According to interviews completed with program staff and parents of children in care, Lead Teacher inappropriately cared for Child A when they held Child A upside down by the torso in an attempt to stop him from crying. Additionally, Lead Teacher pretended to fling a rubber-band at Child A.

On 3/29/2022 I conducted an onsite inspection at the child care facility Lakeshore Little People's Place — Hamilton South. During the inspection, I interviewed the Program Director Ms. Cassie Avink, and the child care staff members Ms. Lilly Carney, Ms. Victoria Wunder, and Ms. Selena Lundy. Ms. Avink stated that on 3/21/2022 Child A had been left inside the toddler classroom for approximately two minutes, unattended. Ms. Avink reported that the toddler classroom was operating with 6 children to 2 staff ratio at the time of the incident. However, Ms. Avink noted that shortly before the incident, there was 6 children to 3 staff ratio in the classroom. Ms. Avink stated that the lead caregiver, Ms. Lundy, had just completed her shift and left the classroom in preparation to clock out. Ms. Avink stated that it was her understanding that prior to the toddler room departing the child care facility and walking to the outdoor play area, Child A wandered into the bathroom located inside the classroom. A head count was conducted prior to the children lining up while they were sitting on the rug in the classroom. Ms. Avink reported that the child care staff member Ms. Carney went into the bathroom after the children were lined up at the door to retrieve her shoes. Ms. Avink stated that it is her understanding that Child A slipped into the bathroom at this time. Ms. Avink reported that the two child care staff members, Ms. Carney and Ms. Wunder, discovered that Child A was not with them once they approached the gate to the outdoor play area where they conducted a second head-count. Ms. Avink noted that it was at this time that Ms. Wunder returned inside the classroom and noticed Ms. Lundy present with Child A. According to Ms. Avink, the incident transpired over a course of one to two minutes before Child A was located. Ms. Avink disclosed that after the incident occurred and she reported it to Child A's Guardian, Child A's Guardian informed her that she too, needs to close doors behind her as she had discovered Child A likes to sneak into rooms. Ms. Avink reported that this was the first time the child care facility had been made aware of this behavior from Child A. Ms. Carney informed me that at approximately 3:30 PM the toddler classroom had just finished eating, gathered their belongings, and went to sit on the rug to be called 3 up to the door for recess. Ms. Carney reported that during this period of the day things can become busy, as other children are frequently in the process of being picked up. Ms. Carney disputed Ms. Avink's account of what occurred and reported that attendance had not been taken while the children were sitting on the rug, but rather attendance had been taken while the children were lined up at the door. Ms. Carney recalled only counting five children before exiting the facility and acknowledged that she did not conduct a count based on the Tadpoles app on the classroom iPad. Ms. Carney stated that if she had cross checked the Tadpoles app, she would have noticed that Child A was not standing in line. Ms. Carney reported that when the classroom arrived at the outdoor play area, they took another head count and cross referenced it with the attendance on the Tadpole app. Ms. Carney noted that it was at this time that they realized Child A was not with the group. Ms. Carney then sent Ms. Wunder back inside the child care facility to retrieve Child A. Ms. Carney stated that the entire incident occurred over the course of one to two minutes. Ms. Wunder reported that on 3/21/2022 after the children finished snack, they began to get their coats and shoes on to go outside. Ms. Wunder stated that the child care children then returned to the rug in the classroom where they waited to be called to stand in line at the door of the facility. Ms. Wunder noted that they then conducted a head count, and recalled counting five children, prior to leaving the classroom. I inquired into when Ms. Wunder believed Child A was able to

On 8/26/2021 I made an onsite inspection at Lakeshore Little People's Place — Hamilton South. During the inspection, I interviewed the Program Director Ms. Cassie Avink, and staff members Ms. Josie Grady, and Ms. Jocelyn Fritzsche. Ms. Avink informed me that on 8/23/2021 at approximately 8:30 AM the Education Director, Ms. Samantha Smith was making her rounds and visiting the classrooms. Ms. Avink reported that the preschool classroom was operating with a ratio of 15:2, but that they were temporarily at 15:3 with Ms. Smith's presence in the room. Ms. Avink stated that upon Ms. Smith's arrival in the classroom, she observed the classroom lined up to go outside at the back door in the classroom that lets out directly to the fenced in outdoor play area. Ms. Smith observed the child care staff members Ms. Grady and Ms. Fritzsche completing their count procedures and Ms. Grady was noted to have been exiting the building with five children while Ms. Fritzsche briefly remained in the classroom with her 10 children prior to walking outside to join Ms. Grady. Ms. Avink informed me that Ms. Fritzsche then held the door open and allowed the 10 children to exit before she reached back in to grab her laptop. Ms. Avink stated that Ms. Smith then exited the building with the classroom, where they stood on the concrete sidewalk directly outside the door. Ms. Avink noted that Ms. Smith proceeded to speak with Ms. Grady and Ms. Fritzsche outside the door, in the outdoor play area. When Ms. Smith turned around to return inside the classroom, she witnessed Child A waiting on the circle time rug. Ms. Avink reported that the classroom was only outdoors for around 1.5 minutes before Ms. Smith returned inside the classroom. Ms. Avink denied that Child A was distressed or upset as a result of the incident. Ms. Grady noted that after they completed Bible study the classroom lined up to begin getting ready to go outside. Ms. Grady then informed me that there is a door in the back of the classroom that faces the outdoor playground where the children play. It should also be noted that upon observation of the classroom, the back wall facing the playground consisted of windows, and allowed for direct line of sight to the outdoor play area. Ms. Grady stated that as she was walking out of the classroom with her group of five children, the Education Director, Ms. Smith entered the classroom. Ms. Grady reported that Ms. Smith began speaking with them while they were lined up and exiting the building and that almost immediately after her last child exited the classroom, Ms. Fritzsche's group proceeded to exit the classroom. Ms. Grady stated that after she left the building, she proceeded to walk to the shed and start to remove the bicycles for the children to ride. Ms. Grady reported that this takes her 3 approximately five minutes to complete, and that by the time she finished removing the bikes from the shed, Ms. Smith and Ms. Fritzsche had already observed Child A sitting inside the classroom and she was brought back outside to rejoin the rest of the group. Ms. Grady reported that they always initiate a count procedure before taking their group outside. Ms. Grady stated that they will either read individual names off the daily attendance sheet, or they will count heads to make sure the numbers align with the children that are on the sign-in sheet. Ms. Grady reported that after she counted her five children and began exiting the classroom, Ms. Fritzsche began her count procedure and then proceeded to walk outside. Ms. Grady stated that Child A must have slipped out of line and walked directly into the bathroom after the count occurred, because she could recall hearing Ms. Fritzsche stating that she had her 10 children. Ms. Fritzsche stated that at approximately 8:30 AM she and Ms. Grady had a ratio of 15:2 and that they had just dismissed the children from "Bible time." Ms. Fritzsche stated that Ms. Grady then left the classroom and took five children out with

On 9/4/2020 I spoke to the Program Director/Licensee Designee, Ms. Cassie Avink, through email. During the correspondence, Ms. Avink provided me with a copy of the incident report, and informed me that due to the nature of the allegations, the child care staff member, Ms. Dawn Timmer, would be placed on leave, pending completion of the investigation. Due to this, an onsite inspection was scheduled at the child care facility so that Ms. Avink could assure Ms. Timmer would be present. On 9/4/2020 I spoke to Child A and Child B's Mother. Child A and Child B's Mother stated that during the Spring of this year, Child A had informed her that the child care staff member, Ms. Dawn Timmer, had pinched him. Child A and Child B's Mother stated that she did not initially believe Child A, or assumed that the incident was done accidentally, which caused her not to follow-up with the child care facility regarding Child A's disclosure. Child A and Child B's Mother noted that shortly after Child A informed her of this, the child care facility had shut down in response to the Covid19 outbreak and the Executive Order which restricted child care facilities from providing care for families that were not essential employees. Child A and Child B's Mother informed me that after the Executive Order was lifted and Child A was able to return to the child care facility, he began asking if he could continue to remain at home due to Ms. Timmer pinching him. Child A and Child B's Mother stated that Child A indicated Ms. Timmer pinches him on his side, near his hip. Child A and Child B's Mother stated that he has made this disclosure several times, but she denied that Child A has ever had any marks, bruises, or injuries resulting from the 3 alleged pinching. Child A and Child B's Mother stated that she was concerned as she did not believe that Child A was the type of child "to make this kind of thing up." Child A and Child B's Mother reported that Child A has been attending the child care facility for approximately 4 years, and she noted that he has been in Ms. Timmer's class for one year. Child A and Child B's Mother also noted that Child B attended the child care in the past, and that aside from this current situation, she has never experienced any issues or had any concerns regarding the child care facility. On 9/8/2020 I performed an onsite inspection at the child care facility, Lakeshore Little People's Place — Hamilton South. During the inspection, I spoke with the Program Director/Licensee Designee Ms. Avink, and the child care staff members Ms. Dawn Timmer, Ms. Darshan Scholten, Ms. Renee Turner, Ms. Ruth Pittsley, and Ms. Sklyer Humphreys. Ms. Avink informed me that after she spoke to Child A's Mother regarding Child A's disclosure of being pinched by Ms. Timmer, she recalled an incident from a former child care family that had also brought to her attention approximately one year prior. Ms. Avink stated that Child C's Mother had informed her that Child C also made the disclosure that he was pinched by Ms. Timmer. Ms. Avink stated that nothing occurred as a result of this, as Child C's Mother didn't seem concerned, and questioned whether the incident had actually occurred. Ms. Avink noted that she would provide me with the former child care family's child information card so that I could establish contact with Child C's Mother. Ms. Timmer stated that she has worked at the child care facility for approximately six years, and that she is an assistant in the preschool classroom. Ms. Timmer noted that Child A typically arrives at the child care facility between 8:00 and 8:30 AM and that he eats breakfast upon arrival. Ms. Timmer noted that prior to the Covid19 restrictions, she will typically speak with Child A and Child B's Mother for a little while after drop-offs, and that Child A and Child B's Mother would typically always stay in the classroom until she finished reading the newsletters.
