    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On March 29, 2023, I completed an unannounced onsite inspection at the facility and Spoke to Program Director, Stacy Idema and Child Care Staff Member 1 (CCSM 1), Child Care Staff Member 2 (CCSM 2), and Child Care Staff Member 3 (CCSM 3). Ms. Idema stated Child A is assigned in the Frog room which is the center's toddler classroom. Due to staff shortages this classroom has not been operating. The toddler classroom has been closed for roughly one month. The facility has divided the children in the toddler classroom and moved one child down to the infant classroom and two children, including Child A, to the preschool classroom. Ms. Idema acknowledged the facility uses the Bright Wheel application for attendance and parent communication. She stated currently the children enrolled in the toddler classroom are still in the toddler classroom on the Bright Wheel App and they have not been moved to the other classrooms. 2 I spoke to CCSM 1 who works as an assistant in the preschool classroom. CCSM 1 stated she goes into the restroom with children and assists them if needed. She stated Child A is self-sufficient in the restroom but does have accidents on occasions and she will help him if needed. CCSM 1 could not recall if Child A was alone in the restroom on March 23, 2023, but stated he could have been because this is common practice in the preschool classroom. She identified that the restroom door is always left open so staff can see in the restroom while children are in there. I spoke to CCSM 2 who works as an assistant in the preschool classroom. CCSM 2 stated he was in the classroom on March 23, 2023 during pick up while Child A was in the restroom alone. He stated he had a direct line of sight of Child A. He identified that Child A had multiple accidents on this day so he may have been wearing the center's back up clothing if his clothing was soiled. I spoke to CCSM 3 who works as the lead in the preschool classroom and is newer to this role. CCSM 3 stated the door to the restroom is always left open so staff can see while children are in the restroom. She identified there are two bathroom stalls within the preschool restroom. She did not observe Child A alone in the restroom on this day. I observed the preschool classroom. This classroom has its own attached restroom within the classroom. This restroom has two stalls with two toilets with a handwashing sink in the classroom. The door leading into the restroom is always left open. There is a direct line of sight into the restroom from the classroom. On March 30, 2023 I spoke to Child A's Mother by phone. She stated on March 23, 2023 when she arrived to pick up Child A she found him in the restroom alone on the floor struggling to get his shoes on by himself. She identified CCSM's were in the classroom, but no one was in the restroom with Child A. She also stated he was dressed in clothing that didn't belong to him. .................... .................................. ...............................................

    On March 29, 2023, I completed an unannounced onsite inspection at the facility and Spoke to Program Director, Stacy Idema and CCSM 1, CCSM 2, and CCSM 3. Ms. Idema stated typically children between the ages of four- and five-year-olds use the restroom independently but most of the other children including Child A need assistance in the restroom. She identified that staff do not document toilet training on the Bright Wheel app for the preschool classroom but will document if a child has an accident. I spoke to CCSM 1. She stated that she typically goes into the restroom with child care children and assists if needed. She identified that Child A is self-sufficient in the restroom, but she will still help him if needed. He does still occasionally have accidents. She recalled on March 23, 2023, Child A having three accidents where he urinated through his clothing. She stated he didn't have enough extra clothing, so he was put in the center's extra clothing. She believed Child A was newly potty trained while in the toddler classroom. CCSM 1 explained that Child A is still technically placed in the toddler classroom on the Bright Wheel app and as a staff member in the preschool classroom she does not have access to view, change, or document things for Child A. She stated that some of the other preschool staff do have access to the toddler classroom children so she will ask other staff members to log notes on Child A's profile if needed. She is unsure if this was completed on this day because she cannot view Child A's profile. She was not aware of Child A having a bowel movement accident on this day. I spoke to CCSM 2. He recalled on March 23, 2023, that Child A had multiple accidents. CCSM 2 identified Child A is from the toddler classroom and he has not worked closely with Child A and does not know all his bathroom needs. He believed Child A used the restroom independently and denied helping Child A while he was using the restroom. He stated Child A never asked him for help, so he assumed Child A was fine while in the restroom. He stated Child A is still in the toddler room on the Bright Wheel app and he has access to Child A's profile if needed but Child A doesn't come up on the preschool class list even through he's currently in that classroom. I spoke to CCSM 3. She stated she was not aware that Child A had multiple accidents on March 23, 2023. She is still learning who is potty trained and who needs assistance in the restroom. CCSM 3 was not aware if Child A was self- sufficient while using the restroom and denied helping him in the restroom. CCSM 3 denied having access to the toddler classroom on the Bright Wheel app and did not have the ability to update any of Child A's information because he is still currently listed in the toddler classroom. CCSM 3 was not aware of Child A having a bowel movement accident prior to being picked up on March 23, 2023. 4 I spoke to Child A's Mother by phone on March 30, 2023. She stated her son does not use the restroom independently. He still requires help cleaning himself after a bowel movement. She identified her son had multiple accidents on March 23, 2023 but not all of them were documented on the Bright Wheel app for her to view. She stated Child A is supposed to wear pull ups at nap time but didn't realize the center didn't have any pullups left until after she disenrolled her child and there were no pullups when she picked up his belongings. She denied the center ever asking her to bring in more pullups when they ran out. Child A's Mother did not have an opportunity to speak to staff about Child A's restroom needs due to staff constantly changing. She stated when she got home on March 23, 2023 she observed dried fecal matter on Child A's underwear, bottom, and on his back. This resulted in a rash.

    On September 1, 2020, the center director Stacy Idema contacted me to report that the center had received information from the church that Child A's Relative had contacted them to report that Child A (male, 5 years old) had said that children at the center were having inappropriate contact with each other. A written incident report was received. The email from Child A's Relative was forwarded to me. The email lists the names of six other children that Child A alleged was involved in inappropriate contact during nap time. The email said that Child A was told to keep it a secret and that they are playing that they are in love, putting tongues in each other's mouths, and Child A was shown a girl's underwear and asked if he wanted to kiss it. On September 3, 2020, I completed an on-site inspection to initiate the investigation. I interviewed Ms. Idema about the allegations. Ms. Idema explained that August 14, 2020, Child Care Staff Member (CCSM) Ainot Crees told her that she saw Child A crying when she came back from her break. Child A told Ms. Crees that he and another child had showed each other their underwear. School age children then teased the two children about being boyfriend and girlfriend and Child A was very upset about the teasing. Ms. Idema reported that Ms. Crees contacted Child A's Mother via text to inform her about it. Ms. Idema did not talk to Child A's Mother or Child A's Father about it. Ms. Idema received an email from Child A's Mother reporting that Child A would not be returning to the center after their vacation. Ms. Idema indicated she spoke with the preschool children about privacy and body safety. She spoke with Child C's Mother who reported that Child C (female, 5 years old) thinks that underwear is funny. School age children teased Child A and Child C about being boyfriend and girlfriend. Ms. Idema stated she also spoke with the school age children about teasing and bullying. Ms. Idema explained that preschool and school age children do use the playground at the same time. Ms. Idema explained she does not think that inappropriate contact happened during nap time and explained that one of the names of children who were allegedly involved is not a name of any children that have attended the center. The other children named are preschool children. Ms. Idema explained that school age children are not in the preschool room during nap time except Child A's sister Child C (female, 8 years old). CCSMs Michelle Matthews, Karen Reyes, Hannah Foster, 3 Monique Jeffries and Amber Rodas were out on the playground when the incident between Child A and Child C occurred. I interviewed CCSM Ainot Crees who works in the preschool classroom. Ms. Crees explained that on August 13, 2020, she had joined the preschool classroom outside after she took a break. She saw Child A was upset and while comforting him, he told her that he and Child C had showed each other their underwear. Child A told Ms. Crees that his mom and sister would be upset with him. Ms. Crees thought that maybe he was concerned about getting in trouble and that is why he was upset. Ms. Crees sent a text message to Child A's Mother and explained what happened. Child A's Mother responded, Ms. Crees told Child A about the reply, which helped Child A feel better. Ms. Crees said that no staff members saw the incident between Child A and Child C. Ms. Crees explained that toddler, preschool and school age children were all outside together when the incident occurred. The following day, Child A's Mother sent Ms. Crees a text message informing her that Child C asked Child A to kiss her underwear. Ms. Crees stated that Child C has shown her underwear to children before when she was wearing a dress, so they asked her to put shorts on under her dress. Ms. Crees said that she forwarded the text messages to Ms. Idema. Ms. Idema spoke with Child's C's Mother. Ms. Crees said that Child A is a sensitive child and she thought it was an innocent preschool matter that is being
