scheduled for 8/10/2022. I asked her if she reported the investigation to her licensing consultant, Dawnita Diaz, and she stated she did not report it because she did not know she was supposed to. I explained that she is required to report any investigations involving herself or adult household members with MHDDS. Ms. Mier stated she believed it was completely unrelated to her child care license because the allegation was not made by a child care child. On 8/12/2022, - left me a message stating that she is closing her _ investigation and that the allegations will remain unsubstantiated. She noted that the forensic interview did not have a credible disclosure. On 8/22/2022 I spoke to - She stated that there were no credible disclosures during the forensic interview. She stated that law enforcement will send the report to the prosecutor per protocol but there will be no rosecutions. ■ and Mrs. Mier have placed MHM 1 at another location for now. told Ms. Mier that she can resume her child care business so as far as she knows, Ms. Mier is open and operating at this time.
