On November 4, 2022, I conducted a telephone interview with Child A's Mother. She said she had some concerns regarding Child A's care at Champions. She picked Child A up from child care on November 2, 2022, at 5:35pm. During pick up, Lisa Ryan and Sabrina Duffer told her that Child A was crying for approximately 15 minutes prior to pick up. Child A walked up to her and said, "my peepee hurt" referring to her vagina. She asked, Ms. Duffer what happened? Ms. Duffer said, Child A fell and hurt her butt. When she got home, she disrobed Child A, and her pants and panties were stained with blood as if she were on her menstrual. She immediately took child A to the hospital for an examination. While in transit to the hospital she called the program director Melissa King and informed her of the situation. After the examination was completed, the doctor told her Child A had a torn labia and that the injury likely came from child A straddling something. Child A's Mother said the entire incident is very suspicious. Staff did not disclose the injury upon pick up and could not say how Child A sustained the injury. She was told it happened on the red fire truck, the play bar, and the red firehouse. None of which were confirmed. She was not given an incident report, which is the center's policy for staff to do so. She feels like Child A was neglected and the matter was mishandled. On November 4, 2022, I conducted an unannounced onsite inspection at the facility, and I interviewed child care staff member (CCSM) Holly Ibanez. She said she has been employed at Champions for a year. She denied having any information regarding the incident involving Child A. She said Champion's policy on incidents and injuries are to contact the parents and write an incident report. Parents are usually called immediately after an incident or contacted on the communication app. Every situation is different and depends on the severity of the injury. Parents are always given a copy of the incident report. CCSM, Lisa Ryan was interviewed during the onsite visit as well. Lisa said Child A was not in her class and she was not caring for her at the time of the incident. Lisa said she was outside with two other children from her class during the same time Child A and Sabrina Duffer were outside. She heard Child A yell, and she went by her to see what happened. She asked, what happened, and Child A said she fell and hurt her butt. Ms. Duffer was there and said she was tending to Child A, so she walked away. During pick up, Child A told her mother her "peepee" hurt. Ms. Duffer did not say anything, so she told Child A's Mother that child A fell. Child A's Mother told Ms. Duffer to write an incident report and left. She did not notice any blood stains on Child A's pants and Child A was behaving normal after her fall. She said staff would usually take a child indoors to conduct a brief visual inspection for any injuries if they complained of being hurt, especially in genitalia areas. If a child is hurt, staff would write an incident report whether they had a mark or not. If a child breaks skin or appears severely hurt, staff would call the child's parents. On November 4, 2022, I conducted a telephone interview with director Melissa King. Ms. King said she did not witness the incident, but Sabrina Duffer told her Child A was playing outside and fell while playing on the circular bars. During that time, 4 CCSM, Sabrina Duffer was watching Child A and staff Lisa Ryan was outside with two other children. Ms. Ryan patted Child A's legs after the fall and asked her if she was okay, Child A said, yes. At approximately 5:30pm Child A's Mother picked Child A up from the center and left. Twenty minutes after Child A was picked up, she received a call from Child A's Mother who told her she had taken Child A to the hospital for an injury she sustained at the center. Child A's Mother later told her that Child A's examination revealed the injury was caused by straddling something. Ms. King

On 08/08/2022, I completed an unannounced onsite inspection at KCE Champions LLC at Lathers ECE. I interviewed licensee designee and program director Melissa Clark-King, CCSMs Denise Swisher, Angie Sweet-Painter, Danielle Decker, and Ashley Cassatt. Licensee designee and program director Melissa Clark-King stated that Denise has been working in child care for over 20 years. Denise is respected by her peers but may not be liked. Melissa believes this is due to "Denise not allowing any rift raft and being direct". Denise has never had any disciplinary actions or complaints brought against her. Denise acts as a staff trainer at the center because she is such a good staff member. Denise is one of the only staff members who had not had her hours reduced due to her ability to act in an administrative role when needed. Melissa said, "Denise's personality has a tone to it". Lathers has combined staff with Stevenson for the summer. Since combining staff, Melissa has received complaints about Denise being difficult to work with. Emily Dunn, a Stevenson child care staff member, came to her on 08/08/2022 stating that she did not like working with Denise. During the onsite visit, Emily Dunn was offsite purchasing items for an event at the center. Melissa sent Emily to purchase the items because she appeared down and out, and she wanted to see how she could split Denise and Emily up. CCSM, Denise Swisher, stated that she has been working with children for over 30 years. Currently, she is the lead teacher in the toddler room. She has never yelled at a child or been nasty or rude to a child. She believes that she has a great relationship with children and their parents and maintains relationships with families' years after they age out of her room or the program. Since combining with Stevenson staff she feels that there has been a clash between what their staff feels that they should do in the classroom and what she normally does in the classroom daily. Has never had any complaints from her peers or parents. CCSM, Angie Sweet-Painter, has been working in the toddler room since 2019 and has worked with Denise the entire time. Denise does not yell at children. Denise is stern and strict, but not mean. The toddler room has primary caregivers and Denise assigns herself the easier children to handle. Angie is assigned to the more needy children. Denise is never rude or nasty to the toddlers. No other staff members are rude or nasty or yell at the children. Everyone is very hands on and has patience with the children. CCSM, Danielle Decker, is a Stevenson staff member and has been working with Denise for about two and half months. Denise does yell at children, in particular the children from the Stevenson center. Denise raises her voice if she gets 3 overwhelmed with a child or if they are not doing what they want them to do. The room has a few toddlers who are displaying autistic traits, and those children seem to be the kids with the most issues. She has heard Denise make negative comments about a child's weight or their looks. She has seen Denise mock a child while they were crying. Danielle believes that Denise thinks she is doing this in a joking manner but feels that is inappropriate. None of the other staff are rude or nasty to the children. She feels that the staff in the room all feel the same way about Denise. No one has said anything directly to Denise. She knows that Emily went to the program director to complain about how uncomfortable the staff was with Denise's behavior. She feels that the staff does not vocalize their issues with Denise because she has been working at the center for so long and has the most tenure at her level. Danielle has never seen Denise physically harm a child. CCSM, Ashley Cassatt, has been working in the toddler room since 2019 and has worked with Denise the entire time. She has never heard Denise yell at a child, never heard her mock or shame a child. Has never seen her be rude or nasty to any children. Deni

On 07/26/2022, I completed an unannounced inspection at KCE Champions LLC at Lathers ECE. I interviewed licensee designee and program director Melissa Clark-King and CCSMs Autymn Lazenby. CCSM Autymn Lazenby came over to Lathers center in June 2022. Ms. Lazenby is on staff with the Stevenson Champions center. Their center is closed for the summer due to construction and they have merged their staff and children with Lathers. Ms. Lazenby has moved around to various rooms in the center. Ms. Lazneby has worked in a room with Ms. Cameron, and she saw her pick Child D (6- month-old, female) up by the feet and hang her upside down. Ms. Cameron was sitting on the floor playing the infant when this occurred. Ms. Lazenby knew that Ms. Cameron was playing with Child D, and Child D was not in any distress. Child D was laughing with the staff member. Ms. Lazenby does not feel that Ms. Cameron was doing it to hurt the child. Ms. Lazenby did not say anything to Ms. Cameron about the incident; no other CCSMs were in the room when this occurred. Ms. Lazenby was not comfortable with the way Ms. Cameron was playing with Child D and told the licensee designee and program director Ms. Clark-King the next day. Ms. Clark-King asked Ms. Lazenby if she would like her to address the incident with all the staff or just Ms. Cameron. Ms. Lazenby felt Ms. Clark-King asked her this to avoid her being singled out. Ms. Clark-King did address it through the staff wide weekly email blast. The email discussed the proper way to hold children. Ms. Lazenby does not know if Ms. Clark-King spoke directly to Ms. Cameron about the incident. Ms. Lazenby has not seen Ms. Cameron do it anymore or with any other children. Licensee designee and program director, Melissa Clark-King states that she was not informed that infants were being held up by their feet. Ms. Clark-King herself has seen her staff as a whole handling children in a way that was not the best choice. Ms. Clark-King did not see her staff handling children in a way that was wrong or inappropriate but, more so in a way in which the children could end up hurt or if someone passing by saw it could misinterpret it. Examples that she provided were, staff swinging children around for fun or tickling children. Ms. Clark-King felt that even if they were having fun and playing, she wanted to reduce all risk for someone being hurt. CCSM Autymn Lazenby informed Ms. Clark-King that another CCSM Heather Cameron was handling a child inappropriately. When Ms. Clark-King questioned Ms. Lazenby further, Ms. Lazenby said, "well she is kind of swinging her and playing with her feet." Ms. Lazenby informed her that Ms. Cameron was not doing it in a malicious way; the child was not crying, and she was not being mean to the child. Ms. Lazenby told Ms. Clark-King that Ms. Cameron was playing with the child, and Ms. Cameron and the child thought it was fun. Ms. Clark-King states that Child D has great body control and can sit up independently. Ms. Clark-King did not feel that Child D was in immediate danger or lacked the body control to sustain play. Ms. Clark-King did talk to Ms. Cameron about ensuring that she is handling the children with care and being careful. Ms. Clark-King did not directly address Ms. 3 Cameron about the allegations of inappropriate handling of Child D because Ms. Lazenby did not want Ms. Cameron to think she was telling on her. Ms. Clark-King also addressed the entire staff through a staff wide email and went class to class and told staff that they needed to ensure that they are handling children with care and even if they are having fun to be mindful of the risk of harm. On 07/29/2022, I completed a telephone interview with Child D's Mother. Child D's Mother has not had any concerns about care or supervision while Child D has been enrolled. Child D has only been attending for about a month. She has not had any incidents. Ms. Clark-King did inform her of this allegation. Child D's Mother stated that Child D

On 07/26/2022, I completed an unannounced inspection at KCE Champions LLC at Lathers ECE. I interviewed licensee designee and program director Melissa Clark-King and CCSM Autymn Lazenby. I also interviewed CCSM and Child A's (15-month-old, male) and Child B's (3-year-old, female) Mother, Brooke Taylor and CCSM, and Child C's (4-month-old, female), Mother Shelby Bodnovits. Licensee designee and program director Melissa Clark-King stated that on 07/12/2022 she received a phone call from a parent of a child who tested positive for Covid. The child's last day attending the center was 07/07/2022. A staff member called on 07/18/2022 and stated that she had Covid. The staff member was last at the center on 07/14/2022. No other children or staff members have had Covid. There was another child who was quarantined for five days because his mother tested positive. The child's mother informed Ms. Clark-King on 07/19/2022 that she had tested positive. The child never tested positive or showed symptoms. The child returned to the center after their five-day quarantine on 07/25/2022. Whenever anyone, staff or children, test positive for Covid the center sends a center wide email to all staff and children informing them that a child or staff member has tested positive. The center's first diagnosed case of hand foot and mouth was 07/15/2022 in the preschool room. All parents in the preschool classroom were notified with a letter that went home with the children in the room. Ms. Clark-King also had the letter placed on the classroom door. Three additional students were diagnosed with hand foot and mouth. As of 07/26/2022, some students are still out sick, and some had begun to come back. The classroom was cleaned and disinfected. When a student or staff member contracts a communicable disease all parents of children enrolled at the center are notified through a messenger app that the center uses to communicate with families. Additionally, the classroom which has the confirmed communicable disease had a note sent home with each child in that classroom and the note was posted outside the classroom as well. Ms. Clark-King only sent one message on the app, and one letter home to parents when the first case of hand foot and mouth was confirmed. The three other children were diagnosed within five to seven days; therefore, she did not send out additional notifications after each child was confirmed to have contracted hand foot and mouth. CCSM and Child C's Mother Shelby Bodnovits works in the preschool room. Ms. Sam, Ms. Tahnini, and Ms. Cece work in the room with her. Ms. Bodnovits was notified of the first case of hand foot and mouth two weeks ago by Ms. Clark-King. When Ms. Clark-King came and told her, staff took the kids for a walk and she began doing a deep cleaning of the classroom. Ms. Bodnovits posted a message on the center's messaging app letting families know that a child in her room had been diagnosed with hand foot and mouth. Ms. Bodnovits also placed a letter on the door 5 of her room notifying families. The second case of hand foot in mouth in her class came in while Ms. Clark-King was on vacation. Ms. Bodnovits asked Ms. Alison, the Stevenson staff program director, if she should post the new case of hand foot and mouth on the app. Ms. Alison informed her that licensee designee Hailey Fisher would send messages to parents. Ms. Bodnovits stated that the room has had three additional cases of hand foot and mouth since her initial post, and she did not send out any additional notifications. Ms. Bodnovits has never felt that she had to work while ill or could not take off when sick. When a child is ill, they are placed in the gross motor room, which is sometimes used as the isolation room with a staff member until they can be picked up. Ms. Bodnovits was only notified of one case of Covid in the infant room but is sure there is another case. Ms. Bodnovits is not sure if the center is notifying parents of multiple cases of an infectious dis

On 07/26/2022, I completed an unannounced inspection at KCE Champions LLC at Lathers ECE. I interviewed licensee designee and program director Melissa Clark-King and CCSMs Autymn Lazenby and Holly Ibanez. I also interviewed CCSM and Child A and Child B's Mother Brooke Taylor and CCSM and Child C's (4-month-old, female) Mother Shelby Bodnovits. Licensee designee and program director Ms. Clark-King, states that the center has two phone lines available in her office. One a landline phone line and a center cell phone. CCSMs Autuymn Lazenby, Holly Ibanez, Brooke Taylor, and Shelby Bodnovits all confirmed that there is an accessible phone line on site, and they have always been able to use a phone if needed. I observed a working landline phone in the center's office and every classroom that is onsite.

On 07/26/2022, I completed an unannounced inspection at KCE Champions LLC at Lathers ECE. I interviewed licensee designee and program director Melissa Clark-King and CCSMs Autymn Lazenby and Holly Ibanez. I also interviewed CCSM and Child A and Child B's Mother Brooke Taylor and CCSM and Child C's Mother, Shelby Bodnovits. Melissa Clark-King stated that Child A is still sleeping in the crib and is being transitioned to a cot. During the transition from crib to cot, staff has allowed him to have his blanket during rest time. Child A uses his blanket when in the crib or on the cot. Child A uses the blanket to self soothe. Child A is 15 months and does not fall under the requirements for safe sleep for infants. CCSM Holly Ibanez, is the lead teacher in Child A's room. Ms. Ibanez stated that Child A does use a blanket in the crib during rest time. Child A's Mother provided the blanket to Ms. Ibanez and often check in on him during rest time. Ms. Ibanez felt that the blanket was allowed because Child A is no longer considered an infant. Ms. Ibanez stated that the center is sharing their space with another center. The two centers have combined their staffs and the other center's staff members that are working in the room with her have reported concerns with Child A using a blanket in the crib. Ms. Ibanez informed the staff that Child A is not considered an infant and allowed to have a blanket while resting, either in his crib or on a cot. Child A started using the blanket when he turned 1 years old. Ms. Ibanez and staff check on resting children in their room every 15 minutes. CCSM Autymn Lazenby, works in the infant toddler room. Ms. Lazenby is a staff member from a different center that has combined with Lathers staff for the summer. Ms. Lazenbysaid Child A is in the infant toddler room and he sleeps with a blanket in the crib. Ms. Lazenby did feel this was a safe sleep concern but, was explained that blankets are allowed for children aged 1 year old and up. CCSM and Child A and Child B's Mother Brooke Taylor, was told that at 1 years old children could begin bringing and using blankets, so she brought Child A's blanket in. Ms. Taylor checks on Child A often while he is resting. Child A was going to be transitioned to a cot due to his size and age however, he got a double ear infection. Due to this, he began to use his blanket for comfort and remained in the crib. Ms. Taylor does not have any concerns about care, supervision, or safe sleep practices. CCSM and Child C's Mother Shelby Bodnovits stated that Child C is enrolled in the infant room. Ms. Bondovits and Child C's Mother stated that she does not have any concerns about safe sleep. Ms. Bodnovits and Child C's Mother also does not have any concerns about care or supervision. On 07/26/2022, I observed Child A resting in the crib. Child A did not have a blanket in the crib with him. I observed three other infants and toddlers resting in cribs, including Child C. None of the children had anything in the cribs with them. All cribs and resting infants and toddlers were resting within safe sleep guidelines. On 08/18/2022, I completed a telephone interview with CCSM Alison Lee. Ms. Lee stated that she has had staff raise concerns about safe sleep practices. Ms. Lee stated that both she and Ms. Clark-King referenced the departments rule book on safe sleep for clarification of their polices and informed staff that safe sleep was not being violated. On 08/03/2022, I completed an exit conference with licensee designee Hailee Fisher. Ms. Fisher believes that there have been issues amongst the two staffs due to their being a shortage of hours available to work. Enrollment decreased for the summer and now they have a surplus of staff with the merging. This has caused hours to be decreased for all staff members. Ms. Fisher and Ms. Clark-King had a meeting with staff to discuss all allegations and further clarify the centers policies and procedures and licensing rules that pertain to them. A
