    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 02/11/2022 Rebecca Patterson, program director and designee, sent an incident report that on 02/09/2022 Child A, female age 3, pulled a podium over onto herself. It fell hitting her in the head and the mouth causing serious injury. Child A received medical treatment at the emergency room and the dentist. On 02/14/2022 I conducted an unannounced on-site inspection to the child care facility. I met face to face with Rebecca Patterson. Child A and Mary Ann Siegel, child care staff member (CCSM), went into the hallway outside of her classroom to gather her items to go home. While in the hallway Child A hung onto the podium pulling it over on herself. The podium struck her in the head and the smaller second shelf on the podium hit her in the mouth. She was taken to the emergency room where she was diagnosed with a hematoma and the next day, she went to the dentist due to the injury to her mouth. Ms. Siegel was not present during the on-site inspection. I asked Ms. Patterson to show me the podium, it was outside the classroom and is top heavy, easily able to fall over on a child. It had not been removed from the hallway, I requested it be moved immediately. On 02/14/2022 I spoke with Child A's Mother by telephone. She was displeased Child A was seriously injured while in care. She was also concerned the podium remains in the hallway. She said she was called approximately 20 minutes after the injury as she was told they could not locate her child information card as the classroom was locked. She received a phone call shortly before she arrived at the center. She transported Child A to the emergency room where she was diagnosed with a hematoma and followed up the next day with the dentist. Child A's teeth were injured, and the long-term impact is unknown at this time. In addition to the injury Child A sustained while in care she was concerned with the length of time it took to be notified about it. She said she was told by the staff present when she arrived to pick up Child A that they were unable to locate her contact information because Child A's classroom was locked, and they had no way to access her contact information. Child A's Mother was concerned as they had to find someone else to locate her contact information delaying notification of Child A's injury. On 03/01/2022 I spoke with Mary Ann Siegel by telephone. She said she took Child A into the hallway to gather her things to prepare to be picked up. Their routine at the end of the day is to wait for her mother in the library as she is the last child to be picked up. While in the hallway she turned her back and Child A pulled the podium down on herself. She saw she was hurt and picked her up and sought assistance to help her as she was seriously hurt. Ms. Siegel explained once she found another CCSM, unknown name, she and the CCSM did not have access to the child information cards for Child A's class. She stated it took over 10 minutes to find a 3 person who could locate the contact information for Child A's Mother and contact her about the injury. Child A was picked up and transported to the emergency room. On 03/04/2022 I completed an exit conference with Rebecca Patterson. I asked if the podium was still in the hallway, and she said it was there. I asked it be removed immediately and she send verification of it. As of the writing of this report she has not provided verification the podium has been moved and made inaccessible to children in care. I also provided technical assistance on the rule requirement for the need for all staff to have access to every child's contact information while the center is open and operating.

    R 400.8143 · R 400.8143 Children's Records (1) At the time of a child's initial attendance, a center shall obtain a child information card, using a form provided by the department or a comparable substitute, that is completed and signed by the child's parent. The center shall keep it on file and accessible in the center.

    On 2/11/2022 Rebecca Patterson, program director and designee, submitted an incident report. It stated that on 02/10/2022 Child B, male age 3, was exposed to a food allergen at snack time. This caused an allergic reaction requiring his epi-pen to be administered, an ambulance was called, and he was transported to the emergency room. On 02/14/2022 I conducted an unannounced on-site inspection to the facility. I met with Rebecca Patterson, program director, regarding this incident. Ms. Patterson said Child B, male age 3, has a documented milk and peanut allergy. I saw his medical plan and postings in the classroom notifying staff of his approved snacks and allergies. On 02/10/2022 Child B was eating snack with his class. He was eating at the same table as those without food allergies and grabbed popcorn another student was eating. When the CCSM saw this, she took it from him and he seemed to be fine. Approximately an hour later he began to show signs of a reaction. He was brought to the office and his epi-pen was administered and 911 was called along with his mother. He was transported to the emergency room from the child care center due to the exposure to the food allergen and the epi-pen being administered to him. I then met with Linda Ostoin, lead caregiver, in the Toddler 2 classroom with Rebecca Patterson. She explained to me that on 02/10/2022 Child B sat down to snack at the same table as his classmates. She and the other CCSM's in the room are aware of his food allergies. Child B has his own snacks and while snack was being passed out Child B was seen sharing popcorn back and forth with another student. The popcorn has his known allergens. The popcorn was taken from him and he seemed to be fine. Approximately and hour later Ms. Ostoin noticed him reacting to being exposed to the allergen and she and staff took the proper steps in responding. She noticed his "face and eyes looked poofy" and he was itchy and swelling she administered his epi-pen. She then contacted Child B's Mother and asked about giving him Benadryl, she agreed, so she administered it to him. She did not record the date, time, amount, or her signature when she provided this medication. ANALYSIS: Linda Ostoin, child care staff member, administered medication to Child B and did not document the date, time, amount of medication, and signature. Rebecca Patterson, program director, did not ensure the compliance with this rule. CONCLUSION: I VIOLATION ESTABLISHED IV RECOMMENDATION Upon the receipt of an acceptable written plan of correction I recommend the status of the license remains unchanged. 03/08/2022 Dawnita M.
