(3) In each room or well-defined space, the maximum group size and ratio of child care staff members to children, including children related to a staff member or the licensee, must be as shown in Table 4: (d) For preschoolers 4 years of age until school-age, there shall be 1 caregiver for 12 children. (e) For school-agers, there shall be 1 caregiver for 18 children.
On 3/08/2023 I left a voicemail message for the Complainant. On 3/10/2023 I spoke to the Complainant regarding the complaint made against the child care facility, Y Time 2. The Complainant stated they were previously employed by the child care center and had first-hand knowledge regarding the allegations that were received by the bureau. They left the child care center on their own accord, and denied having received any prior disciplinary action. During the time of their employment, they approximated that the typical ratio for the preschool classroom were around 12:1. The age range for the preschool room was 2.5 years through 4 years of age. They suggested that I conduct an unannounced inspection and recommended that I visit after 3:00 PM, as this is typically the time in which the child care facility operates out of ratio. The Complainant informed me that if the daily attendance logs reflected the appropriate ratios, then these documents were likely "fudged." On 3/14/2023 I completed an onsite inspection at the YMCA Camp Algonquin located in Hastings, Michigan. During the inspection, I spoke to the CEO/Executive Director of the YMCA of Barry County, Mr. Jon Sporer. Mr. Sporer advised that the Y Time 2 program was not located at the camp. Mr. Sporer provided me with the correct address for Y Time 2. 3 On 3/14/2023 I completed an onsite inspection at the Y Time 2 child care center. During my inspection I interviewed the Program Director, Ms. Payne. It should also be noted that during the course of the onsite inspection, Mr. Sporer also arrived at the child care facility to be present for the discussion of the investigation. During the onsite inspection, I observed a ratio of 22:2 for the school-aged classroom and a ratio of 4:1 within the preschool classroom. Ms. Payne denied that they have any preschool children currently enrolled that are under 3 years of age. Prior to leaving the child care center, the school aged and preschool classrooms had been combined and maintained a ratio of 25:3. The child care center was observed to be within compliance of ratio during the onsite inspection. Ms. Payne reported that the child care center is "always in ratio." Ms. Payne also stated that she was aware that when combining the classrooms, they were required to maintain the ratio for the classroom, based upon the age of the youngest child present. Ms. Payne reported that despite always being within ratio, she stated that they are understaffed. She will often serve as a staff to maintain ratio, which takes her away from completing the administrative portions within her role. On 4/22/2023 I spoke to Child A's Father, Child B's Mother, Child C's Mother, and Child D's Father. Child A's Father reported Child A has been attending the child care facility for a "few years" and that he only utilizes the program for before/afterschool care. Child A's Father denied having any information pertaining to the preschool classroom, and said he had "zero complaints." Child A's Father reported that "all the staff seem nice." When asked if he had any concerns about the ratio of children to CCSMs, Child A's Father reported he did not, but also advised that the parents do not have access to the children in the classroom. Child A's Father stated that upon arrival, they alert the CCSMs of their arrival, at which time their children are brought to them. Child B's Mother reported that Child B has been attending the child care facility for a little less than one year. Child B is school-age, and only attends for after-school care. Child B's Mother denied having any knowledge pertaining to the preschool classrooms or the general upkeep of the premises. Child B's Mother reported that despite not physically going inside the building to retrieve Child B, she reported that depending on the time of the parent arrival, it can be "chaotic with parent's getting their kids." On 3/10/2023 I spoke to the Complainant. While discussing the allegations pertaining to a door not being appropriately sealed, the Complainant stated that the door they were referencing was "the main door in the preschool room." The door not being sealed was an issue for the duration of their employment at the facility. They stated that the Program Director, Ms. Payne had been made aware of this on multiple occasions but failed to correct the issue. The Complainant stated that the door was "so drafty" in the winter that they had to open the doors that connected to the gym "to circulate the hot air." On 3/14/2023 I completed an onsite inspection at the Y Time 2 child care center and spoke with Ms. Payne and Mr. Sporer. Ms. Payne acknowledged that the door located in the preschool room was not properly sealed, and that during the winter there was a slight draft present in the classroom. I then observed the door in classroom with both Ms. Payne and Mr. Sporer. Ms. Payne stated that they have attempted to solve this issue by using stopgaps beneath the door. They did not continue to use the stopgap beneath the door due to believing it created an obstruction to the means of egress in the classroom. Mr. Sporer interjected and noted that they had attempted to use a foam sealant on the portions of the door that had a draft present, but advised this did not work. Mr. Sporer reported they submitted a maintenance request to the building owner/agency to correct the seal in January of 2022. Mr. Sporer denied that there were any efforts made by the property owner to correct the issue with the door seal. Mr. Sporer reported that the YMCA of Barry County was hesitant about addressing the matter themselves, as they were only renting the space. Mr. Sporer also advised that when the child care center opened in January of 2022 this matter was not addressed during the initial inspection, so they did not believe it was fair for the facility to be cited for the rule violation. On 4/11/2023 I received an email from the Executive Director, Mr. Sporer. Within the email, Mr. Sporer advised that the door located in the preschool room had been fixed, and that this was achieved with a new seal, threshold, and sweep. On 4/22/2023 I spoke to Child A's Father, Child B's Mother, Child C's Mother, and Child D's Father. Child A's Father and Child B's Mother did not report having any knowledge of the defective seal on the door in the preschool classroom, and did not report any concerns expressed by either Child A or Child B. Child C's Mother stated that while she has had limited contact within the preschool classroom, she denied ever having concerns regarding the temperature of the room, due to the defective door seal. Despite not having much access inside the classroom, Child D's Father stated he was aware of the "broken door" in the preschool classroom. He stated that it was his understanding that the door inside the preschool classroom had "broke" on two separate occasions, and that the child care facility attempted to make repairs each time. Child D's Father reported that he was made aware of this by the preschool CCSMs. Child D's Father denied having experienced any periods of time where he felt excessive heat or cold air within the classroom, but again, relayed that he was not frequently inside the facility/preschool classroom. On 4/24/2023 I spoke to CCSM 1 and CCSM 2. 7 CCSM 1 informed me that they worked in the preschool classroom frequently and that they were aware of the issues present regarding the door being improperly sealed. They reported that the child care center had placed multiple requests in to the maintenance department to fix the door. The maintenance department had made several attempts, but denied it corrected the problem. I asked if the door seal impacted the temperature in the classroom, CCSM 1 stated "yes, there was a bit of a draft in the winter; we would make sure to cover the bottom of it. On11/7/2022, I received a call from Program Director Shay Payne notifying me of an incident that occurred in which Child Care Staff member Brittany Clous left Child A outside unattended for an unknown amount of time. Ms. Payne explained the Ms. Clous' employment had been terminated as a result. Due to multiple holidays in the week, I did not receive an incident report until 11/14/2022. I provided technical assistance and reminded Ms. Payne that per rule 8158(4) the written report should be received within 72 hours. I contacted former child care staff member Brittany Clous and conducted a telephone interview on 11/14/2022. Ms. Clous reported that she was left alone outside with about seven children aged three and four while child care staff member Michael "Maya" McGee went inside to take two children to the restroom. Ms. Clous explained that she lined the children up to come inside and thinking she had everyone, they entered the classroom and began taking off jackets. Shortly after, she and Ms. McGee heard Child A at the door crying outside and let him in. Ms. Clous was not sure of the exact time that Child A was outside unsupervised, however she explained that staff regularly lock the door when they are done outside, and the door was still unlocked. She added that children were still removing their clothes from outside, so she knew it was just a "few seconds." Ms. Clous was very apologetic and stated repeatedly that she "felt horrible" about the incident, adding that she was still training to work in the child care classroom after being moved from working in the kitchen and she did not believe that Ms. McGee should have left her alone with the children outside. I contacted Child A's Mother on 11/14/2022, and she reported that she was aware of the incident stating the center was upfront about it and took the correct steps. Child A's Mother stated that she was told by Ms. Payne that Child A had been left outside for "five minutes." I asked her if she had spoken to Child A about the incident and she said that he told her he was "crying and knocking on the door" and stated that he "was scared." Child A's Mother felt there was some discrepancies in how long Child A was left outside, as she was originally told "five minutes" and then when speaking to Ms. Payne after, it seemed it was just a few seconds. I arrived onsite on 12/01/2022, and interviewed Program Director Shay Payne, Child Care Staff member Michael "Maya" McGee and Child A. Ms. Payne explained that since the incident staff only go as a whole group if they have to leave a space as opposed to one staff taking a small group. Staff are also to count children in lines before leaving the room and when returning to the room. I explained to Ms. Payne that when I spoke with Ms. Clous, she felt the incident was very short, however Child A's Mother had been told the incident was five minutes. Ms. Payne explained that she was not sure of the time and knew it was between one to five minutes, so that is where the confusion may have come from. 3 Child Care Staff Member Michael "Maya" McGee was present the day of the incident and working with Ms. Clous. Ms. McGee reported that she had brought two children inside to change them in the restroom, and she had returned to the room as Ms. Clous was entering from outside with the rest of the children. While entering information into the parent communication app, Ms. McGee heard crying and looked around realizing it was coming from outside. Child A was at the door crying and upset. Ms. McGee noted that the children were still taking off their outdoor clothing, and that the incident had not been "a long time" and that Child A quickly calmed down. Ms. McGee added that Child A does not transition easily especially if he does not want to do something like come inside, and sometimes he gets emotional easily. I attempted to interview Child A. I made an unscheduled onsite inspection at Y Time 2 child care center on 4/14/2022 and spoke with licensee designee/program director Marci McCoy and program director Shay Payne. There are a few preschoolers that scratch other children when angry. Staff work diligently in an attempt to prevent occurrences. Staff shadow children, work with parents and ask that they keep nails cut short, offer redirection, and discuss expectations with children. Incident reports that provide details of the injury are also given to parents of all children involved. I spoke on the telephone with Child A's Mother, Child B's Mother and Child C's Mother on 4/22/2022. Child A's Mother did not express any concerns about the care and supervision provided at the child care center. Child B's Mother informed me that whenever she has any concerns, she contacts staff right away and the situation is resolved. Child B's Mother has been contacted on a few occasions about Child B's behavior at the preschool. Child B was kept at home for a week and there hasn't been any issues since. Child C's Mother expressed one incident of concern regarding the care and supervision provided at the child care center. Child C informed his mother that he was scratched by another child, however, staff reported the injury was a rug burn. Child C's Mother was on vacation when it happened and questioned staff upon her return. Staff were not sure who said the injury was caused by a rug burn or why. Child C's Mother felt staff were being dishonest but acknowledged that staff could have made a mistake.

Y Time 2 provides a preschool program and before and after school child care. Ms. McCoy and Ms. Payne informed me that the center always meets ratio requirements. When combining school age children with preschoolers, they have one staff member for every eight children. Ms. McCoy acknowledged that they are sometimes short staffed, but this never impacts ratio. When the center was short staffed last week due to spring break, they closed early. They have also had to close when there wasn't enough staff due to illness. I reviewed attendance records for both staff and children from 4/11/2022 through 4/14/2022. The center was in compliance with ratio requirements during that time frame. It shall be noted that there were two staff members caring for nine preschoolers during the onsite inspection. Child A's Mother informed me that the center is following ratio requirements. Child B's Mother stated that the center is understaffed, however, they seem to follow ratio requirements. Child C's Mother has never seen the center out of ratio. She has observed preschoolers and school age children sharing space both indoors and outdoors, however, they are separated and there are several staff throughout the room supervising children.

According to Ms. McCoy and Ms. Payne, most families supply a water bottle for their child. The center has water bottles if a child does not bring one. Water is available at all times. The center has a drinking fountain and the bottles can be filled onsite. Water bottles are sent home with the child at the end of the day to be cleaned. Child A's Mother stated that Child A comes to preschool with a full water bottle. It is returned at the end of each day to be cleaned. The water appears to have been consumed during the day. Child B's Mother stated that Child B comes to preschool with an empty water bottle. There is always water in it at the end of the day. Child C's Mother informed me that water is available at all times. Child C brings a water bottle with him daily both full and empty and it always comes home with water in it. Child C drinks a lot of water throughout the day and has told her that he is drinking it while at preschool.
