On 2/14/23, I conducted an on-site inspection. I interviewed Michelle Gatza, program director, Alicia Reffert, administration assistant/child care staff member, and Marianna Shobbrock, child care staff member. Ms. Gatza stated that although she is here during the school age program Ms. Shobbrock oversees it and Ms. Reffert does all the staff scheduling and assists in the classroom if necessary. Ms. Gatza was very surprised that someone had complained about ratio. They always have more staff than licensing requires. They were just discussing how they must make sure and send child care staff home if they can because she doesn't want the school to complain about paying for too many staff. The after-school program is divided into groups until the number of children does not require separation. The preschool children remain in a group with only preschool children. The "juniors" is the younger school age children young fives through first grade. The "seniormediate" group, children second grade through fifth grade. The juniors come into the program a little earlier than the seniormediates. They meet in the cafeteria have a snack and then either go outside or into the gym. The seniormediates will enter the program about ten to fifteen minutes later and have a snack and then go outside or to the gym. The groups rotate to different areas. The preschool children have their own classroom. They may combine at the very end of the day when ratio allows. 2 Ms. Shobbrock is not scheduled into ratio when the staff schedule is made. She oversees the program and will go between the groups as needed. They always schedule at least one floater along with Ms. Shobbrock. If a child care staff member can't make it to work for some reason they will be covered for ratio. Ms. Reffert provided me with children and staff attendance for 2/09/23. There were 20 juniors that all arrived between 2:55 p.m. and 3:00 p.m. There were 18 seniormediates that arrived between 3:05 p.m. and 3:15 p.m. Two of the seniormediates left by 3:15 p.m. There were three child care staff that were with the school age children until 4:00 p.m. Two child care staff members left at 4:00 p.m. The junior group had 14 children and the seniormediates had 15 children. During this time Michelle Gatza, program director was assisting with the school age children along with the child care staff member. During my inspection I observed three child care staff members with the junior group that had 33 children in the cafeteria. Children were finishing up snack and some were in the hallway getting ready to go outside. When I walked through the hall of children getting ready to go outside, I did not see a child care staff member with the children. I asked Ms. Gatza about this and she pointed out the staff member. I did not see her amongst the children. The seniormediate group was already outside with two child care staff members. There were 23 children in this group. Ms. Gatza feels that some of the child care staff members blend in with the children and if you did not know who they were they may not stand out in the crowd of children. She was discussing different ways to let the parents know who the staff are and thought they would buy bright tee shirts for the staff to wear. She also thought she could do a staff introduction in their newsletter, so parents are familiar with the child care staff. I observed that the cafeteria is divided in half and during transition from snack to outside the juniors would be on the left and the seniormediate group would be on the right side of the cafeteria. There were 13 preschool children and two child care staff at the time of my inspection. They were not with the school age children and were in their own classroom.
On 2/9/23, there seemed like 50 children with two child care staff. There were many younger children present also.

On 08/16/2022, I completed an unannounced onsite inspection at Frankenmuth List Preschool and Eagle Express. I met with the licensee designee/program director Michelle Gatza and an interview was conducted. Ms. Gatza had not been informed by any child care staff members that Child A (female, age five) had been left unsupervised. She was aware that a child being lost or left unsupervised must be reported to the department within 24 hours and a written report must be submitted within 72 hours however she had not been informed of the incident. Ms. Gatza is just returning from vacation and was not at the center last week. I then met with child care staff member, Mariana Shobbrook and an interview was conducted. She was not aware of any child being left unsupervised or being left unattended. There is a child that tends to be a runner however the child has not been left unsupervised or left unattended. I then met with child care staff member, Haley Stroup and an interview was conducted. On 08/11/2022, she was leading the line for Room 3 (Juniors) and child care staff member, Hannah Hare was at the back on the line as they were going outside. Ms. Hare was supposed to be counting the children and must have miscounted. Another child care staff member, Denise Roeske brought Child A outside and reported to her and Ms. Hare that Child A was found inside Room 3 alone. Child A's guardian/grandmother was notified on the same date when Child A was picked up. Ms. Stroup was not aware that the center had to report this incident to the department within 24 hours or that a written report had to be submitted to the department within 72 hours. Ms. Stroup was reminded that as a best practice they should count children in the classroom, at the door and again when they get outside to ensure that no child is lost or left unsupervised. I then met with child care staff member, Hannah Hare and an interview was conducted. On 08/11/2022, she was doing head counts in the Room 3 (Juniors) while they were lining up to go outside. Child A must have left the line and went into the bathroom, and she was unaware of this, and Child A was left inside unsupervised. She and Ms. Stroup did not recount the children when they got outside. Within a minute of getting outside, Ms. Roeske came outside with Child A and reported she had been left in the classroom. Ms. Hare admitted that she did not see Child A get out of line and go into the bathroom and had not noticed her missing when they got outside. Ms. Hare was not aware that the center had to report this incident to the department within 24 hours or that a written report had to be submitted to the department within 72 hours. Ms. Hare has only been employed at the center since 08/02/2022. Ms. Hare was reminded that as a best practice they should count children in the classroom, at the door and again when they get outside to ensure that no child is lost or left unsupervised. I then met with child care staff member, Denise Roeske and an interview was conducted. On 08/11/2022, she was in the office across the hall from Room 3 (Juniors) and she heard someone starting to cry and went to see what was going on 3 and she observed Child A at the doorway and said, "where are my friends"? Ms. Roeske picked up Child A and provided her with comfort and emotional support. She then took Child A outside to Ms. Stroup and Ms. Hare who were both unaware that Child A had been left alone and unsupervised in Room 3. She had intended to inform Ms. Gatza the program director upon her return from vacation however forgot to. I then met with school superintendent Grant Hegenauer who escorted myself and the licensee designee/program director, Ms. Gatza to the office to view the video surveillance. I observed Room 3 at 11:37 am and the child care staff members did an actual head count when they lined up at the door and then again when they lined up at the door to go outside. However, at 12:53 pm when Room 3 lined up to go outside there was only one

On 08/09/2022, 1 conducted an unannounced onsite inspection along with licensing consultant, Takiyah Jackson at Frankenmuth List Preschool and Eagles Nest. I met with child care staff member Haley Stroup and an interview was conducted. On 07/27/2022 the center held a free car wash in the parking lot on the west side of the school building. This parking lot is not used as it is on the opposite side of the entrance to the school building and is considered the back parking lot. Children were not in the road or off the curb in the bicycle lane. All the children were on the sidewalk and were being directly supervised by child care staff members at all times. Most of the children were near the side of the building washing cars. There were only a few school age children who were allowed to stand with the school superintendent holding signs. However, there were several adults and only a few children and they were not in the road. I then met with lead caregiver Emily Taylor and an interview was conducted. The center did hold a car wash in the back parking lot on 07/27/2022. The children were not out in the road in the bicycle lane. The parking lot is at least 150 feet from the road. The children were always being directly supervised by child care staff members. The school principal and school superintendent were also assisting at the car wash. I then met with lead caregiver Denise Roeske and an interview was conducted. The center did hold a car wash in the back parking lot on 07/27/2022. Some of the older 2 school age children were standing on the sidewalk holding signs however they were not standing in the street or in the bicycle lane. The school superintendent, along with several child care staff members were also holding signs and directly supervising the school age children. There were never any children standing in the street or in the bicycle lane. I then went outside with licensing consultant Ms. Jackson and several child care staff members to observe where the car wash was held. The area where the car wash was held is at least 150 feet from the sidewalk. The sidewalk is at least 15 feet from the curb/road and at least 20 feet from the bicycle lane. I then met with school superintendent, Grant Hegenauer and an interview was conducted. On 07/27/2022, the center held a car wash in the back parking lot. Mr. Hegenauer was present for the entire car wash. At no time were any children in the road or in the bicycle lane. Most of the children (99%) were on the side of the building helping the child care staff members wash cars. Mr. Hegenauer was standing on the sidewalk along with several adults and several school age children holding signs. Mr. Hegenauer had pictures of the car wash which he was able to show Ms. Jackson and me to prove the children were not in the road or in the bicycle lane. Mr. Hegenauer showed Ms. Jackson and me several pictures. I observed six adults with four school age children standing on the sidewalk holding signs that read "Free Car Wash". The children were not observed in the road or in the bicycle lane. I also observed pictures of the child care staff members and most of the children washing cars on the side of the building. The children were not standing in the parking lot where the vehicles were pulling in or out of the parking lot. On 09/12/2022, I contacted the program director/licensee designee, Michelle Gatza and an interview and exit conference were conducted. On 07/27/2022, the center did hold a free car wash in the side parking lot. At no time were any children in the road or in the bicycle lane. An exit conference was also held during this telephone conversation.

On 07/12/2022, I conducted an unannounced onsite inspection with child care licensing consultant Tania Allard. I met with Denise Roeske and an interview was conducted. Ms. Roeske is the director of the school's Summer Day Camp for school-aged children only. The summer day camp operates Tuesday through Thursday from 9am — 12pm. The summer day camp is not affiliated with the child care center and is operated by the Frankenmuth Community Education program. Neither the child care center nor the summer day camp allows children to use hair dryers or curling irons. The school did have a "lock in" at the end of the school year and they had a "style station" for the older children in grades three and up. The hair station did have hair and make-up however the blow dryers and curling irons were operated by the teachers and parents. The children at the "lock in" did not operate the blow dryers or curling irons. Neither the child care center nor the summer day camp staff use Clorox wipes to disinfect the tables. Child care staff members use the three-step process to disinfect the surfaces. They do have Clorox wipes which would be used on a spill on the floor if needed. I then met with child care staff member, Mary Jacot and an interview was conducted. Ms. Jacot denies that the children are allowed to use blow dryers or curling irons. In Room 4 they do have a "beauty studio" with play make up and hair brushes however there is not a curling iron or blow dryer. Child care staff members do not use Clorox wipes to sanitize the tables and food surfaces. They use the three-step process to sanitize the tables and food surfaces. Ms. Jacot was able to show me the "beauty studio" in Room 4 which consists of a shelf with hair brushes, combs, and play make up. Room 4 is the school-age room. There were no curling irons or blow dryers observed. I then met with child care staff member, Sydney Merrihew and an interview was conducted. Ms. Merrihew works in the school age room. The school had a "lock in" and the next day someone had left the blow dryer on the shelf and a child had picked it up and she immediately put it away. There were no curling irons ever observed in the center. Ms. Merrihew realized that someone had forgotten to put the blow dryers up and she immediately rectified the mistake. The school age room had been utilized for the "lock in" held by the school during after-hours. The "lock in" was an event that took place after the center closed. They had an area set up where parents and teachers curled the older children's hair and did their make-up. During child care hours there are not blow dryers or curling irons used or available for children's use. Child care staff members do not use Clorox wipes to sanitize the tables or food surfaces. Child care staff members utilize the three-step process to sanitize the tables and food surfaces. There have been times when child care staff members use Clorox bleach wipes for a small spill on the floor. There has never been a time when Clorox bleach wipes were used on the tables. I then met with child care staff member, Lauren Somerville and an interview was conducted. Ms. Somerville works in Room 3 which is considered the Junior's room 3 which serves ages five through seven. Children are not allowed to use curling irons or blow dryers. During the "lock in" sponsored by the school that was held after hours the teachers and parents used curling irons and blow dryers on school age children. Even during the "lock in" children were not allowed to use the curling irons or blow dryers. Child care staff members do not use Clorox bleach wipes to sanitize the tables. There have been times where there was a spill on the floor in which they used Clorox bleach wipes to clean the floor. Child care staff members utilize the three-step process to sanitize the tables. On 03/29/2021, I spoke with Carrie Johnson, child care supervisor. She received a phone call from Child A's (male, 5.5 years) grandmother who said Child A said there was a friend at school where they show private things. When asked what private things, Child A said we show our penis and our butt. When 2 asked where they do this, Child A said, " in the cafeteria at movie time". Child A does not come often and in fact, he has only been here on three occasions this year. They can pinpoint a day in which the incident could have taken place because the last time they watched a movie was on 02/05/2021. They did watch a movie in the cafeteria because the gym was not available that day. The children were never out of view of the camera and were not left alone. On 02/05/2021, there were only 11 children in care along with two staff members, Ms. Merrihew and Ms. Jacot. Ms. Johnson and the principal, Ms. Waliczek viewed the camera from that day and the children were never out of view of the staff members and it showed nothing happened between Child A and Child B. They are currently on spring break this week. On 04/16/2021, I spoke with Child A's mother. She received a call from her mother who told her Child A and Child B showed each other their penis during movie time. Child A did not indicate which movie. Child A usually does not attend child care and believes the last day he attended was February 16. Child A's mother states she has spoken to the police and believed they have closed the case. She does not know if anything happened, but Child A has moved on and has said nothing else about the incident. She has no concerns or issues with the center. On 04/16/2021, I spoke with Child A's grandmother who said while he was riding a scooter, Child A stated he and Child B tell each other jokes. Then said, not really jokes, we show private things. When asked what private things, Child A said they show each other their penis and butt, in the cafeteria during a movie. She contacted Ms. Johnson right away to let her know. On 04/16/2021, I spoke with Child B's mother, who stated when she was told about the incident, and asked Child B who said nothing happened. Child B attends the child care every day. She is aware that Fridays are movie days and is also aware that both Ms. Johnson along with Ms. Waliczek reviewed the video tape and found nothing. She has no concerns or issues with the school and does not believe anything happened or that Child B did anything wrong. On 04/16/2021, I had an onsite inspection at List Preschool and Eagle Express. I spoke with Mary Jacot, child care staff member. She stated she never saw anything out of the ordinary on the day in question, 02/05/2021, and it would be very uncharacteristic for Child B to do anything like the allegation states. He is also good at coming to the staff members and saying something if anything happens. She does remember that they saw a movie in February in the cafeteria, and that it was a snow day so Child A did come. As far as Child A, she describes him as a child who does use profanity at times and exposed his butt at the table a while ago as he is sort of the class clown, and thinks these things are funny. On 04/16/2021, I met with Sydney Merrihew, child care staff member. She describes Child B as well behaved, and would not expect anything like the allegation states, from him. On the other hand, Child A does not listen at times, has used profanity in 3 the classroom and likes to make people laugh. She was very shocked by the allegation. She was present on 02/05/2021, which was the last day they saw a movie. They went to the cafeteria and watched the movie. She never saw anything inappropriate between Child A and Child B and states both are the type that would tell her if anything like that happened. On 04/16/2021, I met with Ms. Johnson, who gave me a copy of the attendance for 02/05/2021 as well as a copy of child information records. I also reviewed the video tape for 02/05/2021 with Ms
