    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 3/30/2022, I spoke with Child A's Mother who reported that the center called her and told her that her son was left outside for a few minutes and was calm and not crying when they found him. Child A's Mother said that when she picked him up, she was told that he had tears in his eyes and the following day was told that he was outside for more than 15 minutes. She was also told that on the camera footage, her son was observed running end to end on the playground but not showing any emotion. She explained that she talked to Child A about the 611 W. OTTAWA. On 4/15/2022, I completed an on-site inspection and interviewed center director Kelly Robertson about the incident. Ms. Robertson reported that the classroom had 3 Child Care Staff Members (CCSMs), Lupita Juarez, Christine Velderman and Samantha Santellon-Malinowski, with 14 children when the incident occurred. Ms. Juarez and Ms. Velderman were responsible for the incident, and both were terminated. Ms. Juarez came in with the children while Ms. Velderman was behind her dealing with a child who refusing to go inside. The third CCSM Samantha Santellon-Malinowski was inside with a child that had to use the bathroom. Ms. Robertson explained that she was standing in the entryway as the classroom entered and Ms. Juarez asked her to help her get the children inside. As Ms. Robertson was moving towards the door, Ms. Velderman came up to the door and told her, "I got it." Ms. Santellon-Milanowski was still inside the building at the time. Ms. Robertson was notified later that Child A had been left on the playground. Ms. Robertson reported that CCSMs are expected to complete a name to face and count the children when they exit the playground, at the dumpster, at the building door, and when they enter their classroom. There is no written policy detailing the name to face threshold requirements other than as they enter and leave the building but CCSMs are trained to follow those guidelines. I viewed a video recording of the incident. The playground is on the center property, but it is not directly adjacent to the building. At 11:15 AM, Ms. Juarez entered the building with a group of children and at 11:16 AM, Ms. Velderman enters with one child. At 11:36 AM, Ms. Juarez exits the building and goes to Child A who was on the playground. On 05/04/2022, I spoke with Ms. Velderman who was the lead caregiver of the classroom. She reported that when the incident occurred, she was dealing with Child B (male, 4 years old) who was trying to run away after he had just hit Ms. Juarez. Ms. Velderman explained that she had just counted the children before she took over dealing with Child B while Ms. Juarez led the group out of the playground. Ms. Velderman was the last one to leave the playground and she locked the gate as she exited. She reported that once she was inside, the classroom was getting diaper changes and using the bathroom. She counted the children again as the children were getting ready for lunch and that was when they discovered that Child A was missing. She explained that her classroom normally has a behavioral aid and another CCSM, but they were not working that day. She said that as she passed Ms. Robertson by the door, she asked her if she had made sure they had all the children and Ms. Robertson responded, "I don't know." Ms. Velderman reported that Child B has a one-on-one aid assigned to him due to his violent behaviors and the aid went inside the building without Ms. Velderman's knowledge. Ms. Velderman said that she was not trained in using a name to face process for transitioning children and the center does not have a policy for transitions. 611 W. OTTAWA. P.O. BOX 30664.
