Chdd A's Mother reported that Child A came home from school and stated that he feared his teacher, Child Care Staff Member 1 (CCSM 1). Child A's Mother stated that Child A told her that he did not want to take a nap and CCSM 1 made him by pushing him down on the cot, grabbing him and forcing him to lay down. She reported that she was frustrated because Child A is typically well behaved and does not understand how this could happen. Child A's Mother provided of Child A's Child A had Child A was observed and did not want to be"in rviewe Child were observed on the left side of his On 3/712022, 1 completed an announced inspection at the facility with During our visit, we interviewed program director, Lauren Obermeyer. Ms. Obermeyer stated that she believed the incident occurred between the times of 12:38pm and 12:46pm. Ms. Obermeyer noted that CCSM 1 is on leave until further notice. Ms. Obermeyer provided video footage for the incident that occurred on 3/112022. The video review is as follows. The video had poor audio quality throughout, and the time stamp was not accurate. It was not possible to hear the two staff members present in the classroom. The two staff members were CCSM I and CCSM 2. At the beginning of the video Child A is observed sitting at a table with a spoon in his mouth. CCSM 1 could be observed talking with him, however the conversation could not be heard. CCSM I then forcefully took the spoon out of his mouth and walked 1 away. Child A remained seated and began to kick the table. The other children in the room were already laying on their mats for rest time. CCSM 2 entered the classroom with a group of students. Ms. Obermeyer informed and I that they had come back from the bathroom. CCSM 2 is observed attempting to clean up the lunch. CCSM I engages verbally with Child A, it appears she is telling him that she is going to move him, and Child A is heard clearly saying "no." CCSM 1 is observed picking up Child A under his arms and moving him to a cot in the corner area of the room. CCSM 1 sat on a small table next to the cot, blocking Child A from moving. After a few minutes and unheard dialogue, Child A leaves the cot and walks away. CCSM 1 follows Child A, and they are briefly out of the camera view. CCSM 1 is then observed carrying Child A back to the cot and laid him on the cot. Child A sits up and CCSM 1 him down him to lay with his head on the cot. Child A sits up again and CCSM 1 him down again. It appears that CCSM 1 Child A for a few secon s. Child A then stands up and CCSM 1 is sitting on the small e near the cot. CCSM 2 approaches CCSM I and Child A. Child A moves away from the cot and CCSM 1 follows him. Child A moves and then is laying on the ground. CCSM 1 grabs his arm, and he appears to on the ground. "'. CCSM 1 him by his arm a short distance back to the cot. CCSM 2 observes the interaction between CCSM 1 and Child A and her body starts to block the camera. Child A runs to the bathroom that is in the classroom. CCSM 1 and CCSM 2 follow Child A into the bathroom. CCSM 1 carried him back to the cot, while Child A is yelling "I want to go home." It appears that CCSM 1 is Child A down on the cot. Child A then sat up and CCSM 1 and W him down on the cot, ensuring that tie is lying all the way down. Ms. ermeyer noted at that point either staff should have radioed for her or support, but they did not. Child A gets off the cot and CCSM 1 picks him up and puts him back on the cot. CCSM 1 again = him down to the cot. Child A is heard crying. CCSM 1 tells him to keep his feet down and takes Child A's shoes off and threw them behind her. Child A then starts to laugh and then cry. Child A is heard yelling "no" frequently. Child A then gets up and CCSM 2 is blocking him from going somewhere else. During this point of the video footage there was a canopy blocking the view of CCSM 2 and Child A; however, Child A can be heard sayi

Based off video surveillance, CCSM I was observed pushing, grabbing, and holding down Child A when he refused to lay on his mat during rest time. Due to these forms of corporal punishments, Child A was observed to have bruising and scratches to the left side of his torso.

Based off video surveillance, it was observed that CCSM 1 and CCSM 2 did not provide appropriate supervision to children in the classroom during rest time on 3/1/2022. CCSM 1 and CCSM 2 were occupied with Child A and did not check on the other children restina for over an hour.
