On 06/13/2023, Child A was upset, and Child Care Staff Member 2 (CCSM 2) grabbed Child A by the wrist while standing over her. Child Care Staff Member 3 (CCSM 3) bear hugged Child A on two occasions and the second time CCSM 3 scratched Child A on both of her arms. It is unknown if this was intentional. Both CCSM 2 and CCSM 3 were being aggressive with Child A. It is unknown if the scratches were caused intentionally.

On June 14, 2023, I received an email forwarded from child care licensing consultant Karen Woodman containing a video of the incident. I reviewed the video and observed Child A putting food on her utensil and then dipping the utensil with the food into the milk cup of the child sitting next to her and then removing the spoon. Child A does not appear upset and the child sitting next to her does not react in any way to food being placed in his milk cup. CCSM 2 stands up and asks, “Why did you do that”, she then takes Child A by the forearm on one side and under her elbow on the other side and guides her out of her chair and has her sit on the floor. CCSM 2 stands in front of Child A bent forward stating in an elevated tone, “That is not nice, you don’t put your spoon from your mouth and put it in someone’s cup. Don’t do that. Do you understand? I think you are done.” Child A cries “Noooooo” as she bends her head toward the floor. CCSM 2 tells Child A she will give her another chance to show her she is (inaudible). CCSM 2 then yells at Child A “Stop crying.” Child A runs to the book area where Child H is and continues crying as she sits down. CCSM 2 sits at the table with the children while CCSM 3 has her back turned to Child A in the far-left corner of the classroom and states, “Child A, she said you can try again.” Child A lunges toward Child H and he begins to cry. CCSM 3 goes to Child A and Child H and then CCSM 2 gets Child H and returns to the table with him on her lap. She is comforting him. CCSM 3 tells Child A, “We don’t hit our friends, that is not nice.” She then says, “We don’t hit our teachers either.” CCSM 2 tells CCSM 3 to hold Child A and she does. Child A is in CCSM 3’s lap facing out with CCSM 3’s arms wrapped around Child A, holding Child A’s arms down. Child A struggles to get away and then CCSM 3 puts her down on the floor saying, “Okay, quit pinching me I am letting you go.” CCSM 3 stands up and steps away from the area and then tells CCSM 2 she is going to go before it gets “chaotic” and walks out of the classroom. This is at 2:35 in the video. Meanwhile Child A 4 incident report is dated June 13, 2023, at 3:25 p.m. and states Child A was injured after being hit or pushed by another child and sustained an injury to her right eye resulting in a bruise or swelling. Parents were notified through the ProCare application at an unspecified time. The fourth incident report is dated 06/13/2023 at 5:35 p.m. and states that Child A and another child were playing one using the shopping cart the other using the stroller when they bumped into each other resulting in Child A falling and bumping her forehead. Parents were notified face-to- face at 5:40 p.m. All the incident reports state comfort was provided and then Child A returned to her normal activities. On August 31,2 023, I completed an exit conference with substitute program director Amber Lundberg. I summarized the investigations and violations. Ms. Lundberg was understanding of each violation.

CCSM 2 used reasonable restraint after Child A had scratched another child and when the restraint was not helpful, she eventually put her back on the floor. CCSM 3 used restraint when Child A was not harming herself or anyone else and this led to Child A becoming more escalated and then she instructed CCSM 2 to continue to restrain her further when the restraint was clearly just escalating the matter further. Neither CCSM 2 or CCSM 3 used any form of positive conflict resolution nor did they remove the child from the situation or remove themselves from her reach.

(2) A person, partnership, firm, corporation, association, nongovernmental organization, or governmental organization shall not establish or maintain a child care center, group child care home, or family child care home unless licensed by the department. Application for a child care center, group child care home, or family child care home license shall be made on forms provided, and in the manner prescribed, by the department, including the fees required under subsection (10). Before issuing or renewing a child care center, group child care home, or family child care home license, the department shall investigate the applicant's activities and proposed standards of care and shall make an on-site visit of the proposed or established child care center, group child care home, or family child care home. Except as otherwise provided in this subsection and sections 5q and 5r, if the department is satisfied as to the need for a child care center, group child care home, or family child care home, as to its financial stability, and that the service, facility, applicant, licensee, child care staff member, or member of the household is conducive to the welfare of the children, the department shall issue or renew the child care center, group child care home, or family child care home license. She is not aware of Child A ever overheating on the playground while she was in her care and she has never heard of anyone having to use icepacks on Child A. On June 16 ,2023, and I spoke with program director Amanda Pohl. Ms. Pohl stated there was not an incident report done when Child A overheated on June 8, 2023, and resulted in Child A being laid down with ice packs. Both Ms. Pohl and CCSM 7 agreed that Child A’s parents should have been made aware of this incident and a report should have been completed. Ms. Pohl stated this has never happened to Child A or any other child before. She was not aware of Child A ever having to go to the doctor for overheating at the child care center, and she was not aware of Child A ever having to receive intravenous fluids due to overheating at the center. If she had known she would have followed proper procedure and filed an incident report pursuant to R 400.8158(3) which requires the department be notified within 24 hours of notification by a parent that a child received medical treatment for an injury that occurred while the child was in care. Ms. Pohl provided the ProCare communication for Child A from March 29, 2023, through June 13, 2023. On March 29, 2023, Child A’s Mother stated Child A was not feeling well and would not be in attendance. On May 19, 2023, Child A’s Mother stated Child A came home dehydrated on May 18, 2023, and she would be staying home to obtain fluids and rest. On May 23, 2023, CCSM 6 told Child A’s parents that Child A was not herself and had a temperature of 99.9, they would recheck in an hour; Child A ate well and drank enough water at lunch. Child A was not in attendance on June 9, 2023. On June 12, 2023, it notes Child a did not sleep at nap time. On June 16, 2023, program director Amada Fisher emailed the email exchange between her and Child A’s Mother on June 8, 2023. Child A’s Mother asks if there is any plan to cover the sand area and she is wondering because Child A tells her often it is hot and appears to be overheated from being outside. Child A’s Mother explains when she picked her up today Child A was laying down with ice packs on her and when asked she was told by an unknown child care staff member that Child A “got too hot” outside.
