On 05/11/2022 I completed an unannounced visit to the child care facility. I met with Program Director Jen Cantrell. Ms. Cantrell stated the front door does have issues shutting when you do not pull it behind you. The door will lock, but you just must make sure you give it some force to close. The building is owned by Hesperia's school district and maintenance requests have been made. The door is on back order, and they have been dealing with shipping issues. These things are out of the center's control, and they are just waiting patiently until it is delivered. Ms. Cantrell has been in communication with the school district and the door will be installed as soon as it comes in. Staff are made aware to pull the door behind them. Some parents who enter the building forget to pull the door and staff will look throughout the day to make sure it is closed. Ms. Cantrell stated the toilets in the center all work properly. She stated one toilet in the preschool room had a broken handle, but she went and purchased a new one and fixed it the same day. She showed me the receipt of the new handle. Ms. Cantrell stated the sensory room is clean and is cleaned on a regular basis. They currently have a child who gets one on one care in the sensory room and the agreement was the company who is providing the care must clean the room when they are done. She stated staff check in and look at the end of the day to make sure 3 it is clean. The preschool room is cleaned on a nightly basis. It is part of staff's closing duties. Sometimes there could be food left while the class is going on, because they just have not had the chance to clean it. They will spend the day taking time here and there to sweep and clean. But at the end of each night, all rooms are cleaned. Trash is taken out at the end of the day in each room. The preschool room's and sensory room's trash is taken out daily. Items in the sensory room are cleaned and taken care of by the company who utilizes the room. Anything that is left over is taken care of by staff when they close for the night. This includes any water bins or other activities that were done. I interviewed staff member Kayla Robeck. Ms. Robeck stated she is the lead caregiver in the preschool room. The front door to the facility does not shut all the time. Staff have to pull the door shut behind you. Staff and parents are aware of the door, but some just forget to pull it behind them. A new door has been ordered, but it is taking a while to come in. Staff will close the door if they see it open throughout the day. Ms. Robeck stated there was a toilet in the preschool room that had a broken handle. The handle was fixed that same day. Children just used the toilets in the hallway during that day. There have not been any other toilet issues that she has seen. Ms. Robeck stated the sensory room is cleaned every night. There is a child who is provided direct therapy in the room. The staff who work with him clean the room as well. The preschool room can get dirty during lunch time, but they clean it up when the children take nap. They also clean the room again during closing time. Trash is taken out each night during closing duties. The trash in the preschool room and the sensory room are always emptied when full. The water bins in the sensory room are cleaned out by the therapists. If they are not cleaned, center staff will pour them out. I interviewed staff member Sonia Davila. Ms. Davila stated she works in the preschool room. Ms. Davila stated the front door of the center locks, but you have to pull it behind you. They have told staff and parents about it. There is a new door coming but it is taking a long time to come. Staff will make sure the door is closed throughout the day and if they see it open, they try and shut it. Ms. Davila stated the toilets are working at the center. She stated at one point she remembers one wasn't flushing because of a handle, but it was fixed by the next day. The child care facility is not maintained in a safe condition. The front door is broken, there are toilets in the center that do not work properly, the sensory room is not clean, food is left on the floor of the preschool room, trash is not taken out in the preschool and sensory room, and the water bins in the sensory room are not changed. Staff members are not fingerprinted before working at the child care center. INVESTIATION: On 05/11/2022 I completed an unannounced visit to the child care center. I interviewed Program Director Jen Cantrell. Ms. Cantrell stated all staff are fingerprinted before they work, and she waits until they are confirmed eligible to start working. Ms. Cantrell provided me with her staffing plan and the consent and disclosure forms. I was able to verify that all staff members have been appropriately fingerprinted and deemed eligible prior to working with children. Ms. Robeck stated she was fingerprinted before she was able to work at the child care center. All staff are fingerprinted before the can come to work. Ms. Davila stated she was fingerprinted before she was able to work at the child care center. All staff are printed before they can work. Ms. Bromley stated she was fingerprinted before she worked at the child care center. She stated all staff have to be printed before they can come to work. I verified the Child Care Background Check system and compared it to the current staffing plan. All individuals on the current staffing plan have been fingerprinted and determined eligible to work with children. APPLICABLE RULE R 400.8112 Comprehensive background check; fingerprinting. (1) Pursuant to section 5n of the act, MCL 722.115n, before an individual has unsupervised contact with children, the department shall determine the individual's eligibility to be any of the following: c A child care staff member. ANALYSIS: All staff have completed a comprehensive background check and deemed eligible before working with children at the child care center. CONCLUSION: VIOLATION NOT ESTABLISHED Staff members in the preschool room do not provide appropriate supervision. Smaller children in the preschool room are picked on, children leave the preschool room without staff knowing, the wrong children are reprimanded in the preschool room, preschool children go to the bathroom and play in the toilet, children in the preschool room go to the bathroom and need help and no one comes to assist, staff do not know children have left the preschool room to use the bathroom, and children of all genders and adults use the same bathroom in the preschool room. Staff members in the preschool room do not have valid CPR certification. Children in the preschool room are not changed on a regular basis and staff do not use gloves when completing diaper changes. The table in the sensory room has sharp edges, and the toys in the sensory room are broken and not in usable condition.

On 05/11/2022 1 completed an unannounced visit to the child care facility. I interviewed Program Director Jen Cantrell. Ms. Cantrell stated staff in the preschool room provide appropriate supervision at all times. Ms. Cantrell stated she has not noticed any children who are picked on. There are not children who leave the classroom. If a child leaves the classroom to use the bathroom, a staff member will stand at the doorway and watch them. The bathroom is across the hallway from the classroom. Ms. Cantrell stated the wrong children are not reprimanded. If a child does something wrong, they are redirected appropriately. Ms. Cantrell stated children do not go to the bathroom and play in the toilets. She stated children use the restroom and come back. If someone is in the restroom for longer periods of time, staff will ask if the child needs help. Children who use the restroom and ask for help, are provided help when needed. Children do not leave the classroom and use the bathroom without being allowed to do so. Children ask to use the facility, and staff allow them to do so. She denied children just leave and staff are unaware of where they are. Ms. Cantrell stated there are bathrooms across the hallway from the preschool room that can be used by staff, parents, and children. There is a boy's rest room and a girl's restroom. There are not times when genders are mixed. They use their own bathrooms. Ms. Robeck stated she works in the preschool room. She explained staff provide direct supervision to children. She has not seen smaller children being picked on. Ms. Robeck stated children do not leave the room unattended. Children do not leave the classroom without permission and staff knowing. If a child needs to leave the room, staff will assist them where they need to go. She has not seen or heard of the wrong children being reprimanded. If a child is disciplined, it is the right child, and they are disciplined appropriately. She also explained that children do not go into the restrooms and play. Staff are standing across from the bathrooms when they are used. Children use the bathroom and then come back. If someone is in longer, staff will ask if they need help. If a child is in the bathroom and needs help, they will help them. Staff do not help the child unless they ask for it. 7 Ms. Robeck stated the bathrooms across from the preschool room are two separate bathrooms. There is a boy's room and a girl's room. Staff and parents can use them if they need to. The do not need to mix genders. Ms. Bromley stated staff do a good job providing supervision to children in the preschool room. She has not seen or heard of smaller children being picked on by anyone. Children do not leave the preschool room without staff knowing. All children are accounted for. If someone needs to leave, staff will assist the child. Ms. Bromley stated she has not seen anyone reprimand the wrong child. If a child needs to be disciplined, staff will do so to the correct child and appropriately. Ms. Bromley stated children do not go and play in the bathrooms. She stated if a child is in the bathroom longer than normal, she will ask what they are doing. She has not seen any unusual activities in the bathrooms. If a child in the preschool room goes to the bathroom and needs help, staff will help. Some children will ask for help before they even go, and staff will encourage them to try first before they go and help. Children do not go to the bathroom without staff knowing. Staff are made aware, and they stand across the hallway and watch the children use the restrooms and then return to class. Ms. Bromley stated there are a boy's restroom and a girl's restroom. Adults who need to use the restrooms can do so. They do not mix people in bathrooms. I viewed the restrooms. They are directly across from the preschool room. (10) All child care staff members who work directly which children are required to be trained in first aid and pediatric, child, and adult cardiopulmonary resuscitation (CPR) within 90 days of being hired. Prior to issuing a license to operate a child care center, and prior to the renewal of a license, the department shall verify that at least 50% of the child care staff members who work directly with children are currently certified in first aid and pediatric, child, and adult CPR. Each of these child care staff member's first aid and CPR certificates must be valid and retained on file in the center.

Ms. Cantrell stated children who need to be changed in the preschool room are changed on a regular basis: at least every 2 hours or when rj needed. Staff will use gloves when diapering and then throw them out when they are finished. Ms. Robeck stated children are checked for diapering at least every 2 hours and are changed if needed before that as well. Staff do not have a lot of children in the preschool room that need changes, but they keep up on it. Staff will use gloves for children and then throw the gloves out with the rest of the diapering materials. Ms. Davila stated they check children who have diapers every 2 hours. If someone needs a change before that, they will do so. She uses gloves and throws them out after each change. I viewed the child care centers diapering policy. The policy states diapers are to be checked and changed at least every 2 hours. Gloves can be used and must be disposed of after each use. Ms. Bromley stated children are checked for diaper changes at least every 2 hours. If someone goes to the bathroom, they will change them. She uses gloves and throws them out after changing.
