Except as otherwise provided in subsection (13), when a person, partnership, firm, corporation, association, governmental organization, or nongovernmental organization applies for or applies to renew a license to operate a child care center, group child care home, or family child care home under section 5m and before a group child care home or family child care home allows an individual to be a member of the household, or a child care center, group child care home, or family child care home allows an individual to become a child care staff member, the department shall do all of the following:

R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.
I spoke with licensing consultant Amanda Wendell on 9/16/2020. Ms. Wendell is the assigned licensing consultant to this child care center. She indicated that she had received a verbal notification from the center in regard to the current allegations assigned in this special investigation. She also received a written incident report detailing the event from the child care center. Ms. Wendell reported that the child care center was currently closed due to furnace issues for the rest of the week. I reached out to licensee designee Lisa Fisher on 9/22/2020 to confirm the furnace issues had been fixed and that children were back in care. Ms. Fisher indicated that the furnace was fixed and children were back in care. According to Ms. Fisher, on 9/14/2020 Child A's Grandmother contacted the main office of the licensee to report concerns that Child A had come home with a bruise 2 on her shoulder, a possible bite mark, and a cut in her underwear. Ms. Fisher reached out to Child A's Mother about the concerns Child A's Grandmother reported. Child A's Mother stated to Ms. Fisher that she was not worried about the bruise because her daughter is clumsy and she did not see the bite mark. Child A's Mother indicated that Child A told several different stories about what happened, but at one point she did mention Child B (male, age 4) cutting her with scissors. I completed the onsite inspection at the child care center on 9/30/2020, I spoke with program director Melissa Fuentes and child care staff member Terry Woodard. Ms. Fuentes indicated that Child A only attended the child care center for one day on 9/14/2020. Ms. Fuentes did not note any concerns with Child A and could not think of any time in which the children would have had access to scissors. Child A and Child B took naps on opposite sides of the room, they did not sit at the same table, and they did not sit together on the bus. Child A never came up to Ms. Fuentes complaining that she had gotten hurt or anything. Ms. Fuentes stated that Child A's Mother never contacted the school to inform them that Child A was no longer attending the child care. Ms. Fuentes reported that Child A's Mother had wanted Child A to attend another Great Start Readiness Program (GSRP) program, but due to their location they were assigned to that site. Now that this incident has occurred, Child A is at the site Child A's Mother initially wished her to be at. I spoke with child care staff member Terry Woodard who was the bus driver on the day that Child A attended the child care center. He stated that all the children sat alone due to COVID policies and that there were no issues on the ride to and from school for Child A. I placed a call to Child A's Mother on 10/28/2020. She stated that she did not have any concerns with the Fountain Child Development center and that Child A now goes to a different GSRP program. Child A's Mother did not elaborate on the incident and said it was "all weird," but they are happy now.
