    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 10/12/2022, I completed an on-site inspection. I interviewed program director Kelly Babinski and CCSM 1, CCSM 2, and Child A's Mother. Ms. Babinski stated that staff failed to contact Child A's Mother as required by center policy. She reviewed the center's policy regarding parent contact when a child is injured with staff. Ms. Babinski provided me with the center's incident reporting policy. The policy dated 05/2022 states that child incident reports are made through the Origami app directly by staff as soon as possible after the injury occurs. Incidents reports are then provided automatically by email to the parent identified in the Bright Star app. The parent is asked to acknowledge receipt of the incident report. Additionally, staff are responsible for completing the incident report whenever a child is injured, to exercise judgement to determine if the parent should be called, and to notify "leadership" of the incident. The policy states that immediate "leadership" notification is required when an injury requires medical attention. The policy states that staff will determine if a call is appropriate and who should place the call. If a call is appropriate, the incident report will be completed after the call. If a call is not appropriate, the incident report will be submitted immediately, and "leadership" notified when possible before pick up. Ms. Babinski also provided me with Child A's attendance record for 10/04/2022. A departure time of 5:39pm was documented for Child A. CCSM 1 stated that she observed Child A trip on her own feet on 10/04/2022. Child A cried for approximately 30 seconds. She helped Child A up from the floor. Child A then went off to have lunch. Child A fell in the classroom after playing in the gym. CCSM 1 stated that she would have checked Child A over had she observed any obvious signs of injury. Additionally, she would have notified the lead caregiver had she had concerns of an injury. She knows to contact the child's parent, write an incident report, and to contact Ms. Babinski in the event of an injury. CCSM 2 stated that she has seen Child A limp before just to be silly. On 10/04/2022, she and CCSM 4 facilitated circle time, story time, snack, free play, diapering and toileting, outdoor play, gym time, and lunch. She believes Child A tripped and fell when she was washing her hands, but she is not positive. Child A was upset with her at lunch because she did not give her ketchup on the side. Child A and the rest 3 of the children laid down for rest time after lunch. CCSM 4 carried Child A to her for a diaper change after rest time. She did not see Child A walk on her own after rest time. She completed her shift after changing diapers. She stated that Child A would have definitely asked for an ice pack had she been in any pain. She would have talked to Child A had she thought she injured. She knows to speak to admin if a child is injured to determine if a call to the child's parent is warranted. She would have provided Child A ice if there was an indication of an injury. She would have talked to other staff to determine if they observed anything that could have resulted in an injury. Child A's Mother stated that she was initially told nothing about Child A's injury. She saw Child A limping at pick up time at approximately 5pm. She asked CCSM 3 why Child A was limping. CCSM 3 told her that Child A was limping when she reported to the classroom at 3pm. CCSM 3 told her that CCSM 2 stated that Child A was fine before she went on her lunch break but saw her limping after rest time. CCSM 2 also told CCSM 3 that she thought perhaps Child A slept on her leg or foot wrong. Child A's Mother stated that she took Child A's shoe and sock off and immediately noticed bruising and swelling on her ankle. Child A indicated that her ankle hurt but was unable to communicate where the injury occurred. Child A answered "yes" when Child A's Mother asked her if she hurt herself inside. Child A also answered "yes" when C

    On 10/12/2022, Child A's Mother stated that she has heard CCSM 2 make inappropriate statements to the children. It was reported to her that CCSM 2 threatens to take away the children's stuffed animals and/or blankets at rest time. It was also reported to her that CCSM 2 has told children that they are the reason she is going to lose her job. Child A's Mother stated she expressed concern 5 to program director Kelly Babinski regarding these allegations against CCSM 2. She stated that Ms. Babinski agreed to her request that CCSM 2 not be alone with Child A. She described Child A as a child who is very good about going where she needs to go, but Child A is hesitant to be dropped off to CCSM 2's classroom. In fact, Child A refused to be dropped off on one occasion when CCSM 2 was the only staff member present. On 05/03/2023, I interviewed CCSM 4 by telephone. She stated that CCSM 2 initially stated inappropriate things to the children and parents when she was new, but it has gotten better over time. The only thing she could specifically remember is CCSM 2 telling a parent that their child must lay down and rest at rest time. CCSM 4 followed up with the parent to inform them that children who do not nap are not forced to lay down and rest for the duration of rest time. She does not feel that it is her job to correct a coworker, so she has directed her concerns with CCSM 2 to Ms. Babinski. She denied ever hearing CCSM 2 being mean or yelling at the children. She stated that CCSM 2 makes off-handed comments in front of the children that she understands but the children do not. She could not think of an example of this. She believes that CCSM 2 is a good team member in general. She has never heard CCSM 2 threaten to take away the children's stuffed animals or blankets. She has never heard CCSM 2 tell any child that they are the reason she is going to lose her job. On 05/03/2023, I interviewed CCSM 3 by telephone. She stated that she has no knowledge of CCSM 2 talking to the children in an inappropriate manner. On 05/03/2023, I interviewed program director Kelly Babinski by telephone. She stated that the allegation is a surprise to her. She denied having any knowledge of CCSM 2 threatening to take the children's stuffed animals and blankets away at rest time. She also denied having any knowledge of CCSM 2 telling children that they are going to be the reason she loses her job. She denied have any knowledge of staff or parents reporting any concerns about CCSM 2. She denied having a conversation with any parent regarding CCSM 2 not being left alone with their child. She stated that she has no concerns regarding CCSM 2's interactions with the children. On 05/03/2023, I interviewed CCSM 1 and CCSM 2 by telephone. CCSM 1 stated that she has no knowledge of CCSM 2 saying inappropriate things to the children. She has never heard CCSM 2 threaten to take the children's stuffed animals or blankets. She has never heard CCSM 2 tell the children that they are the reason she is going to lose her job. CCSM 1 stated that she has no concerns with the way CCSM 2 interacts with the children. CCSM 2 stated that the allegation is absurd. She adamantly denied threatening to take any child's blanket or stuffed animal away from them. She stated that it would be against child care licensing rules for anyone to take a child's blanket from them. She adamantly denied telling any child that they would be the reason she loses her A job. She stated that she has vented to her coworkers that a particular child may be the reason she quits her job, but she has never stated that in front of a child.
