On December 17, 2020, the department received a complaint that the center "leaves kids unattended whether they are napping or not. The program director Tammi Klimek has said that she doesn't condone leaving the children alone but is still training the child care staff members on watching the rooms." On December 21, 2020, I completed an onsite investigation at the center. Ms. Klimek was present and was interviewed. She acknowledged that recently child care staff member Ayanna Williams had left Child A (male, age 11 months), Child B (female, age 21 months), and Child C (female, age 18 months), alone in the infant/toddler room. Ms. Williams was employed at the center for approximately a year until she was terminated a few weeks ago. In the previous month, Ms. Williams had started acting irresponsibly. 2 She would arrive at work smelling like marijuana smoke. She would go out to her car and return smelling like marijuana smoke. Ms. Klimek attempted to work with her and gave her multiple warnings. On December 11, 2020, Ms. Klimek was heading to the infant/toddler room when she discovered that Ms. Williams had left the children alone to go out to her car briefly (for approximately 1 minute). None of the children were harmed. Ms. Klimek terminated her employment from the center after that. The facility has cameras and there is a still shot from December 11, 2020, of Ms. Williams leaving the building without permission during her shift. During the inspection, I observed 3 infants and toddlers in the toddler room, with child care staff member Emily Burke. I observed 10 preschool children outside on the playground with child care staff member Jared Klimek. Each class was within the appropriate group size and ratio for child care staff member to child. On December 21, 2020, I interviewed Mr. Klimek. Mr. Klimek stated that Ms. Williams is no longer working in the center. He was aware that she was not following policy and procedures and that she was terminated as a result. He had heard that she left the children alone in the classroom one time, but he was not sure when. He denied that Ms. Klimek allows the children to be alone. He denied leaving the children alone at nap time or any other time. On December 21, 2020, I interviewed Ms. Burke. Ms. Burke stated that she is relatively new to the center and has only worked there for a month and a half. She did not work with Ms. Williams at the center. She was unaware of the children being left alone. She denied ever leaving the room out of ratio or leaving the children alone. She stated that there is usually 3 staff members working in the building. When someone needs to leave the room, they ask for coverage. She denied being trained by Ms. Klimek that it is alright to leave the children alone. On December 21, 2020, I attempted to contact Ms. Williams. She did not answer and did not return my phone call. On January 21, 2021, I completed an exit conference with Ms. Klimek.

Licensee, Tammi Klimek tossed Child A (male, age 4) over a baby gate for not laying down during nap time. On October 8, 2020, Child B (female, age 2.5) was snatched by Ayanna Williams, child care staff member, and held down by her legs to prevent her from kicking off her shoes. 4 The children are not being fed on time. They are not being fed adequate portions. 5 The children's diapers are not being changed in a timely manner. 7 The cleaning supplies used are not allowed.

On October 14, 2020, I contacted the complainant, who was unable to be fully interviewed at that time. The complainant stated that Ms. Klimek was observed grabbing Child A because he would not nap and was misbehaving. Child A is related to the licensee Tammi Klimek, so she treats him differently than the other children. She handles him "rougher" than other children. I attempted to contact the complainant twice after that regarding the other allegations, but they were unavailable or did not answer. On October 16, 2020, I completed an onsite investigation at the center. Child care staff members Jared Klimek and Ayanna Williams were present and interviewed. Ms. Williams denied ever seeing Ms. Klimek or any of the other staff mistreat the children. She was aware that Child A had a recent negative behavior during naptime, but she was in another room when Ms. Klimek was addressing the situation. She heard her talking to him, but she did not witness her handling him physically. On October 16, 2020, I interviewed Mr. Klimek. He stated that he always provides appropriate care and supervision of the children. He denied ever seeing Ms. Klimek or any staff handle the children roughly. He acknowledged that Child A is related to Ms. Klimek and that she would never harm her own relative. He was aware that Child A had a recent behavior during naptime, which is common for him. He did not see any inappropriate behavior by Ms. Klimek. On October 27, 2020, I interviewed Ms. Klimek. She denied ever handling any of the children inappropriately. She denied ever seeing a staff member provide inappropriate care to the children. She stated that she would not tolerate that behavior and she would not employ someone who mistreated the children. She acknowledged that Child A recently had a negative behavior during naptime. She 3 had to move him from the preschool room to the infant room because he was disrupting nap time. She denied using inappropriate physical force or intervention. She recalled that while he was misbehaving, he almost fell and she grabbed him to stand up. She did not snatch him or grab him inappropriately. Ms. Klimek ended up contacting both of his parents to let them know that he was having a negative behavior during naptime. Ms. Klimek calmed down Child A and he remained at the center for the rest of the day. On October 27, 2020, I interviewed Child A's Father. He was aware of a recent behavioral episode during naptime with Child A. He stated that Child A is impulsive and does have negative behaviors at times. He denied having any concern with how Ms. Klimek or any of the staff members care for Child A. Currently Child A is no longer attending the center. He stated that he previously worked in the center during the last year, and he never observed inappropriate care of the children when he worked there. On October 27, 2020, I attempted to contact Child A's Mother. I was unable to leave a voice message. On October 28, 2020, I interviewed Child C's Mother. She denied having any concerns regarding the care and supervision of Child C (male, age 9 months) while at the center. She stated that Child C loves it there and the staff seem great. On October 28, 2020, I interviewed Child D's Mother. She denied having any concerns regarding the center. She stated that Child D (female, age 13 months) loves attending there, and the staff seem great. On October 28, 2020, I left a voice message with Child E's Mother, which was not returned.

On October 14, 2020, I contacted the complainant, who was unable to be fully interviewed at that time. On October 08, 2020, the complainant observed Ayanna Williams holding Child B down because she took her shoes off when she was not supposed to. On October 16, 2020, I completed an onsite investigation at the center. Child care staff members Jared Klimek and Ayanna Williams were present and interviewed. Ms. Williams denied ever handling the children roughly. Ms. Williams stated that she is a primary caregiver for Child B and the lead caregiver in the toddler room. Child B will routinely take her shoes off inside or outside when she is not supposed to. The child care staff members remind her not to do so, or they will redirect her. Ms. Williams denied ever holding her down to prevent this. She did not know why someone would make that allegation. She stated that two child care staff members were recently terminated from the center and were upset when they left. I observed Child B playing with toys during the onsite inspection. She had her shoes on and did not have any negative behavior. On October 16, 2020, I interviewed Mr. Klimek, who does not provide direct care to Child B. He has observed Child B remove her shoes on the playground, but she does not get in trouble for that. On October 23, 2020, I interviewed Child B's Mother. She denied having any concerns with the care and supervision of Child B while at the center. She stated that the staff members always communicate with her and tell her how Child B did that day. She was unaware of any concerns with Child B removing her shoes or staff punishing her for it. On October 27, 2020, I interviewed Ms. Klimek. She denied observing Ms. Williams mistreat Child B, or any other child care child.

(1) Food and beverages provided by a center must be of sufficient quantity and nutritional quality to provide for the dietary needs of each child according to the minimum meal requirements of the child and adult care food program (CACFP), as administered by the Michigan department of education, based on 7 CFR part 226, 1-1-18 edition, (2018) of the United States Department of Agriculture, Food and Nutrition Service, CACFP, and is hereby adopted by reference. On October 16, 2020, I observed lunch being served in the preschool and toddler rooms at approximately 1:00pm. The meals were already prepared and in dated storage containers in the refrigerator. The lunchtime meal was spaghetti, carrots, fruit cocktail and milk. None of the children asked for second helpings. The posted menu for that day listed pizza, carrots, and fruit cocktail for lunchtime. On October 16, 2020, I interviewed Ms. Williams. Ms. Williams stated the spaghetti was left over from the day before. She indicated that Ms. Klimek writes the menus and records any substitutions. I observed a couple of menu substitutions listed on the menu for a previous week. Ms. Williams stated that there is plenty of food to serve the children and that much of the food goes to waste. Only a few of the children want second helpings and they usually have enough for more or they feed them something extra from the kitchen. Ms. Williams denied that insufficient amounts of food are being served. She stated that typically they eat lunch between noon and 1:00pm every day. On October 16, 2020, I interviewed Mr. Klimek. Mr. Klimek denied that the center serves inadequate portions of food. Ms. Klimek prepares the meals and the child care staff members serve the children in each of their classrooms. There is always enough food for the children and more if they want seconds. They eat lunch around 12:30pm each day, but sometimes they are ahead of schedule or behind by a few minutes. On October 16, 2020, I observed the kitchen and pantry. I observed several canned goods, dry goods, snacks, and fresh food in the refrigerator and freezer. There was an adequate supply of milk and dairy products. There were several frozen meat items in the freezer and boxed goods in the pantry. I observed a posted guideline of food measuring amounts in the kitchen. On October 23, 2020, I interviewed Ms. Klimek. Ms. Klimek stated that the complainant is a disgruntled staff who must have read old reports and decided to make this allegation because other people have alleged this in the past. Ms. Klimek indicated that she participates with the Mid-Michigan Food Program and follows their guidelines at all times. She denied that there are insufficient amounts of food being served. She tries not to be wasteful, which is why she serves leftovers quite often. She feels that a lot of the food is being wasted because the children do not finish their meals, especially the vegetables and foods they do not like. Some children are really good eaters and will ask for more, and she always tells her staff to give seconds. On October 27, 2020, I interviewed Child A's Father. Child A's Father denied that the center serves inadequate portions. He has worked there before and always observed appropriate portions and meals served on time. Child A has never A complained about the food before. He stated that Child A is a food addict and he definitely receives plenty to eat. On October 23, 2020, I interviewed Child B's Mother. Child B's Mother stated that she is never there during meal times. Child B is hungry sometimes when she picks her up. She is not able to talk yet, so she is not able to ask her about the food. On October 28, 2020, I interviewed Child C's Mother. Child C's Mother stated that she sends baby food and bottles for Child C. She is not there during meal times. On October 28, 2020, I interviewed Child D's Mother. Child D's Mother stated that she has no concerns about the food being served at the center. On November 17, 2020, I interviewed Mid-Michigan Food Program consultant Sherry Wilke. She conducted a virtual review with the center on October 30, 2020. Ms. Wilke did not have any concerns at that time. She has previously had three onsite reviews in the last year and a half. She has observed a meal preparation, meal servings and their menus. The center was observed serving adequate portions and following menu guidelines. Serving leftovers is allowed as long as they observe proper

On October 16, 2020, I reviewed Child C's daily sheet (dated 10/15/2020), which showed that he was diapered 4 times throughout the day. On October 16, 2020, I observed Ms. Williams diapering the children after lunchtime. Ms. Williams stated that she changes the children's diapers every two hours at a minimum or more often as needed. She stated that this is their policy. On October 16, 2020, I interviewed Mr. Klimek. Mr. Klimek works in the preschool and school age rooms. He stated that he does not change diapers very often but he has before. He denied ever hearing a parent complain about this. He has observed other staff in the infant and toddler rooms routinely changing diapers. On October 23, 2020, I interviewed Ms. Klimek. Ms. Klimek denied that the children's diapers are not changed in a timely manner. Their policy is every two hours or more often as needed. On October 23, 2020, I interviewed Child B's Mother. Child B's Mother stated that Child B does not come home with a diaper rash. She did not have any complaints regarding this allegation. On October 28, 2020, I interviewed Child C's Mother. Child C's Mother stated that Child C has not had any diaper rashes. She does not have any issues with the diapering procedures in the center. On October 28, 2020, I interviewed Child D's Mother. Child D's Mother stated that the diaper changes are always fine. Child D comes home clean and without a rash. .............

The complainant alleged that the cleaning supplies being used in the center are not allowed. During the onsite investigation on October 16, 2020, I observed a cleaning agent called Solugard Botanical 2x concentrate, which is an EPA registered (EPA# 66251- 2) commercial botanical disinfectant. The bottle of Solugard that I observed was near the edge of the counter in the preschool room. It had a label on it that stated "keep out of reach of children" on it. On October 23, 2020, I interviewed Ms. Klimek. Ms. Klimek stated that she uses Solugard as a bleach alternative because it is less harsh than bleach but still sanitizes surfaces. I informed Ms. Klimek of my observation on October 16, 2020 and informed her that this bottle was in reach of children. She stated that typically cleaning supplies are safeguarded. Ms. Klimek recently had an inspection from the Genesee County Health Department on August 14, 2020 and they reviewed her cleaning supplies and sanitizing procedures. She stated that they approved the use of this cleaner at that time. On November 17, 2020, I reviewed the report from the Health Department dated August 14, 2020 and it had an approved "A" rating.
