    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 03/16/2023, an incident report was received from the center. The incident report detailed that Child A was left unsupervised in the classroom. It said that a name to face was completed at 11:05 AM and the classroom went outside at 11:10 AM. At 11:14 AM, Child Care Staff Member 3 (CCSM 3) went outside and they then realized Child A was missing. On 03/16/2023, I spoke with Child A's Mother about the incident. She reported that she received a phone call from the center to inform her that Child A had been left inside the classroom, asleep, while the rest of the children went outside to play. The center told her that she was only in the classroom unsupervised for a few minutes. She was told that the classroom lined up and the staff did not notice that she had slipped out of the line to go lay down. The classroom did a head count outside and realized she was not with them. Child A's Mother explained that Child A has not been feeling well lately and has been very sleepy. She is not concerned about the incident because Child A is fine, was asleep and unaware, and it was only a couple minutes. The center did not tell her how long Child A was inside alone or when it occurred. They contacted her in the afternoon. She said that there were no prior incidents of issues with supervision and Child A has a twin that attends there too. On 03/23/2023, I completed an unannounced on-site inspection and spoke with program director Raquel Diaz. Ms. Diaz reported that she was at a meeting when the incident occurred and CCSM 3 was in charge of the center. Ms. Diaz reported that there were 11 children aged 4 years and older in the care of 2 child care staff members. Child Care Staff Member 4 (CCSM 4) is the lead caregiver and was not working that day. Ms. Diaz said that CCSM 4 is transitioning to the classroom after having worked in the infant room and she is going back and forth between the PreK and Infant classrooms. I interviewed CCSM 3 who reported that Child A's Mother called the center to check on Child A, so she went to the preschool room to give the phone to Child Care Staff Member 1 (CCSM 1). She went outside and gave the phone to CCSM 1 who went into the PreK classroom to take the call. Child A was in the PreK classroom at the time. CCSM 3 completed a name to face because the name to face policy requires that one be completed when a new child care staff member comes in. She noticed Child A was not with them, so she opened up the preschool classroom door to ask the preschool classroom If Child A was with them and at that moment CCSM 1 came out with Child A. CCSM 3 said that she looked at the phone log to see what time Child A's Mother called and the name to face sheet to see when they went outside to determine how long Child A was unsupervised. She said that it was less than 5 minutes. CCSM 1 said that she did a training on Monday for the child care staff members on how to complete the name to face process. They have added that it will 3 be completed when they go through the doorway as opposed to when they are lining up. I interviewed CCSM 1 who reported that she was in the charge of the classroom on 3/15/2023 because CCSM 4 was not in the classroom at the time. CCSM 1 said that it was chaotic that day due to children with challenging behaviors. She explained that there was a child that was fighting with another child when they were lining up. The child had attempted to choke CCSM 1 earlier, so she was working to stop him. The children were not staying in a line and were dispersing everywhere. She described things as "chaotic." The name to face process was completed but she did not see Child A walk away. She completed the name to face process again at the gate on the playground but somehow skipped Child A and "must have double counted a child." CCSM 1 said that CCSM 3 came outside with the phone so she went into the preschool classroom and then the hallway so she could hear. She was talking to Child A's Mother and after the phone call ended
