    R 400.1908 · R 400.1908 Capacity. (1) The licensee shall ensure that the actual number of unrelated children in care at any 1 time does not exceed the number of children for which the child care home is licensed, not more than 6 children for a family child care home and not more than 12 children for a group child care home.

    I conducted on unannounced on-site inspection on 08/03/2022 at approximately 12:53 PM. Licensee, Heather Ampey, explained that she provides sunscreen for the children in care. Ms. Ampey showed me the sunscreen that she uses the children in care, which is SPF 50. Ms. Ampey stated she does have written permission from all the parents to put sunscreen on the children in care. On 07/19/2022 Ms. Ampey applied the sunscreen to Child A along with the other children in care. She acknowledged that because it was a nice day, she had the children outside for a few hours. Child A did not appear to be sunburned when he came into the house up until he was picked up from the child care home. Ms. Ampey stated that a few hours after Child A was picked up from the child care home, Child A's Mother called her and told her that Child A had a sunburn. Ms. Ampey stated that Child A's Mother sent her a picture of Child A and Child A did have a severe sunburn. Ms. Ampey stated she did not know why Child A was sunburned as none of the other children in care got sunburned. During the on-site inspection, I observed Child A's child information card and sunscreen permission. There was no concern noted for Child A on his child information card that he had any issues with a sun allergy or that he should not be in the sun for long periods of time. The sunscreen permission slip also did not specify what kind of sunscreen that Child A should be using. There were no other concerns noted on either the child information card or the sunscreen permission slip. I attempted to call Child A's Mother on 08/24/2022, 09/21/2022 and 09/22/2022. I left telephone messages but have not heard from her to date. I interviewed Child B's Mother, Child D's and Child E's Mother, Child F's Mother and Child G's Mother on 09/21/2022. No one had any concerns regarding any of their children experiencing sunburn while in care. Child B's Mother stated that Child B has fair skin and gets sunburned very easily, but he has never gotten a sunburn while in care. On that same day, I attempted to contact Child C's Mother and Child H's Mother. I left telephone messages but have not heard from them to date. 4

    There is no evidence that Licensee, Heather Ampey, did not apply nonprescription sunscreen on Child A inappropriately, resulting in sunburn. Ms. Ampey had a written permission slip from Child A's Mother that did not specify what brand of sunscreen needed to be used. There was also nothing noted on Child A's child information card stating that he had any issue with sun exposure.
