On 10/20/21, I completed an onsite inspection and spoke with Child Care Staff Member Rachel Francisco regarding the allegation. Ms. Francisco stated that the incident took place on 10/18/21 between 12:30pm and 12:40pm. There were 14 children, herself and child care staff member Jeff Schuleter present at the time. Ms. Francisco stated that she had to use the bathroom which for staff members is located in the breakroom down the hall. Since she was going into the breakroom she decided to grab her lunch to place in the microwave. She put her lunch in the microwave for a couple minutes and then went into the bathroom. She stated that when she came out of the bathroom her food was done, she grabbed it out of the microwave and went back into her classroom. Ms. Francisco stated that when she returned to the classroom Mr. Jeff Schuleter was standing at the sink with Child A holding a wet towel against her face. He immediately told her that Child A was hurt. She tried to check her mouth but there was a lot of blood, so she took her upstairs to the school nurse. The school nurse took over first aid from there, but she stood with Child A while the nurse rendered first aid. However, she briefly left Child A with the nurse while she went back to the classroom to grab Child A's belongings and another child would was being picked up in the office at 1:00pm. Ms. Fransciso stated that Child B was recently diagnosed with medical condition requiring medication that was making her angrier and yelling but not physically aggressive. This incident was completely out of the blue, unexpected, and unprovoked. She stated that Child B has never been physically aggressive before which is why this was so surprising and unexpected. I spoke with Child Care Staff Member Mr. Jeffrey Schlueter about the incident between Child A and Child B. He stated that on 10/18/21 around 12:30pm or 12:40pm, Ms. Francisco left the room to use the bathroom and warm up her soup. She was away from the room no more than 3-5 minutes. She asked him to stand near another child who was finishing his lunch at her desk because he needs a little extra supervision. All of the other children were seated except a couple of boys in line to use the bathroom and Child A and Child B were in the bathroom. Child B was at the sink, Child A was a couple of steps behind Child B waiting and there was another child standing just outside of the room waiting. He stated that he noticed Child A had moved a little closer to Child B near the sink because Child B was still washing her hands. At that point Child B reached over with her right hand and just slammed Child A's head down. Child A started screaming and he rushed right over to grab her. He took her to the classroom sink, grabbed a clean towel from the drawer, wet it and put it up to her mouth. He stated that at the point Ms. Francisco came in. He told her what happened, and she took Child A right up to the nurse. 3 On 10/21/2022, I spoke with Child A's Mother regarding the incident. She stated that she was told by Ms. Franscisco that her daughter was pushed by the back of her head into the sink. She stated that when she asked her daughter what happened, Child A told her that they were in the bathroom washing hands when Child B pushed her head into the sink and after that she also pushed her down to the ground and looked at her in a mean way. Child A's Mother stated that if all of this was able to happen it makes her question how long the children were unsupervised. Child A's Mother stated that the school nurse was unable to reach her, so the nurse contacted her mother who picked up Child A. The nurse told her mother that Child A needed to see a dentist. On 10/19/2021, she took her daughter to My Community Dentist Center where they took x-rays at which time the determined that she needed a surgery, but they couldn't do it until the following day on 10/20/2021. She stated that her daughter needed surgery because the tooth was pushed so far up into her
