Child care staff members (CCSMs), Stephanie Niezgoda and Angie Silveus, were attending to another child who was physically ill when this incident occurred so neither CCSM witnessed Child A climbing the bookcase. was also present in the classroom. Ms. Silveus picked the booCkcCasSe "MupMo l and called Child A's Mother while Ms. Niezgoda administered first aid to Child A. Child A's Mother was able to immediately pick up her daughter and 3 On 02/28/2022. I received a call from licensee designee Sadie Riley-Flemming reporting the 02/24/2022 incident involving Child A. Ms. Riley-Flemming stated that on 02/24/2022, Child A climbed a book case in the Little Ram's classroom while ■ Ms. Silveus, and Ms. Niezgoda were helping another child who was ill. The bookcase fell over onto Child A resulting in Child A sustaining Child A's Mother was contacted and Child A On 03/02/2022 made an unannounced visit to the t3lacKbird Child Care 11:30 AM. We first interviewed the center's assistant program director Vicky Ryba. On 02/24/2022 Ms. Ryba was contacted by Ms. Silveus through a text message which read that she needed to come to the Little Ram's Classroom due to a bookcase falling and injuring hild A. Ms. Ryba was -year 1 informed that Child B -old, female) had in the classroom while Ms. Silveus and Ms. Everette were moving a broken trai le out of the Little Ram's classroom. Ms. Niezgoda and were left in the classroom while the other staff moved the old train table out. Since the old train table was against a bookcase, Ms. Silveus directed to stand next to the bookcase to prevent children from climbing on it or knockingRover. When Child B became , Ms. Niezgoda assisted the child with getting cleaned up, calling the child's parents, and requesting a janitor to come and clean up the vomit which was directly next to the free-standing bookcase. During this time, the bookcase fell over onto Child A. It is unknown whether Child A was climbing on the bookcase or if another child pushed the bookcase over. By the time Ms. Ryba made it to the classroom, the bookcase had been picked up and Child A was reporting her arm hurt. Ms. Ryba denied any other children being injured with the book case falling over, but she mentioned that there were children stationed by the bookcase playing when it fell over. Ms. Rvba contacted Child A's Mother who arrived at the center within 10 minutes. . ivis. rcyaa reportea tnat none of the start witnessea seeing how the bookcase fell on Child A. Ms. Ryba disclosed that the center is pursuing disciplinary action against three CCSMs stemming from this incident. Ms. Ryba clarified that normally center staff do not move furniture in the classroom when children are present. Ms. Ryba provided written statements on the incident from Ms. Silveus, Ms. Niezgoda, and I took pictures of 14 child information cards and the Little Ram's attendance sheet from the week of 02/20/2022. Pi I interviewed Ms. Silveus. On 02/24/2022, Ms., eus was assisting"ci aff member Ms. Makaela Everette move a broken train table out of the Little Ram's classroom. Before leaving the classroom, Ms. 4 Silveus to stand next to the exposed bookcase after moving the broken tdrairine ctatebld" frroomm e classroom to prevent it from falling or injuring a child. While moving the table, Ms. Niezgoda reported that Child B had vomited in the classroom, and she was trying to reach Child B's emergency contacts. Ms. Silveus went and assisted Ms. Niezgoda with contacting an emergency contact. Ms. Silveus directed most of the children in the class to get away from the vomit since she assumed the janitor would clean the vomit with a chemical. While she was assisting Ms. Niezgoda, she saw the bookcase begin to fall. She did not see how the book case fell over, but she observed it as

On 11/15/2021, I received an incident report stating that Child A was left unattended by child care staff members Christe Gwilt and Makaela Everette for one to three minutes in the outdoor play area called the tot lot. The staff failed to do a head count before transitioning back to the classroom after outdoor play. On 11/15/2021, I received two written statements by child care staff members Christe Gwilt and Makaela Everette from the program director Sadie Riley- Flemming. Christe Gwilt wrote: It was time to come in for lunch from the Tot lot, so I (Christe) told a student "Come on let's go line up and have some lunch!" I was helping the student find his color and we all left the tot lot. I made sure that the gate was closed, and we walked into the coat room. The other teacher with me said "Let's take everything off at the blue rug inside the classroom." I followed the children inside and started helping them take their snow pants off at the blue rug. I noticed in the corner of my eye a child's inside shoes that we had taken off to put the snow boots on. Immediately I did a head count and noticed that the child with the inside shoes was missing. I turned to the teacher that was with me outside and said, "Where is Child A?" She immediately scoped out the whole room and coat room and went outside to find him. The lead teacher who was in the room, came up to me and said, "What happened?" I filled her in and waited for the teacher to return. The teacher returned with the child, and everything was alright with the child. I made sure that the child got extra hugs and cuddles the rest of the day. I am sorry for 4 all the trouble I caused you today! Please know that something like this will never happen again! Thank you for all that you do! Just know you handled it beautifully and I am the one who made the mistake! Makaela Everette wrote: This morning at 11:20 I called out to the kids that it was time to line up. I retrieved the rope and began helping the children that ran over grab their colors (they needed extra help because they had their mittens on). When I was done helping all of the children get their colors (aside from Child A) I saw that Christe was holding the end of the rope and was ready to go. I yelled out "alright, everybody, time to go!" and we began our walk back to the classroom. We made sure that the gate was shut after we left the tot lot. Once we entered the classroom, I told everyone to go straight to the classroom to take their wet snow gear off, so they don't slip on the tile. When all of our friends got into the classroom and to the rug to begin changing, Christe did the headcount and realized Child A was not in the classroom. I hurried and checked the bathroom and coat room and when he was not there, I immediately went out the coatroom door to the tot lot. I saw him standing in the tot lot right next to the playground. He was not crying or upset, he just asked where his friends went. I took his hand and we walked back into the classroom together. He was alone for some time between 1-3 minutes, but I did not think to check the clock during the incident." On 11/16/2021, I made an unannounced visit to the Blackbird Child Care Center from 9:04 AM to 10:22 AM. I interviewed child care staff member Christe Gwilt, child care staff member Angie Silveus, child care staff member/assistant program director Vicky Ryba, and program director Sadie Riley-Flemming. Upon arrival, I went and observed the Little Ram's classroom. While there, I obtained copies of the child information cards from the Little Ram's classroom, attendance sheets for 11/15/2021, the Little Ram's daily schedule, and I took nine pictures of the outdoor play area while onsite. The attendance from 11/15/2021 showed 12 children were present. I first interviewed child care staff member Christe Gwilt. Ms. Gwilt reported that around 11:20 AM on 11/15/2021, the Little Ram's classroom was transitioning from outdoor door play to the classroom. Ms. Gwilt and child

On 05/21/2021, I received an incident report from the Blackbird Child Care Center stating that Child A (5-years-old, male) and Child B (3-years-old, male) ingested flower foam during free play. Additional information regarding the incident report was obtained from interviews with Child A's Mother, Child B's Mother, and child care staff member Adrian Ortiz. On 05/24/2021, I interviewed Child A's Mother. Child A's Mother reported that she had received a phone call from Ms. Wilkins on 05/21/2021 stating that Child A had "ingested poison" and Ms. Wilkin's had contacted poison control. Ms. Wilkins initially told her that no one saw Child A consume the "poison" and it was unknown how much he had consumed. It was not until Child A's Mother arrived at the center that she was informed that the ingested poison was in fact flower foam. Child A had told her that he had been pretending to eat the flower foam with another child and he accidentally swallowed some of it. Child A's Mother picked Child A up from the child care center within 30 minutes of receiving the phone call and took him immediately to the hospital. On the way to the hospital, Child A told her that he had vomited at school once and then he threw up in the car while taking him to the hospital. Overall, Child A's Mother feels the situation could have handled better. She discussed that when she picked her son up from the center, two child care staff members informed her that Child A had told them that he had vomited in the bathroom, but they did not believe him because he seemed fine. She did send licensee designee Ms. Tamara Wilkins a text message to inform her that her son had vomited in her car on the way to the hospital. Child A's Mother stated that Ms. Wilkin's sent a text message back stating that Child A threw up because he consumed too much water. She confirmed that her son is doing well, and he will be returning to the center. She denied having any other concerns with the center and she denied having any concerns with the center's ability to supervise her child prior to this incident. On 05/24/2021, I interviewed Child B's Mother. She stated that on 05/21/2021, Tami Wilkin's called and informed her that Child B and another child had ingested green flower foam during free play. Ms. Wilkin's informed her that she had contacted poison control. She questioned Ms. Wilkins on how much flower foam Child B ingested, and Ms. Wilkins stated that she did not know. She stated that Child B was never ill from ingesting the foam and she did not pick him up early on 05/21/2021. She denied having to take Child B to a doctor. Child B's Mother stated that the center handled the incident appropriately. Child B's Mother had no concerns regarding the center's ability to care and supervise her child. On 05/24/2021, I interviewed child care staff member Adrian Ortiz. She stated that child care staff members created an imaginative play flower shop area in the Ram's classroom on 05/21/2021. There were fake flowers, plastic vases, and green flower foam for the children to use in a green tote located under the table being used for the flower shop. She was informed by child care staff members Danielle Sylvain and Makaela Everett that Child A and Child B had ingested flower foam upon returning from her break. Ms. Ortiz stated Ms. Wilkins contacted both Child and Child B's parents to inform them of the incident after Ms. Wilkin's had called poison control. I 4 asked Ms. Ortiz who purchased the supplies for the flower shop. She stated that she believes that these items were donated, and she does not know who provided the materials. I asked Ms. Ortiz if she knew what the foam was made up of and she stated formaldehyde. When asked how she knew the flower foam contained formaldehyde, Ms. Ortiz stated that she had looked up the ingredients in the flower foam when Ms. Wilkin's was on the phone with poison control. She stated that Ms. Wilkin's called poison control because they did not know if the flower
