R 400.1903 · R 400.1903 j Licensee responsibilities. (8) To comply with section 3c of the act, MCL 722.113c, a licensee shall have a policy and procedure on smoking and vaping that includes all of the following: (a) Ensure that smoking and vaping do not occur in child-use space, on the premises of a child care home while children are in care, and in a vehicle when used to transport children who are in care.

On 09/28/2022 I completed an onsite inspection and interviewed the licensee, Melanie Whitman, regarding the allegations. Mrs. Whitman was visibly upset stating that her husband has given up so much for the child care program. She denied that he smokes around the child care home or in the child care home. She could not recall a time when he was standing with a group of men on the property smoking cigarettes. They do have 12 acres of land and she wouldn't know if someone was smoking way in the back of the property as she is caring for children. They do have a pile of wood outside but it is located out by the road. The children are only there when she is walking them to the bus. Mrs. Whitman indicated they recently spent a lot of time cleaning up the lawn due to insurance requirements. The insurance company actually came out and inspected the property and requested some changes which they complied with. Mrs. Whitman was able to show a no smoking or vaping sign posted in the child care home. I walked around the child care home outside and by the fenced-in outdoor play area behind the home and saw no evidence of smoking. The outdoor area was clean and organized. I did not observe any object or lawn equipment that would cause harm to children as they were entering or leaving the child care home. 2 observed the wood pile at the end of the long driveway. I called Child A's mother and Child B's mother. As of the date of this report I have not received a return call.

Melanie Whitman, licensee, ensures the structure, premises and furnishings of the child care home are in good repair and maintained in a clean, safe and comfortable condition. Mrs. Whitman admitted recently cleaning the outdoor area for insurance purposes. I observed the outdoor area to be clean and oraanized.
