On 2/23/2021, I received an incident report outlining a staff complaint regarding another child care staff member (CCSM). The incident report stated CCSM Stephanie Rohs reported she witnessed two inappropriate incidents where CCSM Sofia Seath was involved. It stated that Ms. Seath was observed taking Child A (female, age 1) by the arm and "flung" her three feet before putting her down and saying roughly "oh you're okay". It was also reported that Ms. Seath put Child B (male, age 11 months) down roughly in an Exersaucer when his leg got caught in the seat. On 2/25/2021 I completed an unannounced onsite inspection at the facility and spoke to program director Beth Lucksted and CCSM's Stephanie Rohs, Stacy Maestas-Muir, Carley Laubough, Kylie Corell and Leah Parker. Ms. Lucksted stated this is the first time she has heard of any inappropriate contact involving Ms. Seath. She stated Ms. Seath has worked at this facility since September 2020 and has no complaints or write ups. 2 I spoke to CCSM Stephanie Rohs who stated she works in the Infant classroom. She stated that she occasionally works in other classrooms throughout the building when needed. Ms. Rohs stated she has worked with Ms. Seath two to three times for a few hours total, never a full day. She explained on one occasion she observed Ms. Seath pick up Child A by one arm and toss her. She estimated that Child A came about six inches off the floor and moved around two feet across the floor. She stated that Ms. Seath sarcastically said to Child A "oh are you okay." She identified that Child A was crying. Ms. Rohs was unaware if there were any other staff members present in the classroom. The second incident that Ms. Rohs recalled was regarding Child B. She stated that Child B was banging his hands on the nap room window and Ms. Seath picked him up. Ms. Seath jammed Child B down in the Exersaucer. His leg was bent and not in the leg hole. Eventually Child B's leg went into the leg hole. Ms. Rohs stated Child B was crying and Ms. Seath stated, "oh did that hurt you?". Ms. Rohs believed she and Ms. Seath were the only staff members in the classroom when this occurred. I spoke to CCSM Stacie Maestas-Muir. She stated she works in the Faris classroom and works closely with Ms. Seath who is the lead. She identified she has never witnessed Ms. Seath to do anything inappropriate with child care children. She stated that Ms. Seath's speaking voice tends to be loud, but she denies that she has ever heard Ms. Seath speak inappropriately to child care children. Ms. Maestas-Muir identified that if she felt like Ms. Seath was ever inappropriate with children, she would speak to Ms. Seath about it or notify administration. Ms. Maestas-Muir stated she was in the classroom during both alleged incidents. She observed Ms. Seath take Child A by the hand to guide her in the classroom. Child A collapsed onto the floor. Ms. Seath let go of Child A's hand and picked her up under her arms to move her where she needed to go. Ms. Maestas-Muir explained she watched Ms. Seath pick up child B while Ms. Rohs was in the classroom. She stated that Child B was picked up and moved to the Exersaucer. She could not recall why he was moved but stated sometimes staff will do this after lunch to prevent them from eating the food on the floor following lunch service. When Ms. Seath placed Child B in the Exersaucer, Child B was observed to cry and flung his body backwards. Ms. Maestas-Muir stated Child B does not like to be placed in any confining baby equipment. She saw that Child B's leg was not in the seat correctly and observed as Ms. Seath corrected the leg before placing him in the seat. I spoke to CCSM Carley Laubough who stated she works in the back half of the Faris classroom. She stated Ms. Seath works in the front half of the classroom, but she has observed Ms. Seath's interactions with children regularly. She stated she has never heard or witnessed anything inappropriate from Ms. Seath. Ms. Laubough stat

On 01/06/2021 I spoke with the complainant regarding the allegations. They stated that Ms. Lucksted does not complete the duties of her job. "She's supposed to do the schedule, but she doesn't do it correctly. She changes staff hours without communicating it to them." She also said Ms. Lucksted "sits at the front doing nothing while everyone else works." The complainant also stated that Ms. Lucksted creates a toxic work environment. "She yells at staff in front of children. On 12/29/2020 she yelled at an employee in front of other staff and children, like full-on shouting". The complainant said the staff member had been asked to work in the kitchen and she refused as that was not her usual job. Ms. Lucksted then came back to ask her to do something else and the employee got upset. The staff member started yelling but Ms. Lucksted yelled back. "She's the director, she should be calm." On 01/07/2021 I completed an unannounced on-site inspection at the center. I interviewed Ms. Lucksted. She said she had been anticipating a complaint, as they've been "having some staffing issues. I had a group of employees who were all friends and addressing issues with them was difficult. They don't respond respectfully." I asked specifically about the alleged confrontation on 12/29/2020 with a staff member that took place in front of children. "Voices were raised, yes. The person I was speaking with is loud and she started raising her voice, so I had to raise mine to be heard." She said she had asked the child care staff member to help in the kitchen because the center was short staffed due to the COVID-19 pandemic. The child care staff member refused because it wasn't part of her normal duties. She then returned to the classroom to ask the same child care staff member to take some classes online and she had gotten upset. "There's been many issues with her. I've had many conversations with her about it, because she's been difficult and causing grief with other steady employees." Ms. Lucksted said she feels that the staffing issues have progressed "because I allowed it to happen. I tend to be kind of passive and I should have addressed it better." Morgan Davis is an assistant teacher and floater at the center. She said Ms. Lucksted has "always been kind to me and has never raised her voice at me." She was in the classroom on 12/29/2020 during the incident with Ms. Lucksted and the child care staff member. "Beth [Ms. Lucksted] came into the room and asked her to help in the kitchen. She said no, and Beth [Ms. Lucksted] said ok and then asked her to do some training. The child care staff member started raising her voice, and Beth [Ms. Lucksted] raised her voice to be heard. The child care staff member was yelling, but Beth [Ms. Lucksted] just raised her voice." Ms. Davis said the children did not appear to notice the altercation and did not ask what was going on. Ms. Davis has never seen Ms. Lucksted be disrespectful or inappropriate to a child care staff member. "She has a good handle on the center. I don't have any concerns about her not doing her job well." Justice Crawford, staff member, stated she has worked at the center for around two years, and works in the Pedal room. She has never had a negative altercation with 3 Ms. Lucksted but she said she doesn't interact with her too often. She hasn't seen her act in an inappropriate way with child care staff members. "She might get flustered, but I've never seen her yell or use inappropriate language." Ms. Crawford did not know about the incident on 12/29/2020. Over the summer there was an incident where two child care staff members got into an argument in the kitchen, and one of them was the child care staff member involved in the incident on 12/29/2020. It wasn't handled well by the administration. "They were yelling and arguing in the kitchen. Beth [Ms. Lucksted] got them together and had a meeting with the two of them and then one of them walked out for the day. Beth [Ms. Lucksted] called her

During my interview with the complainant on 01/06/2021, they stated that the center is often does not maintain the required staff to child ratio. The Pedal room was out of ratio on 12/29/2020 and again on 01/06/2021. If the classrooms are out of count "which happens a lot, she won't do anything. She won't come in or send anyone else in." On 01/07/2021 I asked Ms. Lucksted about staff to child ratios in the Pedal room. She said the room had been out of ratio on 01/06/2021 for a short time, but that no one had informed her that they were out of ratio. "Yesterday they were over by 3 [children], but they hadn't notified us at the front. As soon as I saw them, I addressec it. I'm not sure how long it had been." I reviewed name to face records for the Pedal room from 12/21/2020, 12/28/2020, 12/29/2020, 12/30/2020 but they did not reflect the classroom being out of the staff to child ratio on those days. During my on-site on 01/07/2021 I completed a tour of the center and counted ratio in all classrooms at the center. None of the rooms were out of ratio at the time of my inspection. Morgan Davis did not have concerns about staff to child ratios in the center. She said she thought the rooms were usually covered sufficiently and that if they needed help, the administration team would send someone. Justice Crawford stated that classrooms are out of count often and "no one tries to help us. It's mostly our room, it seems, and they don't send help." Ms. Crawford explained she was in the Petal room on 01/06/2021 and they were out of the required staff to child ratio for 30 minutes. "I had one of the other teachers call the front but no one was there." Lydia Gall stated she did not have concerns for staff to child ratio over the past several weeks. She said it has been an issue in the past but not more recently. Katelyn Coleman said the Pedal room was did not maintain the required staff to child ratio on 01/06/2021. "They knew we were out. It's hard in the mornings. I think Beth [Ms. Lucksted] said she'd send someone down but then didn't." Diana Colorado said she hasn't had concerns for staff to child ratio over the last several weeks. She was sitting up at the front on 01/06/2021 during her planning time when the Pedal room was out of ratio. "While I was doing planning up front, Beth [Ms. Lucksted] was moving kids around in other rooms to make sure they were in count. She went back to the Pedal room and came back and said, "They're over and didn't tell me. Did anyone call up here?' They had not. Beth [Ms. Lucksted] covered the room right away when she knew." A
