Child A (age 8 months) was in a stroller crying outside when Child A's Mother arrived to pick up Child A. Ms. May said Child A had been crying, but Ms. May didn't know why Child A was crying. When Child A's Mother changed Child A's diaper at home, Child A had an ant and bug bite in the crease of his leg. Ms. May placed a child who was crying unconsolably in a back room without supervision to go to sleep. Ms. May's husband was sleeping in a chair with children in care during nap/rest time while all the children were awake.

Uncertified people watch child care children when Ms. May leaves for appointments and vacation. Ms. May is over her maximum number of children and planned on placing some of the children in a shed when licensing personnel comes to the home. Ms. May's son chased another child care child with a steak knife. A couple kids were hurt by Ms. May's dog that is allowed around the child care children. One child was bit through the lip and one of the children's front teeth was chipped.

On 7/28/2021, I completed an unannounced on-site inspection at the child care home. I informed Licensee Holly May of the allegations. Ms. May said she recalls a day when Child A was in a stroller outside when his mother came to pick him up. Ms. May said Child A was a little fussy like how Child A acts when he is getting sleepy. Child A was not crying out as if he was uncomfortable. Ms. May changes Child A's diaper and feeds him before she takes Child A and the other children outside at the end of the day. Ms. May does not believe Child A would was crying because he was hungry or had a wet diaper. Ms. May said Child A has been teething so he has been a little fussier that usual. I interviewed Ms. May's husband and assistant child care staff member, Chris May. Mr. May said he does not recall a specific time Child A was crying due to unknown reasons when his mother came to pick him up. On 1/28/2022 I placed telephone calls to Child B's Mother, Child C's Mother and Child D's Mother. I left voice messages requesting return calls. On 4/19/2022 I completed an exit conference by telephone with Ms. May.

On 7/28/2021, I completed an unannounced on-site inspection at the child care home. I informed Licensee Holly May of the allegations. Ms. May said she changed Child A's diaper right before taking the children outside on the day Child A's Mother reported she found insect bites on Child A's leg. Ms. May did not see any bites on Child A's leg while changing his diaper prior to taking Child A outside. Child A's Mother sent Ms. May a text message when she arrived home with Child A. Child A's text message stated she discovered Child A had bites on his leg. Ms. May said she would have told Child A's Mother about the bites on Child A's leg if Ms. May had observed the bites prior to Child A being picked up for the day. Ms. May does not know if Child A obtained bites on his leg at the child care home, in the car on the way home, or at his own home. Ms. May said she has all parents sign a permission slip if they want Ms. May to apply bug spray or sunscreen to the children while they are in attendance at the child care home. I reviewed Child A's file and found that Child A's Mother declined to have Ms. May apply sunscreen or bug spray to Child A prior to Child A going outside. Mr. May said he heard Child A's Mother found some bug bites on Child A's leg while she was changing Child A's diaper after picking up Child A from the child care home. 3 Mr. May said he does not know how or where Child A received the bug bites. Mr. May said Child A's Mother did not request Child A have bug spray applied to him prior to going outside.

R 400.1916 · R 400.1916 Bedding and sleeping equipment. (6) Infants, birth to 12 months of age, shall rest or sleep alone in an approved crib, play yard, or porta-crib. This equipment must meet all of the following requirements: (a) Cribs, porta-cribs and play yards must comply with the product safety standards issued by the Consumer Product Safety Commission, 16 CFR 1219 (2019), 16 CFR 1220 (2019), and 16 CFR 1221 (2019), which are available at http://www.cpsc.gov. Ms. May said if a child is crying inconsolably, she will try everything she can to calm the child. Ms. May said she will pick up a crying child and walk around with them, change their diaper, feed them, attempt to rock them to sleep, everything she can think of to calm the child. Ms. May said she has never placed an inconsolable child alone and unsupervised in a room while the child is crying. Mr. May said neither he nor Ms. May has ever placed an inconsolable crying child alone unsupervised in a room. Mr. May said "you can't do that." Mr. May said if there is a child who becomes fussy, Ms. May picks up the child and walks around with them to try to console the child. Mr. May plays with the other children to keep them occupied while Ms. May consoles the crying child. Mr. May said Ms. May is usually able to console crying children after trying various things.

Ms. May said her husband, Mr. May, sits in a chair in the corner of the room while the children are napping and resting. However, Mr. May does not sleep while child care children are present. Ms. May said Mr. May is an assistant child care staff member who helps her out even when he is not required to be present to maintain ratio. Often, Mr. May is an extra child care staff member. Mr. May does not sleep during nap time even when he is not required as an assistance child care staff member to maintain ratio. I interviewed Chris May. I asked Mr. May if he has ever been asleep in the chair while supervising child care children during nap time. Mr. May said "I have never done that. You can't do that. You can't go to sleep on them." Mr. May said he sits in the chair, but he always remains awake.

Ms. May said there has been only a few occasions where she has left the child care home for a short period of time during child care hours. During those times, Ms. May informed parents ahead of time and the children were left in the care of a qualified assistant caregiver. Ms. May said typically she closes the child care home if she has a personal appointment during child care hours. Ms. May also closes the child care home if she goes on vacation. Ms. May does not need to take time off for her own children's appointments because Ms. May's husband takes their children to all appointments. Ms. May said her assistant caregiver recently quit suddenly. Ms. May is in the process of finding a new assistant caregiver. I reviewed the file of Ms. May's most recent assistant caregiver and found the caregiver to have all the requirements to qualify as an assistant 2 caregiver, including a completed background check where the assistant caregiver was found eligible. On 10/23/2020 I completed an exit conference by phone with Ms. May. On 10/30/2020 I spoke to Child C's Mother by telephone. Child C's Mother said she "absolutely loves" Ms. May. Child C's Mother said Ms. May is always happy, loves kids and is compassionate. Child C's Mother likes that Ms. May does a preschool program for a couple hours a day to prepare children for school. Child C's Mother said Ms. May notifies her ahead of time if Ms. May will be away from the home during child care hours. Ms. May always has qualified assistant caregivers to care for the children when Ms. May has an appointment. On 10/30/2020 I spoke to Child D's Mother by telephone. Child D's Mother said she "loves" Ms. May. Child D's Mother used to work at the child care home as an assistant caregiver. Ms. May notifies parents ahead of time if she will be away from the home during child care hours. A regular assistant caregiver is always present if Ms. May is away from the home during child care hours. Child D's Mother said she is "very protective" and Ms. May is the only person she is comfortable with providing care to her children.

Ms. May was present with eight child care children. Ms. May said there has been times where she might have 14 present children in the child care home including her own children who are both over the age of 6 years. I reviewed past attendance sheets and verified the attendance sheets to Ms. May's statement about the number of children she typically has in care. Until Ms. May's assistant caregiver quit, Ms. May always had an assistant caregiver when that many children were present. Ms. May said she never had intentions of hiding children in the shed during her on-site inspection. Ms. May said she has one shed on her property. The shed is very small and the door to the shed is always open. I observed the shed on the property and found the door to be open and the shed to be free of any children. The shed is in an area where Ms. May would have been required to walk past a person standing at the door to place children in the shed during an on-site inspection. Ms. May said she has never said anything about hiding kids in a shed even in a joking manner. Ms. May does not know what would lead anyone to believe she would hide children in a shed to conceal the number of children she had in care. On 10/30/2020 I spoke to Child C's Mother by telephone. Child C's Mother said Ms. May has a low number of children in care now due to the school age children being back to school. If Ms. May has a larger number of children in her care, Ms. May has an assistant at the home to help. On 10/30/2020 I spoke to Child D's Mother by telephone. Child D's Mother said Ms. May is the only provider if there is just a small number of children. If Ms. May has a larger number of children in her care, Ms. May has as assistant at the home to help. ............

Ms. May said there was an incident where her son, Minor Household Member (MHM) was playing outside in a play kitchen area with Child B. MHM and Child B had a plastic play kitchen knife they were playing with while running around. Ms. May was outside observing the interaction the whole time. MHM and Child B were not playing in an aggressive manner or threatening each other in any way. Child B went home and told his mother MHM chased Child B with a knife outside. Child B's Mother believed the knife was a real steak knife instead of a plastic play knife. Child B's Mother asked Ms. May about the incident and Ms. May clarified to Child B's Mother that the knife was plastic and MHM and Child B were interacting in a playful, non-violent manner. On 10/30/2020 I spoke to Child C's Mother by telephone. Child C's Mother said she believes Ms. May always provides appropriate supervision to the children. On 10/30/2020 I spoke to Child D's Mother by telephone. Child D's Mother said she has never had any concerns with supervision at the child care home.

On 8/19/2020 I completed an unannounced on-site inspection at the child care home. I informed Holly May of the allegations. When I arrived at the child care home Ms. May's dog barked as I knocked on the door. When Ms. May invited me into the home the dog, Maddy, stopped barking and appeared friendly towards me. Maddy was separated from the children by a plastic room divider. Ms. May said Maddy does interact with the children at times. Ms. May said Maddy has never acted aggressively towards anybody in the home. Maddy barks when people arrive at the home but never in a vicious way. Ms. May could not recall any incidents where Maddy caused an injury to any of the children in care. I reviewed child-in-care statement forms and found that Ms. May informed parents that she owns a dog. On 10/30/2020 I spoke to Child C's Mother by telephone. Child C's Mother said she has never had any concerns with Ms. May's dog. The dog is always friendly to Child C's Mother. Child C is also "loves" the dog. Child C's has never reported the dog to be aggressive and Child C's Mother has not heard of the dog harming any other child care children. Child C's Mother believes Ms. May would separate the dog from the children if the dog were to show any signs of aggression. On 10/30/2020 I spoke to Child D's Mother by telephone. Child D's Mother said she does not have any concerns with Ms. May's dog. Ms. May started tying the dog up while the kids were outside playing only because the dog would run behind the kids in a playful manner while the kids rode bikes. Child D's Mother has never seen or heard of Ms. May's dog being aggressive to anybody. Child D's Mother believes Ms. May would separate the dog from the children if the dog showed any type of aggression.
