On 03/21/2023, I reviewed the incident report and supporting documents uploaded into the facility's licensing file on 03/17/2023 by child care licensing consultant Jessica Miranda-Bevier. The incident report indicates that Child Care Staff member 2 (CCSM 2) observed Child Care Staff Member 1 (CCSM 1) pull Child A off the steps by the sink by one arm on 03/03/2023. CCSM 2 was changing diapers when the incident occurred. CCSM 2 told CCSM 1 that lifting a child in that manner was dangerous and risks dislocating the arm. CCSM 1 told CCSM 2 that Child A was "falling out", but Child A was standing normally. CCSM 1 told CCSM 2 that she was leading Child A down the steps, but she pulled his arm up, not down. CCSM 2's other arm was free, but she made no attempt to support Child A with both hands. On 03/23/2023, I completed an on-site inspection. I interviewed program director Matthew Selmon and Child Care Staff Member 2. Matthew Selmon stated that CCSM 1 and CCSM 2 are co-lead caregivers in the toddler classroom. CCSM 2 informed him of the incident. He has never witnessed CCSM 1 handle a child inappropriately. CCSM 2 affirmed that she witnessed CCSM 1 lift Child A off the steps by the sink by one arm on 03/03/2023. She did not observe any marks or bruises on Child A. She noted that Matthew Selmon notified Child A's parents of the incident. She reported that CCSM 1 is routinely rough with the children by grabbing them by their upper arms. CCSM 1 is also abrupt with children who fidget on the changing table. On 07/03/2023, I interviewed Child Care Staff Member 3 (CCSM 3) by telephone. She stated that she was not in the classroom when the incident occurred. She noted that CCSM 1 is in a classroom with a lead caregiver, CCSM 2, who tends to blow everything out of proportion. She has never seen CCSM 1 be aggressive with any child. She observed CCSM 1 redirect Child A when he went the wrong way on the slide in the classroom. CCSM 1 was guiding Child A by the hand when Child A just plopped down without notice. On 07/06/2023, I interviewed CCSM 1 by telephone. She stated that she took hold of Child A's hand when he was pressing up against a much smaller child on the steps by the sink. She described Child A as a "bigger" child who loves to play in the water. She told Child A "no thank you" as he pressed on the smaller child in front of him on the steps. She took hold of his hand to assist him down the steps, but he went limp causing her to hold him up by his arm. She did not anticipate Child A going limp. She did not want to let go of his hand because he would have fallen to the tile floor. She was worried that he would hurt his head had she let go of his hand in that moment. In hindsight, she believes that she should have guided him off the steps by coming up behind him under his arms. After this incident, she told Matthew Selmon that the 3
On 03/03/2023, Child Care Staff Member 1 (CCSM 1) grabbed Child A (18-month-old, male) by the upper arm and lifted him off a stool by one arm. Child Care Staff Member 1 (CCSM 1) falls asleep while she is responsible to care for children. Child Care Staff Member 1 (CCSM 1) does not change gloves between diaper changes.

On 03/21/2023, I reviewed documents uploaded into the facility's licensing file on 03/17/2023. The document dated 03/09/2023 indicates that CCSM 1 fell asleep at rest time and jerked herself away every few minutes on 02/16/2023. On 02/20/2023, CCSM 1 began to fall asleep around 11a m, jerking herself awake. On 02/21/2023 and 02/27/2023, CCSM 1 began nodding off, jerking herself awake. On 03/23/2023, I completed an on-site inspection. I interviewed program director Matthew Selmon and Child Care Staff Member 2. Matthew Selmon stated that CCSM 1 and CCSM 2 are co-lead caregivers in the toddler classroom. Matthew Selmon stated that he has no knowledge of CCSM 1 sleeping while she is responsible to care for children. On 07/03/2023, CCSM 3 and CCSM 4 reported no concerns regarding CCSM 1 sleeping while caring for the children. On 07/06/2023, CCSM 1 denied sleeping while responsible for the care of the children.

On 03/21/2023, I reviewed documents uploaded into SharePoint on 03/17/2023. The document dated 03/09/2023 indicates that CCSM 1 does not change gloves between diaper changes. On 03/23/2023, I completed an on-site inspection. I interviewed program director Matthew Selmon and Child Care Staff Member 2. Matthew Selmon stated that CCSM 1 and CCSM 2 are co-lead caregivers in the toddler classroom. Matthew Selmon stated that he was aware of the allegation, but he is not in the classroom to know if it is true or not. He noted that staff are trained to wash their hands after each diaper change and to use a clean pair of gloves for each diaper change. CCSM 2 reported that CCSM 1 does not wash her hands or change her gloves between diaper changes. On 07/03/2023, CCSM 3 and CCSM 4 reported no concerns regarding CCSM 1 washing her hands in between diaper changes and using a fresh pair of gloves each time because all staff are trained to wash their hands between each diaper change and to use a fresh pair of gloves each time. On 07/06/2023, CCSM 1 stated that she always washes her hands between diaper changes; therefore, she uses a clean pair of gloves each diaper change.
