On 11/30/2022, I completed an on-site inspection. I interviewed site supervisor Alena Gessner, Child Care Staff Member 1 (CCSM 1), and Child Care Staff Member 2 (CCSM 2). Ms. Gessner stated that program director Morgan McCarty was not present. Ms. Gessner has no knowledge of CCSM 1 or CCSM 2 inappropriately handling any child. She has no concerns with CCSM 1 or CCSM 2. CCSM 1 stated that she has received plenty of training on how to move a child appropriately. She has routinely picked Child A up from underneath his arms, but only when absolutely necessary. She has never injured Child A when she has had to physically redirect him, nor has Child A ever complained of pain. She described Child A as a very active child who routinely climbs on things, hits, scratches, and throws toys. She identified rest time as a trigger for Child A. He would throw chairs and run around the classroom when it was rest time. Additionally, Child A has fallen to the floor in a fetal position with his hands over his head whenever staff attempted to redirect him and Child A would say, "Please don't hurt me, please don't hurt me." She recalled a time when Child A punched, slapped, bit, and kicked another staff 2 member. She stated that whenever she has needed assistance with Child A that the center has always provided prompt assistance. She always asked for support when Child A became physical. She had more interaction with Child A than CCSM 2 and routinely redirected him. She would routinely sit down with Child A and ask him open-ended questions whenever he was upset. She stated that Child A was "awesome" one on one. She was shocked and very distraught when she learned that Child A's Mother sent an email accusing her and CCSM 2 of hurting Child A. She recalled that Child A used to push his chest up against a shelf and wondered if that could have caused him pain to his ribs/underarm area. Child A never indicated to her that he was injured or in pain after he was moved under the arms or otherwise. She stated that Child A was attached to her the most and that she would never hurt anyone. She stated that program director Morgan McCarty watched the video footage of her interactions with Child A and did not see anything of concern. She stated that Child A's parents declined Ms. McCarty's offer to review video footage. She wished that they would have watched the footage because then they would know that she and CCSM 2 did not mishandle Child A. She reported that Child A went on a behavior plan and reduced schedule due to his behaviors. She stated that she was sad when Child A stopped attending altogether because he was benefiting from the program. CCSM 2 stated that she has never hurt Child A while disciplining him or otherwise. She and CCSM 1 have talked with program director Morgan McCarty regarding Child A's behavior on a regular basis. She described Child A has having explosive and unpredictable behavior. Child A's little behaviors frequently snowballed into big behaviors, but they have learned how to address and meet his needs. She stated that Child A's behaviors lasted for long periods of time and routinely disrupted the learning day for the other children. Child A was put on a behavior plan and a reduced schedule due to his behaviors. Child A routinely climbed, hit, scratched, bit, ran, and "dropped out." She described "dropped out" as Child A abruptly falling to the floor and yelling, "You're hurting me, you're hurting me" or "Don't hurt me, don't hurt me." She stated that he frequently did this when staff held his hand, but he did it even if no one was touching him. She has received training on how to properly move a child. She always picked Child A up from under his arms if she ever needed to physically move him. She described Child A as very light and easy to move. She and CCSM 1 always backed off when Child A verbalized that they were hurting him, but they also reassured him that they trying to keep him safe. Additionally, Child A frequently used pr

On 4/13/2022 program director, Frenisha Wiggins notified Child Care Licensing Consultant Stacia Thrower of an incident were Child C (female, age 5) was left alone in the restroom for approximately four minutes. On 4/14/2022 I completed an unannounced onsite inspection at the facility and spoke to program director Frenisha Wiggins and Child Care Staff Member (CCSM) Paul Mayhue. Ms. Wiggins explained that Child C is enrolled in Room 26 and there are no restrooms in the classroom. Vanita Irvin was the lead CCSM in the classroom and was new to this location. She worked at another Head Start location but was filling in at this facility due to staffing issues. This facility has camera's that record throughout the building. Cameras in the hallway showed CCSM Ms. Irvin and unsupervised volunteer Katharine Thomas bringing nine children to the restroom that is located directly across from the main office at 2:42pm. Shortly after, CCSM Mr. Mayhue brought down two other children bringing the total of children to 11. At 2:44pm 10 children and three CCSM's were observed on the camera's leaving the restrooms and heading toward the gym. Around that time CCSM Treasure Belcher was in the hallway with her class when she heard a child crying. Ms. Belcher turned towards the restroom along with Ms. Wiggins who was in the office near the bathroom, and they observed Child C peaking her head outside of the restroom door. Ms. Wiggins identified that this occurred at 2:48pm. She was sure of these times because when she rewatched the security camera videos which was time stamped. Ms. Wiggins stated she was told by Ms. Irvin that she thought she only saw one child come down to the bathroom with Mr. Mayhue and didn't realize he had two with him. Mr. Mayhue let the two boys enter the restroom with the rest of the class. When one of the boys exited the bathroom and joined the rest of the class who were waiting in the hallway, Ms. Irvin counted 10 children and thought she had everyone. The class then headed to the gym. Ms. Irvin reported to Ms. Wiggins she believed the other child was still sleeping in the classroom and she didn't realize he also went with Mr. Mayhue to the restroom. Ms. Wiggins provided written statements from all staff involved. I spoke to Paul Mayhue who works as a behavioral specialist in the building. He stated he was called into Room 26 to provide support. He identified the children were restless so the plan was to bring them to the gym to burn off some energy. He entered the classroom around 2:30pm. Two children were still sleeping from nap, so he was told to stay in the classroom with them and help them wake up and get shoes on while Ms. Irvin and Ms. Thomas brought the other children to the restroom then to the gym. Mr. Mayhue was not sure how many children were present in the classroom but Ms. Irvin and Ms. Thomas brought most of the classroom with them and left him and CCSM Lisa Winne in the classroom with two boys. Ms. Winne was working on writing a statement and was not providing care for children. After helping the boys wake up and get shoes on, he walked them to the restroom.. He stayed in the hallway while the boys entered. Ms. Thomas was holding the restroom door 3 open as children exited into the hallway. He identified that children were coming out of the restroom and lining up in the hallway. He denied counting the children but stated one of the other staff members counted the children. He was unsure how many children were present while at the restroom. Mr. Mayhue walked with the children to the gym and counted the children as they entered the gym. He counted 10 children. When they arrived at the gym one of the two boys he brought down needed to use the restroom so he exited the gym to bring him to the restroom. When he did, he observed Ms. Wiggins in the hallway with Child C. Mr. Mayhue explained he did not typically work in this classroom, and he was unfamiliar with the children. On 4/14/2022 program director, Frenisha Wiggins notified Child Care Licensing Consultant Stacia Thrower of an incident were Child D (female, age 4) was left alone in the restroom for approximately two minutes. On 4/15/2022 an incident report was received from Ms. Wiggins outlining the incident where Child D from Room 21 was left in the restroom unsupervised for approximately two minutes. The incident report stated CCSM's Ella Fulkerson and Kanesha Lyons were heading in from the playground with their class. The class stopped at the restroom at the north end of the building. This restroom is directly across from a receptionist desk where Laura Tucker sits. When the left the restroom the two CCSM's and Ms. Tucker had 14 children, leaving a child in the restroom, and headed back to their classroom. Child D was found walking down the hallway alone by CCSM Stephanie Edwards. Ms. Edwards brought Child D to Ms. Wiggins. Ms. Wiggins then returned Child D to her classroom. The video footage was reviewed and a timeline was determined from the video. During the timeframe of five minutes Child D was in close proximity of other staff members but unsupervised for approximately three minutes but in the hallway alone unsupervised for two minutes. On 6/2/2022 I spoke to CCSM's Ella Fulkerson and Kanesha Lyons by phone. A phone call was made to Ms. Fulkerson but Ms. Lyons was also present in the room during this call. Ms. Fulkerson identified she and Ms. Lyons had 15 children present on 4/14/2022. They came in from outside on the playground and went directly to the restroom across from the secretary station. There are two restrooms side by side. Ms. Lyons had three children in the smaller restroom and Ms. Fulkerson took 12 children in the larger restroom. Child D was in the restroom with Ms. Fulkerson. Ms. Lyons finished first and was waiting in the hallway with her three children and Ms. Fulkerson was sending out children as they finished in the restroom. Ms. Lyons began to walk back to the classroom, but Ms. Fulkerson told her to wait until everyone was finished. Another CCSM, Ronnieceya Smith, came to the restroom with one of her children. Ms. Fulkerson exited the restroom during this time and she had the children line up. She stated she miscounted and thought Child D was in the line with the rest of the class. Ms. Fulkerson believed she saw Child A in the hallway with the other children but thinks she may have re-entered the restroom. She stated the hallways back to the classroom was long and when she got back to the classroom, she did not count the children. She estimated around three minutes later Ms. Wiggins brought Child D back to the classroom. 5 I spoke to Ms. Lyons. Ms. Lyons stated that while she was waiting in the hallway with the children one child took off running. She followed the child while Ms. Tucker stayed with the other children in the hallway. Ms. Lyons stated this child continued to not want to stay with the group which caused a little commotion during this transition. On 6/2/2022 I spoke to Ms. Wiggins by phone. She stated she observed the video footage of this incident. Ms. Wiggins observed the group standing in the hallway and the child running in the hallway away from the class. Ms. Lyons went and got that child and rejoined the class. Ms. Tucker was observed walking back to the classroom with the class to help engage the child who kept running away. Ms. Smith was standing in the doorway waiting for her one child to finish using the restroom. Once she left the camera cut out and went black. Ms. Wiggins was not sure but stated she thought the camera either had a glitch or was activated by movement. Approximately two minutes later Child D was observed on another camera walking in the hallway near the restroom. Ms. Edwards was standing near the secretary station and saw Child D. Ms. Edwards was observed looking around for a staff member and when she didn't see one she went up to Child D. It was estimated that Child D was
