On 11/1/2022, a complaint was received alleging that the center was operating out of ratio on 10/18/2022 and 10/28/2022. The complaint alleged that this occurred in the Pratt and Terance classrooms. On 11/04/2022, I made an unannounced on-site inspection and interviewed program director Elizabeth Lucksted. I reviewed the allegations and Ms. Lucksted responded that the allegations "are possible" and that the center did not maintain staff to child ratio, but she was not sure for how long. Ms. Lucksted said that several CCSMs called in sick. On 10/18/2022, the Terance and Pratt classrooms combined in the morning until the Pratt staff came in. The Terance classroom has 3-year-olds enrolled in it and the Pratt classrooms has 4-year-olds. Ms. Lucksted said that the classroom did not maintain required staff to child, but she was not sure by how much or for how long. She called in substitute CCSMs. She explained that the corporation has a spreadsheet that is used for staffing and shows that she reached out to find additional staff. On 10/28/2022, she was supposed to have the day off but came in around 9:00 AM because she heard that the center was short staffed. Ms. Lucksted reported that someone had quit via email at 8:00 AM and someone else called in sick at 8:15 AM. She said that the Terance and Pratt classrooms were combined and at 8:04 AM, they had 11 children and 1 CCSM. The next CCSM came in at 10:30 AM. Between 8:04 AM and 10:30 AM, 16 more children came in. Ms. Lucksted said that there may have been a substitute CCSM working in the classroom at that time, but they did not record who was in the classroom. Ms. Lucksted said that she did not know what happened, what the numbers were or what the noncompliance was. I asked what about her plan for future ratio compliance. Ms. Lucksted said that she has not been instructed to stop accepting children when the room is already at ratio and there are no CCSMs to work. She said that the operationalist specialist CCSM 10 would be the one to tell her what to do and that CCSM 11 does the staffing. Ms. Lucksted said that she is calling in substitute CCSMs, putting herself, the assistant director and cook into classrooms, combining classrooms and moving children around but they are not turning parents away. The center was in compliance with ratio requirements during the inspection. Ms. Lucksted provided me with the name to face sheets for 10/18 and 10/28/2022. 3 I reviewed the documents and found that the Pratt classroom had 1 CCSM with 12 children and the Terance classroom had 2 CCSMs with 16 children on 10/18/2022. Both classrooms were within the required ratio. On 11/20/2022, Ms. Lucksted emailed me additional documentation and detailed that the classrooms were not out of ratio on 10/18 but confirmed that they were out of ratio on 10/28/2022. On 10/28/2022, the Terance classroom was out of ratio from 8:13-9:30 AM; there was 1 CCSM with 16 children. The required ratio was 1 CCSM to 10 children. The Pratt classroom was out of ratio from 8:27-9:30 AM; there was 1 CCSM with 16 children. The required ratio is 1 CCSM to 12 children. On 11/15/2022, a second complaint was received alleging that on that day the Pratt Room was out of ratio all day and the infant and toddler classrooms are operating out of ratio almost every day in the morning. The complaint also alleged that the director was telling the corporate office that the cook was counted in ratio, but she was in the kitchen the whole time. It also said that the director is still enrolling more children despite already being short staffed. On 12/02/2022, I completed an unannounced on-site inspection. I spoke with CCSM 1 who was in charge as Ms. Lucksted was not working that day. CCSM 1 provided me with documentation of the classroom rosters and name to face sheets. I walked through the center to verify staff to child ratio compliance. No classrooms were out of ratio at the time of the inspection. CCSM 1 reported that in the morning, they notif
