On 06/27/2023, I completed an onsite inspection and interviewed program director, Ms. Angela Bailey as well as three CCSMs regarding the allegations. Ms. Bailey explained that on 6/22/2023, while in care, Child A was not acting like herself. Child A had been crying more than usual and felt warm. CCSM 1 took Child A’s temperature twice and got readings of 100.6 and 100.2. CCSM 1 contacted Child A’s Mother and requested that Child A be picked up due to Child A running a fever. Child A’s Mother came to pick up Child A and was upset because Child A’s Mother didn’t think that Child A had a fever. Ms. Bailey explained to Child A’s Mother that they took her temperature twice, and both readings showed a fever. Ms. Bailey offered for Child A’s Mother to bring her own thermometer in if she did not agree with the reading of their thermometer. Child A’s Mother took Child A home. CCSM 1 stated that Child A was not acting normal on 6/22/2023 and was extra cuddly, wanted to be held, was not eating, and felt warm. CCSM 1 took Child A’s temperature on Child A’s forehead and the reading was 100.6. CCSM 1 used another thermometer, and she believes the reading was 99.2 but added one degree due to the reading being taken in the armpit. CCSM 1 texted Child A’s Mother requesting that Child A be picked up due to a fever. Child A’s Mother stated that on 6/22/2023 she was contacted by a CCSM and asked to come pick up Child A due to Child A running a fever. Child A’s Mother had a CCSM check Child A’s temperature while Child A’s Mother was there, and the temperature came back normal. At that point, CCSM did not say that Child A’s Mother had to bring Child A home, however Child A’s Mother stated that it was naptime, and she knew that if she left, Child A would scream and have a hard time going down for a nap, so Child A’s Mother took Child A home. CCSM 1 and Ms. Bailey suggested that Child A’s Mother bring in her own thermometer, if Child A’s Mother did not agree with the temperature readings they got on the center’s thermometers. I obtained a copy of the center’s illness policy that is included in the Parent Handbook which is provided at the time of enrollment as well as in the Parent Contract. The illness policy states that if a child develops a fever during the day (anything over 100.4) the child’s parent will be notified to pick up their child up from care. 3
The program director did not follow the center’s illness policy when Child A’s Mother was called to pick Child A (female, 1 year) up when Child A did not have a fever. Child care staff members did not provide appropriate care and supervision of children in care when children were left unattended in the 3-year-old room for 10 minutes. Media is utilized in the 3-year-old classroom for extended periods of time that does not support learning. Media was utilized for children under the age of 2. Tables were not properly sanitized when a CCSM used a broom to clean a multiuse table.

Child care staff member Ms. Ally Crippen was expected to run multiple rooms with numbers way over the caregiver to child ratio. On 10/06/2021, child care staff members were left to care for too many children by themselves and it was complete chaos. Child care staff members were yelling at one another in front of the child care children. The center is not clean. 10 Child care staff members files are incomplete and missing important documentation. On 11/08/2021, additional allegations were received regarding child care staff member Ms. Katie Lilly being left alone in rooms to care for children and she is not qualified to be a lead caregiver. On 10/08/2021, additional allegations were received. A child care staff member tested positive for COVID-19 and the center did not information the child care staff members and parents. On 11/09/2021, an additional allegation was received that child care children, who are sick, are 26 being allowed to come into the center and remain at the center for 3-4 hours before being sent home. Complainant's own children have gotten sick multiple times while attending the center. 27

I completed interviews with Ms. Bailey, CCSM 1, CCSM 2, and CCSM 3 regarding allegations of children being left unattended in rooms. All staff members denied ever leaving their rooms unattended or seeing other CCSMs leave children unattended in a room. CCSM 1 stated that CCSMs may step outside in the hallway of a classroom to assist a child, but the door is always left open and it is only for a brief time. CCSM 2 and CCSM 3 both stated that if a CCSM has to leave their room, to go to the bathroom or for any other reason, they have a CCSM scheduled as a floater or Ms. Bailey that can come cover the room so that children are not left unattended. Child A’s Mother reported that at the beginning of June 2023 (exact date unknown) she observed the three-year-old room to have no staff members present for approximately 10 minutes while children were in the room. CCSM 3 is usually in that room, and the day that the three-year-old room was unattended, CCSM 3 was in the director’s office. I spoke with Child D and Child E’s Mother, Child F and Child G’s Mother and Child H’s Mother and Father. None of the parents interviewed had ever seen a classroom left unattended with children in it, and it was noted that there are always plenty of staff available within the center during pick up and drop off. 4

Ms. Bailey reports that when media is used in the classroom it supports learning. CCSM 1 stated that they use the television for sound during rest time in the young preschool room (2.5-3 years). If the television is on during other times in the room, it will have educational content such as colors or shapes or used for gross motor movement. All rooms (except for the infant room) will play lullabies through the television for sound. At parent drop off times, sometimes they will have the Disney channel on. The older children (5 years and up) may sometimes watch a movie, but they do not watch a movie from start to finish in one day. CCSM 2 states that sometimes the television is used to play lullaby music as the children are transitioning to nap time. However, there are no graphics on the television, only sound. CCSM 3 stated that the preschool classrooms use music on the television for napping. The television may have a graphic such as “under the sea” fish swimming. The school age children do watch movies on Disney Plus on some days during rest time. Occasionally they will do a movie day if it is raining outside and they can’t go outside to play, however CCSM 3 stated they have not done a movie day yet this year. Child A’s Mother has observed non-educational media being used at the center such as Moana, Encanto, Spiderman, as well as Cocomelon, and YouTube. She reports that the television plays these cartoons all day, exceeding the licensing rules of 2 hours per child, per week. Child D (male, age 3) and Child E (male, age 1.5)’s Mother has seen the television utilized in Child D’s classroom; however the programming is for dancing/large motor activities. 5 Child F (male,age 2.5) and Child G (male, age 1.5)’s Mother has seen the television on playing a movie during morning drop off in the young preschool room (children ages 2.5-3 year olds). She has also observed the television to be utilized in the young preschool room in the afternoon but has only seen learning songs being played at that time.

Ms. Bailey denied that children under the age of two watch television in the center. Ms. Bailey believes that Child A’s Mother passed by a room that had television on when she came to pick her other child, Child B, up, but that room had all two-year-olds in it, with the exception of the CCSM 1’s child, Child C, that is under two years. CCSM 1 stated that on 06/22/2023, Child A and B’s Mother peeked her head into the older toddler room (ages 2-2.5) and told child care staff members that children under 2 cannot watch television per licensing rules. CCSM 1 stated that all of the children in the room were over the age of 2, with the exception of CCSM 1’s child, Child C (male, 1 year) and CCSM 1 did not mind Child C watching television. During interviews with CCSM 1, CCSM 2 and CCSM 3, all CCSMs were able to properly explain the three-step cleaning system that they use to clean and sanitize surfaces. All CCSMs denied that they have utilized a broom to clean off a table, seen another staff member use a broom to clean off a table, or heard about a CCSM using a broom to clean a table. Ms. Bailey denies ever seeing or hearing about a CCSM using a broom to clean a table, until it was recently brought to her attention by Child A and B’s Mother. On 06/26/2023, Child A and B’s Mother reported seeing a CCSM who she believes was CCSM 3, cleaning off a table with a broom approximately 1-2 weeks prior. Child D and E’s Mother did not have concerns regarding the center equipment not being properly sanitized. Child D and E’s Mother reports that she has had times where she has changed her children’s diapers at the center, and she is instructed to change them on the changing table and instructed on the three-step cleaning process when she is done. During interviews with Child F and Child G’s Mother and Child H’s Mother and Father, there were no concerns regarding sanitization.

On 10/08/2021, I interviewed the complainant along with licensing consultant Mr. Don Vita. The complainant reported that on 10/06/2021 the center was short-staffed. "They [the center] kept taking kids in and not telling parents no." Former child care staff member Ms. Ally Crippen and child care staff member Ms. Katie Lilly had been responsible for taking care of all the toddlers and babies together in one room. The center was in "chaos" and child care staff member Ms. Hope Pratt and program director Ms. Angie Bailey were yelling back and forth and bickering at each other in front of the child care children. On 10/08/2021, Mr. Don Vita and I conducted an on-site inspection. Together, we interviewed program director Ms. Angela Bailey. I explained the allegations to Ms. Bailey. She reported that on 10/06/2021, she was working in the Infant Room with Ms. Crippen, caring for Child A (3-month-old, male) and Child B (10-month-old, male). Child care staff member Ms. Ashley Pohl arrived with Child D (5-month-old, female). Ms. Bailey said she left the room to answer a telephone call and when she returned to the infant room, she informed Ms. Pohl that she had to leave due to an issue with her background check. She then pulled child care staff member Ms. Malia Cole from the Preschool Room to work in the Infant Room where she remained for the rest of the day along with Ms. Crippen. Ms. Crippen had been working in the Toddler Room earlier that morning with child care staff member Ms. Hope Pratt. When child care staff member Ms. Kerissa Harrell arrived at the center Ms. Crippen returned to working in the Infant Room. On 10/06/2021, all rooms remained within the required caregiver to child ratios. Ms. Bailey denied there was any yelling or bickering between her and Ms. Pratt on that day. On 10/08/2021, Mr. Vita and I interviewed child care staff member Ms. Hope Pratt. Ms. Pratt reported that she had worked with Ms. Crippen on 10/06/2021 in the Toddler Room. She stated that Ms. Crippen was breastfeeding her child in the Toddler Room when she asked her to put a blanket over herself. Ms. Crippen didn't 4 like it, so she left and went over to the Infant Room. The Toddler Room remained within the caregiver to child ratio on that day and the only yelling that took place was between Ms. Crippen and child care staff member Ms. Shellie Somerfield On 10/08/2021, I interviewed child care staff member Ms. Felicia Swank. She reported that she has never been out of the required caregiver to child ratio since she started working at the center in 2011. She denied there was any yelling or screaming between child care staff members on 10/06/2021 On 10/08/2021, I interviewed child care staff member Ms. Katie Lilly. She reported that on 10/06/2021, she had worked in the Big Toddler Room all day with child care staff member Ms. Abigail Waite and Ms. Pratt. She was unsure if the caregiver to child ratio had been maintained that day, as she said she was still a new employee and wasn't sure what the ratio should be. She denied there had been any yelling or bickering on that day. On 10/08/2021, I interviewed child care staff member Ms. Malia Cole. She reported that on 10/06/2021 she came into the center and started working in the Preschool Room and then went into the Infant Room while Ms. Bailey answered a telephone call. She believes she was within the required ratio for both rooms on that day. She denied the center was chaotic that day or that any yelling took place between caregivers. On 10/21/2021, I interviewed Child Care Staff Member 1 (CCSM1). She/he reported she/he had worked with Ms. Crippen and denied that she had ever been expected to work in multiple rooms. To his/her knowledge, Ms. Crippen was never placed in the role of a lead caregiver. The caregiver to child ratios have been maintained and Ms. Bailey is an extra caregiver who will fill in and help out when there is a need for another caregiver in a room. On 10/08/2021, the complainant reported that approximately one month ago the center had a case of fleas which they did not tell the parents about. Ms. Pratt and Ms. Bailey were both made aware the center had fleas and nothing was done, so Ms. Ally Crippen went into the center on two separate weekends and cleaned the center. On 10/08/2021, Ms. Angela Bailey denied that the center is not cleaned. On one occasional a child care staff member had found one flea at the center. Once she had pinpointed who the flea came from, she spoke to that specific parent. Ms. Pratt, Ms. Crippen, and herself cleaned the center over the weekend of 09/03/2021 and 09/04/2021. The center was closed that following week due to a COVID-19 related shutdown. When the children returned to the center, they were checked for fleas. Since then, there has not been any other reported cases. Ms. Pratt reported there had only been one flea that was found at the center. Once it had been found, Ms. Bailey, Ms. Crippen, and she vacuumed and treated the center on a Friday night and the center remained closed the following week. Ms. Bailey and she told the parents to check their pets for fleas. Since that time, there have not been any other reported cases. Ms. Felicia Swank reported that the flea incident probably occurred sometime in August. "A child care staff member had found bites on her child." Once the fleas were taken care of, she hasn't noticed any more at the center. Ms. Katie Lilly reported on one occasion she had pulled a flea off her daughter. Once the center was cleaned, she had not noticed any other fleas. Ms. Malia Cole reported she had only heard of one child having fleas and Ms. Pratt had sprayed for them. She was unsure if she had been working at the center during this time. Ms. Renee Demorest report that she felt like Ms. Bailey and Ms. Pratt responded to the flea situation the right way. They cleaned the rooms several times, and there has not been another flea incident since. On 11/02/2021, Ms. Shellie Somerfield reported that she believes the center is always cleaned and well-maintained. There was the one incident where one child had bites on him and when the parents were questioned. They had said they were bug bits. Once the center found a flea on the child, he was sent home immediately and the center was cleaned. The child was not allowed to return to the center until he was clear of any fleas. When Mr. Don Vita and I completed the on-site inspection on 10/08/2021, the center appeared to be cleaned and well maintained. 11 On 11/08/2021, additional allegations were received. Child care staff member Ms. Katie Lilly is being left alone in rooms to care for children and she is not qualified to be a lead caregiver. The center is not properly cleaned. Child care staff members were lying to the department when they were interviewed on 10/08/2021. On 11/10/2021, Ms. Katie Lilly reported that Ms. Malia Cole, Ms. Ashely Pohl, and Ms. Abigail Wait will only spray the diaper changing surface with bleach water after changing a child's diaper. She stated, "They will use bleach water, wipe it down and change the next child." Ms. Lilly reported that she does not believe the center is thoroughly cleaned. She has pulled fleas off Child E (10-month-old, female) and Child F (22-month-old, male). She said, "I have not seen them do anything about the fleas." Child E and Child F come home with black socks. On 11/12/2021, I conducted an unannounced on-site inspection and the rooms appeared clean and well maintained. On 11/12/2021, child care staff member Ms. Renee Demorest was observed changing the diapers on three different children. Each time, following a diaper change, Ms. Demorest washed the child's hands with soap and water, cleaned the changing surface with soap and water, wiped it down with paper towel, rinsed the changing surface with water, wiped it down with a paper towel, sprayed the surface with a bleach water mix, and placed a clean paper towel on top of the

On 10/08/2021, the complainant reported that on 10/06/2021 child care staff member Ms. Hope Pratt and program director Ms. Angie Bailey were saying the state was going to come in and shut them down because they didn't have the required paperwork on file for child care staff member Ms. Ashley Pohl. Ms. Crippen had been working as a lead caregiver, but she did not have the qualifications to be working in that position. Her last day of employment with the center was 10/06/2021. A total seven child care staff members files were reviewed on 10/08/2021 and 11/12/2021. The following information was not on file: • Child care staff member Ms. Katie Lilly's first day with child care children was 08/27/2021. Her file was missing a certificate of completion for safe sleep training and documentation for the completion of the required health and safety courses. • Child care staff member Ms. Kerissa Harrell's first day with child care children was 08/02/2021. Her Tuberculosis test was completed on 10/08/2021. Her certificate of completion for safe sleep training was dated 08/12/2021 and did not contain a trainer's signature. She completed the 14 Health and Safety Training Course 1 on 11/13/2021 and Course 2 on 11/14/2021 via MiRegistry. Ms. Harrell was not fingerprinted until 09/27/2021. • Child care staff member Ms. Malia Cole's first day with child care children was 03/16/2020. Her Tuberculosis test was completed on 07/22/2020. She completed the Health and Safety Training Course 1 on 11/16/2021 and Course 2 on 11/21/2021 via MiReigstry. Ms. Cole was not fingerprinted until 07/01/2020. • Child care staff member Ms. Mackenzie Harmon's first day with child care children was 10/26/2021. There was no record of Ms. Harmon completing the required health and safety courses. • Former child care staff member Ms. Ally Crippen's first day with child care children was 04/12/2021. Her file was missing a signed and dated consent and disclosure form, a tuberculosis test, documentation of safe sleep training, documentation of the required health and safety courses, and documentation of an orientation. On 10/21/2021, CCSM1 reported Ms. Crippen was never placed in the role of a lead caregiver. On 11/02/2021, Ms. Shellie Somerfield reported that she had worked with Ms. Crippen and she had never witnessed her working as a lead caregiver in any of the rooms because "she did not have the qualifications." On 11/10/2021, Ms. Katie Lilly stated he/she and Ms. Crippen are not qualified to be lead caregivers, but on one occasion they worked in the classroom together for a day without a lead caregiver being present. She was unable to provide a specific timeframe of when this had occurred. On 11/12/2021, Ms. Bailey reported that Ms. Crippen and Ms. Lilly were never placed in the position of a lead caregiver because neither one of them had the qualifications on file to be a lead. As far as she knew, neither one of them had even completed the training that is required to be a lead care. On one occasion Ms. Crippen had written her name as the lead caregiver on the board outside of the Toddler Rooms. Upon noticing it, Ms. Bailey removed her name. She told Ms. Crippen that she could not be a lead caregiver because she did not have the required credentials on file. Both Ms. Crippen and Ms. Lilly were repeatedly told that they did not have the qualifications to be a lead caregiver. Ms. Bailey never allowed either one of them to work in the position as a lead caregiver. A list of all the lead caregivers for the center was provided. The infant and toddler lead is Ms. Renee Demorest. The older toddler lead is Ms. Abby Yang. The younger 15 toddler lead is Ms. Malia Cole. The pre-school leads are Ms. Felicia Swank and Ms. Xandria Tatum. The school-age lead is Ms. Angela Bailey.

On 10/08/021, Ms. Ally Crippen reported that child care staff member (CCSM1) left the center early on 10/04/2021 and tested positive for COVID- 19 on 10/06/2021. "They [the center] didn't inform parents or staff." Ms. Bailey reported that CCSM1 worked on Monday 10/04/2021 in the Toddler Room. She became sick and left early. On Wednesday 10/06/2021, she was notified by CCSM1 that they had tested positive for COVID-19. At 10:59 a.m. she sent a text message to all the parents whose children had been in contact with CCSM1 and care staff members were notified verbally or through text message. Ms. Bailey did not call the health department to report the positive case. The text message that was sent to parents stated the following: "I want to let you know on Monday [10/04/2021] I sent CCSM1 home sick because [they] were not feeling well. CCSM1 has been off work and I had [them] go get tested. CCSM1 tested positive for COVID. Please keep an eye on your little one." Ms. Felicia Swank reported that she was told by Ms. Bailey that CCSM1 and CCSM2 were both out due to having tested positive for COVID-19. Ms. Katie Lilly reported that Ms. Bailey had informed her on 10/06/2021 that a child care staff member had tested positive for COVID-19. She was unsure if parents were notified. Ms. Malia Cole reported that she was informed on 10/06/2021 that a child care staff member had tested positive for COVID-19. She said that she heard Ms. Bailey verbally notifying parents. On 10/21/2021, CCSM1 reported that she/he had tested positive on 10/05/2021 for COVID-19 and was absent from the center for the following two weeks. She/he was unsure of what procedures the center had taken regarding notifying parents and other child care staff members. On 11/02/2021, Ms. Shellie Somerfield recalled that two child care staff members had tested positive for COVID-19. She was unable to remember their names. She said the one time the center was closed and the other time she believed she had been informed through a text message. On 11/08/2021, additional allegations were received. Child care children, who are sick, are being allowed to come into the center and remain at the center for 3-4 hours before being sent home. The Complainant's own children have gotten sick multiple times while attending the center. On 11/10/2021, Ms. Katie Lilly reported that there is a note posted on the door entering the center that states when children cannot be in care but children are still coming into the center coughing and having running noses. On one occasion, Child B arrived at the center with a fever. He was in the Young Toddler Room with her and child care staff member Ms. Waite. Ms. Waite noticed the fever and she told Ms. r: Bailey. Child B was given Tylenol and allowed to stay at the center. She stated, "He played around and he wouldn't stop crying. He wanted to be held." Approximately 1- 2 hours after the Tylenol was administered, his parents were called to come and pick him up. On one occasion, Ms. Lily had a bad cough and lost her sense of taste. The center wanted her to stay. On 09/23/2021 she tested positive for COVID-19, she notified the center on 9/23/2021 or 09/24/2021 and she remained out of the center for 10-14 days. Ms. Lilly stated, "I got COVID from them. A child care staff member I worked with had COVID. Ms. Bailey shut the daycare down for a week." She also reported that her children, Child E and Child F have gotten RSV and Hand, Foot and Mouth Disease while attending the center. She had received a notification, via text message, that the children at the center had Hand, Foot and Mouth Disease and what the signs and symptoms are to look for. She further reported that she knows Child F got RSV from the center, because Child A had tested positive for it. Ms. Lily was unable to confirm whether she had received notification from the center regarding RSV. On 3/11/2021, I spoke with licensee designee and CCSM Ms. Angela Bailey. She informed me that on 3/8/2021, she was away from the child care center when she received a phone call from Ms. Wright. Ms. Wright informed her that she had slapped Child A in the face immediately after Child A had slapped her. Ms. Bailey instructed Ms. Wright to go home from the day while Ms. Bailey looked into the situation. Ms. Bailey added that CCSMs Shellie Somerfield, Felica Swank, and Kenzie Greenhoe witnessed the incident between Child A and Ms. Wright. All 2 three CCSMs provided Ms. Bailey with written statements regarding what they had witnessed on 3/8/2021. Ms. Bailey provided me with copies of those written statements on 3/14/2021 and they will be added to the licensing file with a copy of this report. On 4/14/2021, I conducted an onsite inspection at Kids R Kids to interview the CCSMs. When I arrived, Ms. Bailey informed me that Ms. Somerfield and Ms. Swank were both working that day and available to be interviewed, but Ms. Greenhoe had recently quit her position and is no longer employed by Kids R Kids. Ms. Bailey stated that on 3/8/2021, while she was away from the center, she received the phone call from Ms. Wright. On 3/8/2021, after talking to the owner of Kids R Kids, Ms. Hope Pratt, and speaking with the CCSMs that witnessed the incident between Child A and Ms. Wright, Ms. Wright's employment with the child care center was immediately terminated. Ms. Bailey added that she has worked with Ms. Wright for many years and she has never seen Ms. Wright physically discipline or strike a child. Ms. Wright had recently completed an online positive discipline training and since the incident, the center's discipline policy has been reviewed with all CCSMs at Kids R Kids. Ms. Bailey provided me with a copy of the Kids R Kids discipline policy. After reviewing the policy, I noted it to be appropriate and focused on encouraging children to learn self-control, self-direction and cooperation. I also noted that the policy states "Under no circumstances will employees be allowed to.. .strike a child..." Ms. Somerfield stated that on 3/8/2021 she was working with a group of young toddlers when she heard a commotion coming from the other side of the room. The room is divided by a half-wall and Ms. Wright was working with a different group of children on the other side of the half-wall. She overheard Child A using profanity with Ms. Wright and then observed Ms. Wright pick up Child A and bring him near the half-wall. Child A stated, "I'm going to kill you." And Child A struck Ms. Wright in the face with his hand. Ms. Wright reacted immediately by striking Child A in the face with what she believed to be an open hand. Ms. Somerfield added that she had never seen Ms. Wright or any other CCSM at Kids R Kids strike a child in their care. I reviewed the written statement provided by Ms. Somerfield and noted that it was consistent with information she provided during my onsite interview. Ms. Swank explained that Child A has a history of behavior issues including using inappropriate language, biting, kicking, and hitting others at Kids R Kids. On 3/8/2021, Ms. Swank was working with Child A in another classroom when Child A bit another child. Ms. Swank was taking Child A to Ms. Wright's classroom because he responds well to Ms. Wright. While taking Child A to Ms. Wright's classroom, Child A attempted to grab another child's leg to trip that child. When Ms. Swank reached Ms. Wright with Child A, Ms. Wright grabbed Child A's face with one hand and told Child A that he is not allowed to bite other children. Child A then "smacked or clawed" Ms. Wright's face. Ms. Wright responded immediately by smacking Child A with an open hand in the face.
