On 11/07/2022 Child A (4-month-old) was left alone in the atrium area in a stroller next to the infant gross motor area.

Child A (female, 4 years old) is treated unfairly because she has special needs. The doctor said Child A is not to nap, but the center refuses and gives her naps. Child A gets sent home for being lethargic, but it is part of her disability. Child A got sent home for a runny nose despite having a doctor's note saying she was ok. The school tried to change Child A's school schedule without Child A's mother's consent.

On 11/07/2022 I received an incident report from Ms. McKim stating that Child A was left unattended by Ms. Walker in the infant gross motor area on 11/07/2022. There were six children present with three child care staff members when the incident occurred at 11:00 am. The child care staff member to child ratio is 1 to 4. On 11/14/2022 Ms. McKim and Ms. Kidd stated that they were informed by Ms. Brooks that Child A was left unattended in the infant gross motor area. The infant gross motor area is an enclosed area located within the atrium area located approximately 68 feet away from the Infant classroom. There are no doors on the atrium area and the classroom is around the corner and cannot be observed from the atrium area. Ms. Walker was suspended for one day, 11/08/2022. Ms. Walker is Child A's primary caregiver and she stated that there were six children with Ms. Walker and Ms. Perrego in the infant classroom when they took the infants to the gross motor area from 10:30 am to 11:00 am. At 11:00 am Ms. Cook arrived, and Ms. Perrego and Ms. Cook returned to the classroom with, she thought, five children because she had one child inside the infant gross motor area with her. She did not realize that Child A was in the stroller outside of the infant gross motor area. The area is open, and the stroller is taller than the infant gross motor area. Ms. Walker stated that she stepped over the side of the infant gross motor area and did not look behind her, which was why she did not see Child A sitting in the stroller before she left the area. Ms. Walker and Ms. Perrego had transported the children to the gross motor area in two strollers. When she returned to the classroom there was only one stroller, but she did not pay any attention to that. She helped to remove the children from the four-seat stroller. When she was helping to get the children ready for lunch, Ms. Cook asked her where Child A was, and she thought that Child A was in the classroom. When Child A was not in the classroom, Ms. Walker ran back to the infant gross motor area, and she observed Child A with Ms. Luas. Child A was crying, and she returned her to the classroom. Ms. Walker thinks it was about six or seven minutes that Child A was left alone. Normally the staff and children return to the classroom together, but on 11/07/2022 she stayed back to return the toys and make sure that the area was clean before she returned to the classroom. When Ms. Perrego and Ms. Cook returned to the classroom, they did not inform Ms. Walker that Child A was left with her in the stroller. Ms. Walker informed Ms. Brooks that Child A had been left unsupervised in the infant gross motor area and she informed Child A's Mother. Ms. Perrego stated that she was in the infant gross motor area with Ms. Walker from 10:15 am- 11:00 am. At 11:00 am Ms. Cook arrived, and they started placing the children in the strollers to return to the classroom. Ms. Perrego handed the children 3 to Ms. Cook, and she placed them in the stroller outside of the infant gross motor area. Ms. Perrego informed Ms. Walker that Child A was in the stroller before they returned to the classroom. Ms. Walker had one child in the infant gross motor area with her. When they returned to the classroom, the two-seat stroller was left for Ms. Walker to add the second child to return to the classroom with the stroller. The stroller was next to Ms. Walker's shoes, so Ms. Perrego was not sure how Ms. Walker did not see the stroller or Child A. Ms. Perrego stated that when Ms. Walker returned to the classroom, she was preparing the children's lunches and she did not notice that Child A was missing until Ms. Walker returned to the classroom upset, with Child A. Ms. Cook stated that she was scheduled to start work at 11:00 am on 11/07/2022. She arrived early, and the class was in the infant gross motor area, so she joined them. On 11/1/2022, I called Child A's mother. There was no answer. I left a voicemail message. On 11/3/2022, I completed an onsite inspection. I spoke with program director, Jennifer Kidd, and licensee designee, Lynn McKim. They gave me a copy of the doctors note dated 4/12/2022 that said, "No naps as contribute to sleep patterns and daytime fatigue". Ms. Kidd and Ms. McKim explained that Child A is in their care from 8 am to 12 noon at which time she is walked down the hall to a special education preschool program. Child A attends the special education program from 12 noon to 3 pm and then is brought back to the early education child care from 3 pm — 6 pm. On Fridays there is no special education preschool program offered, so Child A is in the early education child care program all day. It is only on Fridays that Child A is in their care and present for nap time. Ms. Kidd and Ms. McKim stated sometimes Child A doesn't sleep well at night and comes to the center very exhausted. They do not make her go to sleep, and do not lay her down on a cot, but sometimes she does fall asleep, and they cannot keep her awake. The staff have spoken to Child A's father who agreed that if she is so tired that she is falling asleep at the table or while standing up, they should let her sleep. Ms. Kidd and Ms. McKim stated that Child A was never sent home because of her disabilities. If anything, they said the center went above and beyond to accommodate Child A. They provided me with two Sick Child Observation Forms. Child A was sent home on 9/19/2022 because she had a fever of 101 or higher, unusual drowsiness without explanation, discharge from eyes, and could not participate comfortably in routine activities. Child A was sent home on 10/4/2022 for unusual drowsiness without explanation, persistent cough, and could not participate comfortably in routine activities. There was a virus going around the center during the week of 10/10/2022. On 10/13/2022 Child A had a runny nose and was coughing a lot. The center asked that Child A be picked up and taken to the doctor since something had been spreading through the center. Child A's mother and father did pick her up and take her to an Urgent Care. They returned to the center the same day with a note from the doctor that said Child A was cleared for school and could return. Child A has not been sent home since they received the note on 10/13/2022. Ms. Kidd and Ms. McKim did not recall a schedule change for Child A. Child A did move from the 2-year-old special education preschool to the 4-year-old special 3 education preschool this fall, but that is the only schedule change they could think of, and the parents were aware of this. On 11/3/2022, I spoke with staff member, Hattie Thomason. Ms. Thomason is the lead caregiver in the early education 4-year-old preschool. She stated that Child A is in her classroom from 7 am — 12 noon and then again from 3 pm — 6pm Monday thru Thursday and in her classroom from 7 am — 6 pm on Fridays. Ms. Thomason stated that when Child A doesn't take naps in her classroom, but sometimes she comes to her classroom in the afternoons, very tired. Child A has fallen asleep while standing up and in her "safe spot". Her safe spot was made as a place for her to go where she can be alone in the classroom. Child A's father had said that if Child A is that tired, to let her sleep. Ms. Thomason does not remember Child A being sent home from school except on 10/4/2022. Child A had a rash a few days prior and on 10/4/2022 Child A was coughing and not being her usual bubbly self. She was not happy and did not want to participate in activities. Ms. Thomason denies that Child A was ever sent home due to her disabilities. On 11/3/2022, I spoke with staff member Marnie Ryan. Ms. Ryan is the assistant staff member in Child A's classroom. Ms. Ryan stated that all the staff love Child A. Child A is taken care of very well at the center. They give her extra attention because she has extra needs. Chil

On 04/29/2022 the complainant stated that her son has asthma and since the start of the construction at the center in February, he has had a cough and sinus issues. She believes that there is mold and Asbestos in the building. The doctor stated that her son is allergic to mold. She has not voiced her concerns to anyone at the center. I requested the report from the doctor relating to her son being sick, but I did not receive the doctor's report. On 04/29/2022 Ms. Hancock and Ms. Stober stated that on March 15, 2022, they submitted a complaint form to Jennifer Kidd, program director, voicing their concerns about the air quality in the classroom, and they received an air filtration system, and 2 the vents in the classroom were cleaned. The air filtration system was removed one or two weeks ago in April. They did not observe mold in the classroom. On 04/29/2022 I did not observe any mold or dark areas in the center or classrooms. I did not smell construction dust in the building. On 05/10/2022 Ms. McKim stated that she was informed that there were child care Staff Members that had concerns about the air quality in the classrooms during the construction for the addition that the district is adding to the building, and she addressed their concerns by having the air vents cleaned and adding an air filtration system in the classroom. She has not received any additional complaints or concerns. She was not aware of mold at the center. On 05/26/2022 I spoke with Mr. Shelton Qualified Fire Inspector (QFI), and he emailed the following documents: the floor plan, architecture plans, approval for the construction design dated 10/18/2021. On 05/26/2022 I received an email from Mr. Tody, QFI. He completed an onsite inspection at the Apollo center and his email stated that he had observed the construction project on 05/26/2022.He observed the fire rated barriers and the fire curtains for the masonry work areas, and both barriers and curtains were intact. The areas did smell like masonry construction work was taking place. Upon interview with the site superintendent, he stated they are doing all masonry cutting outside. Inside they are mixing mortar and laying brick in the curtained off areas. He did not see any indicators that mold was present, and he was not able to assess the area for mold as a QFI.
