722.115n(3) Application for or renewal of license to operate child care center, group child care home, or family child care home; household member or child care staff member; criminal history check; requirements; duties of department. Each individual listed in subsection (1) shall give written consent at the time of the license application and before a group child care home or family child care home allows an individual to be a member of the household, or before becoming a child care staff member to allow the department of state police to conduct the criminal history check required under subsection (1). The department shall require the individual to submit his or her fingerprints to the department of state police and the Federal Bureau of Investigation for the criminal history check as required in subsection (1).

A licensee shall ensure that barriers exist to prevent children from gaining access to any swimming pool, drainage ditch, well, natural or constructed pond, or other body of open water located on or adjacent to the property where the child care home is located. These barriers must be a minimum of 4 feet in height and appropriately secured to prevent children from gaining access to such areas.

The gate from the back porch to the pool area was latched, but there was no lock.

A home shall have at least 1 functioning multipurpose fire extinguisher, with a rating of 2A'(10)BC or larger, properly mounted not higher than 5 feet from the floor to the top of the fire extinguisher, on each floor level approved for child use.

At the time of inspection, there was no fire extinguisher on the main level. The fire extinguisher on the lower level was not mounted.

At the time of inspection, there were no written procedures in the event of fire, tornado, serious accident or injury, or water emergencies, and there was no crisis management plan.

On August 24 2020 the allegations received stated that Ms. Molter allows MHM2 to watch in the home. It was unknown if child care children are around when this is occurring. On August 26, 2020 and I spoke to Ms. Molter during an unannounced onsite inspection. She has identified MHM2 is not allowed to watch . She stated in the past she has caught MHM2 watching on phone. She stated she checks■ phone sporadically at least once a month to ensure is only viewing appropriate content. Ms. Molter stated that MHM2 is o 0 typically in room and has very little interaction with child care children. She denied the viewing of was ever done in front of child care children. We spoke to MHM2 in the front yard of the home. stated sometimes plays with the child care children but typically keeps to s ated■ watches YouTube on■ phone and denied ever watching anything inappropriate.
