On 07/22/2021, I received a telephone call from licensee designee Robbie Stacey who reported allegations of inappropriate contact between a child care staff member (CCSM) and a child. The center was notified that Child A (male, 4 years) told his mother that CCSM Angela Henderson squeezed his arm earlier in the day. She added that CCSM Sarah Yager notified Child A's Mother that Child A had some behavioral issues that day and had been aggressive to Ms. 2 Henderson by trying to scratch her. Ms. Stacey agreed to report the incident to the Michigan Department of Human Services. On 07/23/2021, I received the written incident report from Ms. Stacey regarding the allegations. On 07/27/2021, I interviewed Child A's Mother who explained that she was made aware by the center that Child A had a history of trying to "fight with the teachers" by attempting to bite, hit, or scratch them. She added that most recently on 07/21/2021 Child A told her that Ms. Henderson grabbed his left wrist tightly after he tried to bite her. She confirmed that Child A did not get injured, obtain a mark/bruise, and did not receive any medical treatment. She had her mother call the center later that day after she arrived at home and report the allegations. She believes her mother spoke with Ms. Yager. Later that day Ms. Stacey called Child A's Mother and notified her that she would be reporting the allegations to the department for investigation. Child A attended the center on 07/22/2021 and Child A's Mother was notified by Ms. Stacey later in the day that he was disenrolled by the center. She asked at this time if she could review the cameras and Ms. Stacey told her that they are not for parent's viewing, only for the center's viewing. She added that Ms. Henderson has been heard calling Child A "bad" although all of the other CCSM's call him sweet. Child A no longer attends the center. On 07/27/2021, I completed an unannounced onsite inspection at the center from 12:25 pm — 3:45 pm and interviewed Ms. Stacey, program director Kelly Slowik; CCSM's Kelly Kaczmarczyk, Joyce Dique, Ms. Henderson, and Ms. Yager. Ms. Slowik clarified that she did not work at the center on 07/21/2021 and came in for "a bit" on 07/22/2021. She confirmed that the cameras in the center do not work, as they are set on "night mode" making the view pitch black at all times. She believed that Ms. Stacey explained this to Child A's Mother. She is aware that numerous voicemail messages have been made to the installer for repair work or assistance in correcting the issue, yet they have not received any return telephone calls. She could not recall if she was notified of the allegations by Ms. Yager or Ms. Stacey but she understood that Child A tried to scratch Ms. Henderson and CCSM's Ms. Henderson, Ms. Yager, and Ms. Dique all intervened in an attempt to redirect him. She was told that Ms. Henderson just held his hands at his wrists briefly at the beginning of nap time to prevent him from scratching her. During the time that she was at the center on 07/22/2021 she observed that Child A was using his arm and did not raise any concerns about it being sore. She never saw Ms. Henderson utilize any inappropriate caregiving toward Child A or any other children. She never heard Ms. Henderson call Child A or any other child bad. Ms. Henderson confirmed that she worked with Child A at the center on 07/21/2021 with both Ms. Dique and Ms. Wisenbaugh in the room 2. She added that Ms. Yager was present at the center but in the nearby room 1. Child A attempted to hit and scratch all of the CCSM's on this day. All of the CCSM's intervened and attempted time-out or redirection. She explained that at approximately 12:30 pm at the start of 3 naptime she was patting Child A's back while he laid on his cot. Child A wanted to get up, he tried to scratch her, so she held his fisted hands with one of her hands while she continued to pat his back with the other.
