On 10/01/2021, I made an unannounced visit to Heavens Above Child Care Center at 3:10pm. I met with the program director, Octavia Harris and read her the allegations. Ms. Harris said it has never been reported to her by any parent that a child care staff member has hit a child. I asked Ms. Harris to give me the contact information of 10 random children who attends the afterschool program. On 10/04/2021, I received an email from Sabrina Ramirez, Bureau of Community and Health Systems, containing an additional allegation in the investigation. The email stated there were "numerous unknown children attending the child care center." On 10/04/2021, I called the complainant. Complainant stated she witnessed child care staff member, Pauline Spatcher yelling and using profanity with the children. She also stated she saw Ms. Spatcher punch Child A (6-year-old female). I asked the witness when did the incident occur. The witness said, "It happened sometime in September." I asked the witness who did she report the incident to. The witness stated, "I wanted to tell somebody, but they wouldn't have believed me. So, I didn't tell anybody." On 10/04/2021, I made an unannounced visit to Heavens Above Child Care Center. I interviewed Ms. Spatcher. I asked her if she ever used profanity in speaking to the children. Ms. Spatcher said, "I would never do that." I asked Ms. Spatcher if she ever punched a child. Ms. Spatcher said, "Absolutely not! I would never do that." I asked Ms. Spatcher if she ever asked the children to sleep on the floor. Ms. Spatcher pointed in the direction of the cots and told me the children rests on the cots and not on the floor. Following the interview, I sat and observed Ms. Spatcher's interaction with the children. They were all positive interactions. On 10/11/2021 I interviewed Child A's Mother by phone. She said the center is clean and she denied seeing any children laying on the floor for nap. Child A's Mother does not have any concerns for the center. She loves the staff. I told her of the specific allegations and asked her if she had ever been aware of an incident involving her child being hit by a child care staff member; specifically, Ms. Spatcher. 3 Child A's mother said, she and Ms. Spatcher have a relationship. She reflected on how much Ms. Spatcher has helped her child. Child A's mother was adamant that she had never heard of any such allegations, and she did not believe them to be true. Child A's Mother said, "I'm pleased with all of the staff at Heaven's Above." I called Child B's Mother, (6-year-old female). Child B's Mother said she was pleased with the center and has no issues with the staff. I asked her if she had ever seen or heard of the children napping on the floor. Child B's Mother said, "absolutely not." Child B's Mother said if her child was sleeping on the floor, Child B would have told her. I called Child C's Father, (7-year-old-female). Child C's Father said he did not have any issues or concerns with the center or the staff. If there was an issue, he would have heard it from Child C's Mother and he has never heard anything about the center to be concerned about. I asked Child C's father if he had ever seen or heard of the children napping on the floor. He said, "If my daughter was sleeping on the floor, she wouldn't be there." I called the Child D's Mother, (6-year-old female). Child D's Mother said she had no issues or concerns with Ms. Spatcher. I specifically asked about the allegations of Child D being punched by Ms. Spatcher. Child D and Child D's mother both indicated the allegations were false and that Child D was never punched by Ms. Spatcher. ..........

On 10/01/2021 during my unannounced inspection, I observed the facility to be thoroughly clean. The floors and walls were without spills, stains, or trash. There was no odor of uncleanliness. There was no garbage or debris in the center. On 10/04/2021, during an unannounced visit of the facility, the center was clean and there was no evidence of improper maintenance of the facility.

On 10/01/2021 and on 10/04/2021 I conducted unannounced inspections. I observed the cots stacked against the wall with blankets in large Ziplock bags on each cot. The cots are the sleeping equipment that is used for napping and rest time. On 10/11/2021, I interviewed Child A's Mother, Child B's Mother, Child C's Father, Child D and Child D's Mother to investigate the allegations of children sleeping on the floor. The parents of Child A, Child B, Child C, and Child D indicated they had not seen or heard of their child, who attends the afterschool program, resting on any surface other than the cots that were provided by the center. Child D denied children are made to sleep on the floor. She said she sleeps on a cot while at the center. 5

On 10/04/2021, during an unannounced inspection, I viewed the children's files. There were 52 children enrolled and 52 completed children's files that contained a child information record, a copy of each child's immunization record, and documentation signed by a parent that they were in receipt of the information packet.
