(4) If a center becomes aware that a staff member, volunteer, or child in care has contracted a communicable disease, then the center shall notify parents and provide all of the following information: (a) The name of the communicable disease the children were exposed to. (b) The symptoms of the disease. (c) Prevention measures as recommended by the U.S. Centers for Disease Control and Prevention (CDC) at the following website: https://www.cdc.gov/DiseasesConditions. 4
On 11/04/2022, I completed an unannounced on-site inspection. Licensee designee/program director Ms. Jolliffe was not at the center. I interviewed CCSM 1 who is the lead caregiver in the Parrot (infant) classroom. CCSM 1 said that there were two confirmed cases of a communicable disease. She reported that Ms. Jolliffe had sent out an email to parents of her classroom to inform them of the 2 cases. CCSM 1 showed me the email and forwarded it to me. The email dated 11/02/2022, read, "Hello Parrot Classroom Parents I have been informed of two confirmed cases of [a communicable disease] within the Parrots Classroom. We have never had this kind of illness here before, so it's unfamiliar to us. If you have any concerns, or questions please contact your child's primary care physician. Thank you Kelle— The exclusion policy of the center is that children can return to care when they have been symptom free for 48 hours. She said that two children with the communicable disease cases followed the exclusion policy and provided documentation from the doctor. There were a lot of children out sick in the Giraffe and Toucan classrooms and the classrooms were closed. CCSM 1 stated that CCSM 2 had a communicable disease recently and was off for 10 days. She was not aware of the communicable disease case being reported to parents. On 11/17/2022, I spoke with Ms. Jolliffe on the phone and explained the allegations to her. Ms. Jolliffe explained that Child A's Mother contacted her and asked if there was a communicable disease at the center and she told her no. CCSM 2 then told her that she had seen Child B's Mother's post on Facebook stating that their child had a communicable disease, so Ms. Jolliffe emailed them. Child A's Mother then contacted her again and reported that Child A had tested positive for a communicable disease. Ms. Jolliffe said that Child B's parent never reported to her that their child had a communicable disease and that CCSM 2 told CCSM 1 about the Facebook post so that is why she was saying that there were two children that had it. The center recently closed two classrooms because the attendance was so low and so they could deep clean the classrooms. There were a lot of children that had coughs and green mucus and their parents were not following their exclusion policy. Ms. Jolliffe was asked about the email sent to the Parrot classroom parents only and why it said there were two confirmed cases. Ms. Jolliffe said that it was not confirmed with a medical provider, only by the parents' report. Ms. Jolliffe reported that she thought she only had to notify parents of the classroom the illness was in. I reviewed the rule requirements with Ms. Jolliffe and suggested that to comply with the symptom and prevention measures, she should look at the CDC website for their fact sheets. I asked Ms. Jolliffe about different communicable disease cases in the center. She confirmed that CCSM 2 had a different communicable disease. She did not report it to parents because CCSM 2 was on vacation and tested positive over the weekend before coming back to work so there was no exposure at the center. On 11/18/2022, I spoke with CCSM 2 via telephone. CCSM 2 reported that on 10/24/2022, she came to work and was not feeling well and was sent home after being there for a few hours. She tested positive for a communicable disease, and she called the center to report it. She said that no parents or staff were informed about her results. She denied that she was on vacation the week prior to testing positive. She reported that she was on vacation from 10/5 to 10/14/2022 and worked the week of 10/17 to 10/20/2022. She said that Ms. Jolliffe has some beliefs about 3 conspiracy related to this communicable disease and that is why she did not report the exposure. On 2/09/2023, I received an email from Ms. Jolliffe that she had attempted to send me on 11/17/22 but had sent to the wrong email address. Ms. Jolliffe sent time cards for CCSM 2 that showed that CCSM

MCL 722.120 Investigation, inspection, and examination of conditions, books, records, and reports; ... failure of licensee to cooperate with investigation, inspection, or examination. (1) The department may investigate, inspect, and examine conditions of a child care organization and may investigate and examine the books and records of the licensee. The licensee shall cooperate with the department's investigation, inspection, and examination by doing all of the following: (c) Providing accurate and truthful information to the department, and encouraging witnesses, such as staff and household members, to provide accurate and truthful information to the department.
Ms. Jolliffe did not provide accurate information regarding CCSM 2's attendance at the center. She reported that CCSM 2 had been on vacation the week prior to testing positive for a communicable disease; therefore, no report to parents was needed because there had been no exposure at the center. This directly conflicts with the timecards provided. CCSM 2's time cards verify that she was at the center and exposed others to the communicable disease

On 06/02/2022 1 completed an unannounced visit to the child care center. I met with Licensee Designee and Program Director Kellie Jolliffe. Ms. Jolliffe stated she has followed all protocols when it comes to communicable 2 diseases in the child care center. There is a parent who is upset because the information regarding one classroom where her friend's child attends is not being shared to the classroom where her child attends. Ms. Jolliffe stated when they have an issue with a communicable disease, they are sharing the information directly to parents of the children who are in the room. Because they have not had any communicable diseases to report, they have not had to report to the parents. Ms. Jolliffe is not reporting suspected cases of close contacts of COVD-19 to the entire school. Per the current CDC guidelines, they notify parents of the children who are considered a close contact and they follow what the health department recommends. Ms. Jolliffe stated there are concerns with HIPPA and confidentiality when sharing information to parents who do not need to know, and the parent who is upset should not be asking about other children. Ms. Jolliffe stated they have notified all parents and individuals who needed to be notified if there was any type of communicable disease. They follow their center policies when it comes to notifying parents and the correct follow up to the health department. I interviewed Morgan Lynch, who stated she works in the preschool room. Ms. Lynch stated they had a child in her classroom with a parent who had a communicable disease. As a precaution, they notified the parents in her classroom of the potential exposure. They wanted to make sure everyone in the room was on the same page. Ms. Lynch stated they do not tell everyone in the center if there is a possible exposure because of the current CDC guidelines and from direction from the health department. Ms. Lynch stated staff speak with every parent in the classroom about communicable disease and notify them directly during pick up. Ms. Lynch stated they have not had any cases of confirmed Pink Eye at the child care center. I was able to view the center's communicable disease protocol, the current health department and CDC guidelines and verified the center is following their guidelines. On 06/03/2022 I received an email from Ms. Jolliffe highlighting the current health department guidelines and how they have been responding appropriately. On 06/02/2022, 06/24/2022 and 07/19/2022 I attempted to contact Child B's Mother and Child C's Mother. I left messages during each telephone attempt. At the time of the completion of this report, I have not received a return call. On 08/03/2022 I completed a telephone exit conference with Licensee Designee Kelle Jolliffe. I provided technical assistance to Ms. Jolliffe regarding communicable disease reporting. I let Ms. Jolliffe know if a child or employee has contracted a communicable disease, she will notify the parents and employees by posting the information at the front of the building on the parent information board. 3
