    R 400.8143 · R 400.8143 Children's records. (2) Child information cards must be reviewed and updated by parents at least annually and when the center becomes aware of changes.

    On 07/27/2023 I communicated with Child A’s Father. He stated that he shares 50/50 custody with his ex-wife of Child A. The center uses an app called ProCare, in addition to their paper child information cards, and ProCare includes a list of people who are approved to pick up and drop off the child from the center. Both parents can add and erase people from the approved list on ProCare. In December 2022, Child 2 A’s Mother added people to the approved pick-up list from her family. The same day, Child A’s Father added someone to the list. On January 23, 2023, Child A’s Mother deleted the person that Child A’s Father had added to the approved list. He then deleted the people she had added. After that date, Child A’s Father noted that he believes people that Child A’s Mother had added to the list continued to pick up Child A from child care, even after he deleted them from the ProCare app. Child A’s Father said he spoke to the Program Director at the center, Jill Peters on July 24,2023 and she told him that she had a copy of the custody order for the child, and it stated that Child A could be released to a third party who is known by both parties and that she didn’t want to get in the middle of a custody battle. Child A’s Father said he felt Child A’s Mother was being deceptive at having her family members come and get the child but using Child A’s Mother’s unique pin to sign her out, so it would look like it was Child A’s Mother picking up in the records. On 07/27/2023 I completed an unannounced on-site inspection at the center. I spoke with Program Director Jill Peters. She stated that the center keeps a hard copy of each child’s child information card, which includes the names of people who are approved to pick up the child, and they also use the ProCare app, which lists approved people as well. The center’s policy is to check the ID’s of people they do not already know if they come to pick up a child. I asked Jill Peters if Child A’s parents had a child information card filled out for Child A’s Mother during her court ordered time, and Child A’s Father during his court ordered time, and she said no. The child only had one child information card and one ProCare account, which the parents shared. Jill Peters showed me Child A’s child information card, and it listed four people: Child A’s Mother, Child A’s Father, Child A’s Maternal Grandmother and Child A’s Maternal Grandfather. It was signed by Child A’s Mother, who enrolled her at the center. Jill Peters said she had a copy of the family’s court order. She showed the court order to me, and it reads, in part, “Either party may utilize a third party, who is known to both parties and the minor child, to assist in the exchange of the minor child.” Jill Peters stated that Child A’s Mother’s family are known to the staff at the center, as they have been picking Child A up from childcare since she was enrolled there. The staff know them well and would not think to check if anyone had taken them off the approved list in ProCare. ProCare does not alert staff when parents delete or add someone to the approved pick-up list. Child A’s maternal aunt is not listed on the physical child information card. Jill Peters said, “An aunt has probably picked up. The mom would tell us in the morning who was picking up, and we would write it down so we could check the ID at pick up.” I reminded her that if a parent wants to have someone else pick up, the staff need to remind them to add that person to the child information card as an approved person. “When Child A’s parents first separated, they were taking off and putting on people constantly.” Jill Peters said, “This is about their divorce, not care. Child A’s Father said to me, “Child A’s Mother could make this all go away if she’d put my fiancé on the card.” I explained to Jill Peters that one of the allegations in the complaint was regarding who signed the child in and out, the family member or the child care staff.     During my contact with Child A’s Father, he stated that on July 16, 2023 he noticed a mark on Child A. When he asked Child A’s Mother about it, she indicated that it had happened at child care. The next day Child A’s Father asked CCSM1 what had happened, and she wasn’t sure. CCSM1 was not Child A’s lead caregiver at that time. Later that same day, CCSM1 texted Child A’s Father and said she found out that it did happen at the child care and they would locate the report. Child A’s Father was notified by Child A’s Mother that Jill Peters had contacted her about the incident report and said there had not been one written because the incident occurred during pick up and Child A’s Mother had been present and witnessed it. Child A’s Father wrote, “On July 19, 2023, at 08:37 AM, I received a screenshot of the incident report from CCSM1 showing the incident happened on July 13, 2023, at 10:20 AM. Which was raised concerns, because Child A’s Mother said she was at daycare at the time of the incident, but Child A was not signed out until 4:15 PM by staff. I was informed by staff the report was found in a cubby with books.” Child A’s Father reached out to Jill Peters about this. Jill Peters called Child A’s Mother, and she stated that there were actually two incidents involving Child A on the day of the incident. One was in the morning, and an ouchie report was written. The other was during pick-up when Child A’s Mother was present. He said it “couldn’t be true” that Child A’s Mother had been there at pick up for the second incident, because her work schedule would prohibit it. He was also upset that Child A’s Mother had been contacted about the incident report, when he was the one who had requested the information. Jill Peters said sometimes the center uploads incident notifications into ProCare, sometimes they call parents and sometimes they give them an ouchie report at pick- up, depending on the severity and urgency of the injury. Often, if it’s not serious, the staff member fills out an ouchie report and “whoever picks up that day signs it.” On the day in question, 7/13/2023, Child A’s Mother had been the one to pick up. Jill Peters said they couldn’t find the incident report when Child A’s Father initially asked for it. “After we sign them, we place them on the ledge so parents will see them when they pick up. This one had fallen off the ledge and into some books. We found it a few days later, and Child A’s Mother signed it then.” Jill Peters said she called Child A’s Mother and not Child A’s Father when they couldn’t initially find it, because they thought maybe she had taken it with her. “He was furious that I called her about it, when he was the one who asked about it. I was just trying to figure out where it went.” CCSM1 said she is an assistant child care staff member in the infant room at the center. She said Child A’s Father was upset that the time frames didn’t add up, that he was told the incident happened at pick up but the incident report said it had happened earlier in the day. “The times didn’t match up because there were two different incidents. Child A’s Mother said it happened at pickup, but she actually saw the second incident, not the first. She didn’t realize there had been an earlier 5 incident.” “I texted him and told him that the girls said it did happen here, but that I couldn’t find the incident report. We found it two days later, it had fallen off the ledge into some books.” CCSM1 said that the usual process for incident reports is that the staff fill them out and fold them with the child’s name on the outside to protect their privacy. They are placed on the ledge for parents to sign and return. Child A’s Mother said that the staff at the center always notified her when there was an incident. “They always notify me. They are absolutely wonderful there. At pick up on July 13, I saw her (Child A) get up off the floor, and I assumed she fell. There was a small mark on her face but it wasn’t anything. It was lik

    Child A’s Father said that Child A was unenrolled after he brought up his concerns. I asked Jill Peters about unenrolling Child A. She said, “On the phone, Child A’s Father was just so disagreeable and threatening. He said, “If you don’t do what I want, this is going to happen.” He said, “It’s in your best interest to figure this out.” He told me on the phone, “I sit and watch at pick-up time” so he knows who picks up Child A. He sits across the street and watches – it’s kind of like stalking. It made me so uncomfortable, so I unenrolled.” I asked Jill Peters about the unenrollment policy of the center. She took it out and showed it to me. Under “Inappropriate Parent Conduct” there is a policy that states that the center reserves the right to 6 immediately terminate the child care agreement if the parent behaves in a threatening or inappropriate manner. Child A’s Mother said she is very disappointed that Child A can no longer attend the child care. “She was doing very well there. I’m very upset that she can’t attend anymore. She was thriving there.”

    R 400.8125(1) · R 400.8125(1) Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On December 13, 2021, I made an unannounced on-site inspection at the child care center. I spoke with child care staff members Katelin Karel, Aleah Fuller, Kaitlyn Sullivan, and Lisa Peters. Ms. Karel stated that she was aware of the incident where Child A received a sprained wrist. She was at the center when Child A's Father arrived to pick up Child A. She said that Child A's Father told her he would take Child A to the doctor and let her know that Child A has received injuries to his left arm in the past. Ms. Karel said there was a similar incident that happened in 2019 where Child A's Mother was holding Child A's hand and he threw himself on the floor and received a sprained wrist. She stated she is not aware if there are any medical explanations for the injuries. She provided me with an email from Child A's Mother that lists past injuries for Child A's left arm. A copy of the email has been placed on file with this report The email states the following information: • 06/26/2019 Child A's Father picked up Child A from care because he was not using his arm. Child A's Father took him to the emergency room and he was diagnosed with Nursemaid's Elbow. The hospital staff taught Child A's Father and Mother how to put Child A's elbow back in place. • 06/30/2019 Child A's grandmother and father were changing Child A's diaper. His elbow was dislocated again. Child A's Mother was able to put his elbow back in place. • 09/28/2019 Child 's Mother was holding Child A's hand when he "threw himself' on the floor. Child A's Mother took him to urgent care and he was diagnosed with a sprained wrist. • 11/02/2019 Child A's parents noticed that he was not using his arm. They took him to urgent care and he was diagnosed with a sprained elbow. Child care staff member, Aleah Fuller stated she is an assistant in the Panda Room. She informed me that children in that room are aged 30 months to 3 years. She said she was working in the Panda room on December 8, 2021, and was present when Child A received the injury. She was helping children with an art project with her back to where Child A was. She looked over to where Child A was. She saw Child A "punch" Child B (male, age 3) on his back. She saw CCSM Kamryn Rouse walk over to the children to "split them up." She heard Ms. Rouse say, "that is not ok" to Child A. She saw Ms. Rouse "gently" grab Child A's hand to take him to time out. Ms. Fuller said that Child A was crying and "freaking out" when Ms. Rouse was walking him across the room. She saw Child A "throw himself on the floor." She said that Ms. Rouse was still holding Child A's hand when he threw himself on the floor. She said she saw Ms. Rouse let go of Child A's hand when he landed on the floor. He continued crying and said his "wrist hurt." Ms. Fuller stated she looked at Child A's 3 wrist and assessed his hand. He was able to squeeze her fingers and move his fingers. She said she provided ice for Child A's wrist. She said he calmed down and about 20 minutes later complained that his wrist was still hurting. She said that CCSM Lisa Peters called Child A's parents. Child A's Father arrived to pick up Child A. She said that Child A's Father informed staff that Child A had received prior injuries to his left arm; making it more susceptible to injuries. Child care staff member Kaitlyn Sullivan stated she is the lead in the Panda Room. She said she was not present in the room on December 8, 2021, when Child A received the injury. She stated that she has worked with Ms. Rouse in the past and has not seen her grab or yank children. Child care staff member Lisa Peters stated that she was not present in the Panda room when Child A received the injury. But staff called her into the room to access Child A's wrist after the incident. She said that she was told by staff in the room that Ms. Rouse was walking Child A to the time out area when he threw himself on the floor and then complained about his wrist hurting. She said she accessed Child A's wrist
