R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.
On April 4, 2022, licensee designee, Ms. Candice Davies called and self-reported an incident. On March 24, 2022, the last day of school before Spring Break, Child A (male, years old) woke up from naptime with a red mark on his neck. Ms. Davies said the mark looked like a burn mark. Ms. Davies said she and Ms. Sean La Rosa, the Executive Director of Early Childhood Services for Livingston Educational Service Agency (LESA), completed an internal investigation. There were three child care staff members, Ms. Jessica Shoner, Ms. Holly Gutierrez and Ms. August Vermillion, in the classroom. According to Ms. Davies, none of the child care staff members knew how Child A received the mark. Child A did not say that a child care staff member hurt him. Child A did not complain about any pain. Ms. Davies said they did not find any evidence that Child A sustained the injury at the center. Ms. Davies said the Department of Health and Human Services (DHHS) was not contacted. I advised Ms. Davies to contact DHHS. I reminded Ms. Davies if she suspects child abuse then DHHS should be contacted immediately. On April 5, 2022, I completed an unannounced on-site inspection. We interviewed program director, Ms. Karen Esper, and child care staff members, Ms. Jessica Shoner, Ms. August Vermillion, Ms. Holly Gutierrez, Child A, and witnesses, Mr. Roman Pariseau, Ms. Kristie Dyke, Ms. Trisha Allen, Ms. Katelyn Fisher and Ms. Shawna Fisher, separately. Ms. Esper said Child A is in the Head Start classroom, room #48 Jungle Classroom, with Ms. Shoner, Ms. Gutierrez and Ms. Vermillion. Ms. Esper said she was unaware that there was any incident with Child A. She was at the child care center on March 24, 2022, but nothing was brought to her attention. Ms. Esper said the children sleep on mats, not cots. 3 I interviewed Ms. Shoner who denied harming Child A. Ms. Shoner said sheWoesnt know how Child A got injured; she doesn't know what happened. Ms. Shoner said on March 24, 2022, there were 14 or 15 children with three child care staff members. She was in the classroom with Child A and a couple of the children. It was after lunch time around 12:00 P.M., and they were transitioning to naptime. She believes Ms. Vermillion was assisting the children in the bathroom. The bathroom is located in the hallway, by the classroom. Ms. Gutierrez stood at the classroom door to help the children to and from the bathroom. Ms. Shoner recalls Child A lying on his mat. His blanket was covering his face so she removed the blanket and covered him. Ms. Shoner said there was no resistance, and the blanket wasn't wrapped under him. Ms. Shoner said she walked away to check on the other children. Ms. Shoner said she came back to Child A and rubbed his back. She rubbed his back, neck and head. This was normal and it's something they do every day during naptime. Ms. Shoner said Child A did not complain. Ms. Shoner said after naptime between 1:30 and 2:00 P.M., Child A woke up and said his neck hurt. She was standing across the room and recalls telling him maybe he slept funny. Ms. Shoner said she heard another child in the classroom say Child A's neck was red. She examined Child A's neck and noticed that it was bright red. She asked Child A what happened, and he said that she did it when she took his blanket. Ms. Shoner recalls standing by Child A's mat, picking up the blanket and `flopping" it back on Child A. She does not remember if Child A was lying on his stomach or back. According to Ms. Shoner, Child A has the tendency to wrap himself, including his hands and face, with his blanket. The blanket is fleece and is brought in from home. Ms. Shoner said she and the other child care staff members try to keep the blankets off of the children's faces. Ms. Shoner does not believe removing the blanket from Child A caused any injuries. Ms. Shoner informed Ms. Vermillion of Child A's injury and they administered an ice pack for his neck.
