    On 5/1/2023 I spoke to Child A's Mother. Child A has been attending the child care facility for approximately nine weeks. She acknowledged being aware of the incident and stated, "I'm really hoping they won't get in trouble as a result of this." I explained the process for the investigation and how the department looks to identify whether any rules were violated, which included corporal punishment. Child A's Mother reported that the class was at maximum capacity and ratio on the day of the incident and that all child care children had "little moods going on." Child A's Mother informed me that after Child A pushed another child over, Child Care Staff Member (CCSM)1 Child A gave her a "light swat" on her bottom as she was being picked up. Child A's Mother stated that CCSM 1 "immediately crumbled" after this occurred. Child A's Mother stated that she believes in her "heart of hearts" that this was an isolated incident and reported that she felt bad for CCSM 1 because of the impact it had on her. Child A's Mother then started to list numerous things that she believed the center consistently excelled in and reported having "no animosities to CCSM 1 or the school." On 5/15/2023 I made an onsite inspection at the child care facility, Lakeshore Little People's Place - Providence where I interviewed the Program Director, Ms. Linda Kisner, CCSM 1, CCSM 2, and CCSM 3. Ms. Kisner informed me that she found out about the incident on 3/9/2023, a day after it occurred. Ms. Kisner stated that on the day of the incident, both she and the assistant director Ms. Mallory Millar were at a director's meeting off-sight. Ms. Kisner reported that after she returned to the center and spoke to CCSM 1 at which time CCSM 1 submitted her resignation. Ms. Kisner stated that Child A's Parents were not upset, and that they were "actually very apologetic for how [Child A's] behavior was that day." CCSM 1 reported that the incident occurred on 3/8/2023 and that it was shortly after lunch while the children were having free play. On the day the incident occurred they were operating at a 12:3 ratio; however, CCSM 1 reported that another CCSM was having a 1:1 with another child care child in the classroom, and did not witness the incident. CCSM1 reported that despite having the three CCSMs in the room, it felt more like they were operating at a 11:2 ratio. CCSM1 stated that in addition to the other CCSM having a 1:1 with another child care child, Child A was also having difficulties. CCSM 1 stated that they could not maintain a 1:1 with Child A due to the number of children and child care staff members present. CCSM 1 had been using "conscious discipline" with Child A prior to the incident occurring that day. On this day, CCSM 1 said Child A was "picking" on another child which she noted to be ongoing scratching and pushing." CCSM 1 stated that during this day, Child A was just generally picking on the children that were "smaller than her." After separating Child A from the other child several times, Child A eventually made contact with the other child. CCSM 1 saw Child A "diving towards another girl to push her over." CCSM 1 stated that when this happened, she grabbed Child A and picked her up, to 3 prevent her from assaulting the other child. CCSM 1 stated that she then "instinctually" gave Child A a "tap on the butt." " CCSM 1 stated that as soon as tapped Child A on the bottom, she said, "oh no, I did not just do that." CCSM 1 stated that as soon as this occurred, she was aware this was inappropriate and knew at this time that it was time for her to resign from the child care facility as she was "burned out." CCSM 1 also told me that while she had been thinking about resigning prior to this incident, she did not have any set date in mind, but that she was aware that she was not operating as good as she should have while at the center.     On 11/2/2022 I left a voicemail message for Child A's Mother. On 11/7/2022 I conducted an onsite inspection at the child care facility Lakeshore Little People's Place - Providence. During the inspection, I interviewed the Assistant Director Ms. Mallory Millar, and the child care staff members Ms. Crystal VanBeek, Ms. Rebekah Skinner, Ms. Rowan Stall, and Ms. Mikaela Turrell. Ms. Millar advised that she was not present at the child care center during the accident where Child A was standing on a bench and fell lacerating his lip. Ms. Millar did not have any additional information not listed in the incident report provided to the department pertaining to the fall. Ms. Van Beek reported that on the day of the incident she arrived at approximately 11:00 AM. Child A was standing on a small bench located in the classroom. The child care children typically stand on the bench due to their fascination with watching the bird feeder, watching for their parents, and seeing garbage trucks pass. Child A was on a "standing bench" with another child when he fell. Ms. Van Beek did not personally witness the fall but turned to look after hearing the noise. Child A insisted he was pushed from the bench. Ms. Van Beek she does not believe the bench was designed for children to stand, but this was common practice amongst the toddlers, and that the child care staff members only redirect the children if there are too many children or if they start to become "rowdy." Ms. Van Beek disclosed that while she did not physically see Child A fall from the bench, she heard the fall while she was assisting another child in the classroom. Ms. Van Beek denied having any concerns 3 regarding the care and supervision that Ms. Skinner, Ms. Staal, or Ms. Turrell provided. Ms. Skinner informed me that she was present during the day of the injury but denied witnessing Child A fall from the bench. Ms. Skinner stated that Ms. Staal was also in the class at the time as a "floater" and that she was the closest staff member to Child A when he fell. Ms. Skinner also reported that Ms. Turrell did not witness the fall, as she was reading to other children in the classroom. Ms. Skinner acknowledged that the bench is regularly used in the classroom by the children to primarily watch the bird feeder. On the day Child A fell, Ms. Skinner believed it was due to him and another child "vying for space." It was Ms. Skinner's belief that the other child present on the bench "pushed" Child A off the bench. Ms. Skinner denied that there was any shock absorption surfacing beneath the bench, and stated that since the fall, they have repositioned the bench, so it is directly next to a larger climber that contained a handrail. Ms. Skinner identified the injury as "very clean," and noted that there was not much blood, but that it became swollen almost immediately. Ms. Skinner denied that Child A made contact with any additional objects (outside landing on the floor) during the fall. Ms. Staal reported that she was assisting as a floater in the toddler room at the time Child A fell from the bench. Ms. Stall witnessed the fall and reported that Child A and other child were "jumping" on the bench shortly before he fell, hitting his lip on the corner of the bench. While Ms. Staal confirmed that they do allow the child care children to stand on the bench; however, she also reported that they always redirect the children when they notice they're jumping on the bench. Ms. Turrell reported that the incident had occurred at approximately 11:00 AM, and that they were preparing for snack during the time Child A fell from the bench. Ms. Turrell denied physically witnessing the incident occur, but she heard a "thud" after he fell. She immediately went to attend to Child A and that after cleaning the laceration, they decided that Child A's parents should be notified. Child A was standing on the bench to observe the bird feeder prior to falling. While she did not believe Child A was "rough housing," it was

    On 11/30/2022 I received an email correspondence from the Program Director Mrs. Linda Kisner that contained an unrelated incident report. The incident report noted an injury to Child B which also pertained to care and supervision. The current investigation occurred in the same room with the same child care staff members as the previous allegation. On 12/7/2022 I made an onsite inspection at the child care facility. During the inspection I interviewed Mrs. Kisner and the child care staff members Ms. Mikaela Turrell and Ms. Crystel Van Beek. Mrs. Kisner reported that she was present in the building at the time Child B was injured. She was in the toddler room just before the incident occurred, noting that approximately one to two minutes after walking out, she heard the child care staff members calling her back to the room to request assistance. Mrs. Kisner reported that the children had just come from outside, and that two children had begun to run around the circle table located in the classroom, at which time Child B fell and chipped his tooth. Mrs. Kisner stated that she contacted Child B's parents, and she has requested Child B's dental documentation from Child B's parents. Mrs. Kisner stated that because of the fall, Child B required a root canal and crown on his chipped tooth. Ms. Turrell reported that the classroom had just returned from outside and that this occurred shortly before lunch. Ms. Turrell stated that Ms. Van Beek was assisting children with putting away their snow gear, while a third child care staff member, Ms. Dana Buri, was outside the classroom assisting the children with removing their coats, snowpants, and boots. Ms. Turrell informed me that Ms. Buri was not physically present in the room during Child B's injury. Ms. Turrell said that both she and Ms. Van Beek were on the opposite side of the room where Child B fell. Ms. Turrell was assisting a child when she heard Child B fall and begin to cry. Ms. Turrell stated that Ms. Van Beek was the one that got to Child B first, at which time she noticed that Child B chipped his front tooth. Ms. Turrell reported that they were not able to recover the missing portion of Child B's tooth. Ms. Turrell informed me that it was "pretty common" for the children to run around the table after returning from outside. Despite that this was a common occurrence, Ms. Turrell advised that they always intervene and redirect when they observe the children running around the table. She also informed me that they had previously allowed children to play beneath the table, but they have since ended this practice as they believed it was confusing to the children. Ms. Van Beek stated that at approximately 11:20 AM, shortly after returning to the class from playing outside, Child B went to the bench near the window and began to look outside. Ms. Van Beek said that she did not observe Child B physically fall as she was assisting the children in taking off their snow gear. Ms. Van Beek also stated Ms. Turrell was also assisting another child, and Ms. Buri had not yet returned inside the classroom as she was assisting a group of children remove their snow gear in the hallway. After asking if the child care children typically run around the table she responded, "they're 2, so they run." Ms. Van Beek stated that while they do not allow the child care children to run around the table, they do redirect them when it occurs. Ms. Van 7 Beek stated that on this occasion, Child B was running with another child and Child B "faceplanted and chipped his tooth." Ms. Van Beek noted that she was the first to reach Child B, at which time she noticed his front tooth was chipped. She reported that she tried to keep him calm while they administered ice and contacted Child B's parents. Ms. Van Beek stated that they had previously allowed the children to play beneath and around the table during free time, but they have since discontinued this practice.     On 9/28/2020 I conducted an onsite inspection at Lakeshore Little People's Place — Providence. During the inspection, I spoke with the Program Director Alicia Zandstra, and I interviewed the child care staff members Ms. Rebekah Skinner, Ms. Jenna Gerrits, and Ms. Alma Cornado-Jimenez. Ms. Skinner informed me that the incident occurred on 9/22/2020 during the last half-hour of the day. She stated that she had two toddlers, Child A and Child C, in her care and took them to the outdoor play area where she saw Ms. Cornado- Jimenez present with one child from the Little Tots classroom and Ms. Gerrits with one baby from the infant room. Ms. Skinner noted that while she was outside with her group, Child C would not stop crying, which prompted Ms. Cornado-Jimenez to offer to take Child C for a walk with the child she was carrying for, Child B, who is also the sibling of Child A. Ms. Skinner stated that while this was occurring, one of the other child care parents had arrived at the facility and Ms. Gerrits went inside with the child she was caring for to assist the parent. Ms. Skinner stated that almost immediately after Ms. Gerrits went inside with the infant, she was providing care for, Ms. Cornado-Jimenez also went inside with Child B and Child C to take them for a walk. Ms. Skinner stated that she then began to clean the outdoor play area as they were preparing to close. Ms. Skinner stated that Child A was sitting in the stroller while she cleaned the outdoor play area. After Ms. Skinner cleaned up the outdoor play area, she returned inside the facility and forgot to bring Child A with her. Before realizing she forgot to bring Child A with her, Ms. Skinner approached Ms. Gerrits and asked if Child A and Child B had been picked up. Ms. Gerrits then informed Ms. Skinner that Child B was currently on a walk with Ms. Cornado-Jimenez, and that they had not been picked up. Ms. Skinner stated that she then realized that she left Child A in the stroller outside. Ms. Skinner then immediately returned outside and observed Child A sitting in the stroller. When asked how long she believed Child A was left outside unattended, Ms. Skinner said it was approximately one minute. Ms. Skinner then informed me that she was new to working at the child care facility, and attributed the confusion to Child C returning 3 inside with Ms. Cornado-Jimenez. Ms. Skinner stated that there is a count procedure that child care staff members are supposed to complete to assure children are not left unaccounted for, which she admitted to not completing. I asked if Ms. Skinner informed Child A and Child B's Mother about the incident, which she did not, but stated that another child care staff member informed her. Ms. Gerrits informed me that Ms. Skinner had been outside with two toddlers, Child A and Child C, and that she and Ms. Cornado-Jimenez were also outside. Ms. Gerrits stated that while they were all on the playground, there was a ratio of 3 child care staff members and 4 child care children. Ms. Gerrits noted that Ms. Skinner appeared to be "struggling" with the two children, due to Child C was having a tantrum. Ms. Gerrits stated Ms. Cornado-Jimenez offered to assist Ms. Skinner by taking Child C back into the facility to go for a walk with Child B. Ms. Gerrits noted that during this time, another parent arrived at the child care facility, and she returned inside with the child she was providing care for to assist the parent. Ms. Gerrits stated that Ms. Skinner was then outside with a 1:1 ratio with Child A. Ms. Gerrits stated that after a few minutes Ms. Skinner had returned inside the child care facility and asked her if Child A and Child B had been picked up by their parent. Ms. Gerrits then informed Ms. Skinner that Child A was in her care and that Child B was still with Ms. Cornado-Jimenez. Ms. Gerrits reported that Ms. Skinner then went outside and got Child A. Ms. Gerrits stated that while she was unsure how long Child A was left outside unaccounted f
