On November 04, 2022, a complaint was received stating that on October 25, 2022, a child came home with a bruise under their eye last week. The identity of the child was unknown and no other details were given. On November 15, 2022, I completed an unannounced onsite inspection at 12:06pm. Child care staff members Tonya Burnett, Dea Jones and Aujerie Sparkman were present and working. On November 15, 2022, I interviewed Ms. Sparkman. She stated that she works in the infant/toddler room. She was aware that one of the children in that room, Child A (male, age 1) came to the center with a small bruise under his eye a few weeks ago. Her coworker Opal Malcolm noticed it and wrote it down on his daily sheet, which is something they would commonly do in that circumstance. The licensee, Marie Haywood, said she had contacted his mother and reported it. They weren't overly concerned about it but wanted to check with his mother. Allegedly his mother denied knowing about it and said that it must have happened at the center. She wasn't upset though and nothing more was said about it. Child A has been attending the center for a while and sometimes he comes in a little dirty. He has had different marks on him before, but nothing concerning. They did not contact children's protective services, as they didn't feel he was abused or neglected. Child A was in attendance that day at the center and I observed him eating lunch. He appeared relatively clean and healthy. I did not observe a bruise or mark on his face. On November 15, 2022, I interviewed Ms. Burnett. She was unaware of any marks or bruises on any of the children recently. She stated that she just started a few weeks ago. On November 15, 2022, I interviewed Ms. Jones. She had heard about a mark on Child A from either Ms. Haywood or Ms. Sparkman. She doesn't work in Child A's room, so she wasn't present for all of the discussion. She did see the bruise and it looked more like a small mark or bruise; it was hard to tell. She recalled hearing that they called his mother right away. His older sibling attends the center in her preschool room. She has 3 never observed any signs of abuse or neglect with her. She has seen his mother at pick up or drop off since then and she didn't seem upset or concerned about the mark. On November 15, 2022, I interviewed Mrs. Haywood via telephone. She was aware of the bruise on Child A. She wasn't sure exactly when he had it. She recalled being there that afternoon when his mother arrived for pick-up, and she had asked her about it. She told her that she would check with Ms. Malcolm, who had documented it on his daily sheet. She was then informed by Ms. Malcolm that he came in with the mark on his face. She had documented it on the daily sheet after he was dropped off. Ms. Haywood called his mother back the next morning and told her that her staff said it was already there, and she said OK. Typically, Child A and his siblings come in relatively clean, dressed well and fine. Child A has five other siblings, and his mother doesn't seem to stress out about any small incidences if/when there has been one. Ms. Haywood wasn't concerned about the mark and did not feel it met the criteria to contact children's protective services. Child A is crawling and moving around and could have bumped his face somehow, but no one recalled him crying or a particular incident. Mrs. Haywood indicate that she recently cut Ms. Malcolm's work hours and she has not been happy about that, so she is no longer working there. On November 15, 2022, I interviewed CCSM1. She recalled seeing the mark on Child A when his mother came to pick him up. She told her that her coworker Ms. Malcolm seen it earlier and documented it on his sheet, but she was unaware of any other details. She didn't seem upset and accepted the response. She said something about how he could have caused it himself. Sometimes other relatives pick up Child A and his siblings. They all seem really nice, and she didn't have an

On November 04, 2022, a complaint was received stating that the center is serving processed food and left overs. They cook on Monday and serve until it's gone sometimes till Thursday. No other details were provided. On November 04, 2022, I contacted the Mid-Michigan Food program and they verified that they work with the center, who participates with their food program. The assigned consultant is Shannon Styker. On November 15, 2022, I spoke with Ms. Styker. She was just at the facility on September 26, 2022. She did not find any violations in the center. She recalled very few children being present. The kitchen was observed to be fine. They had eaten breakfast that morning. She checks the milk that they have onsite, and she didn't recall any issues. She indicated that milk is not allowed to be served past the expiration date. A facility is allowed to serve leftover meals. They must follow proper storage requirements and ensure that it isn't spoiled. On November 15, 2022, I arrived just after lunchtime. The children were lying down for nap time and Ms. Burnett was cleaning up the kitchen. I observed fresh fruit and vegetables in the refrigerator, as well as several canned goods and dried goods. They had eaten hamburger, french fries, pineapple, and broccoli that day. They had broccoli leftover from the day before. Ms. Burnett stated that she does all of the cooking and meal planning. She denied that the center serves the same food all week until it is gone. She stated that she is always cooking something different each day, and the 5 meals are nutritious. The only time leftovers are served is for the school age children who eat later in the day. They will get the leftover lunch items. Rarely do they have enough leftovers to carry over into the next day, but sometimes they do. Today's leftovers from lunch will be served to the afterschool children. They get a full meal when they come after school, not just a snack. On November 15, 2022, I observed the menu posted in the kitchen. The lunch meals were different each day, as well as breakfast and snacks. They appeared to be nutritional and had a variety of options. On November 15, 2022, Ms. Jones and Ms. Sparkman denied that they serve week old food or processed foods. Ms. Jones stated that Ms. Burnett does most of the cooking now and she is always making new meals. They occasionally have leftovers that are used for the older children or sometimes the next day if they have enough. They never go past 48 hours for leftovers. They have never had a food complaint by the children or the parents. In fact, most of the parents compliment them on the food and how well their children eat. On November 15, 2022, Ms. Haywood stated that they only offer leftovers to the latchkey children. She participates with the food program and has never had a violation or complaint. She has no idea why someone would say this, they do not serve week old food. It is always used up within a day or two. The center only cooks one time per day, and that is for lunch. They offer nutritious meals and they are not over processed foods. On November 15, 2022, CCSM1 stated that she see's what the children eat afterschool. They get a full meal, which is usually leftover from lunch. The children eat well and never complain. She has never heard a parent complain. On November 21, 2022, I interviewed Child A's Mother. She denied having any concerns with the food being served in the center. She has other children who attend the center, and no one complains or goes without. On November 21, 2022, I interviewed Child B's Mother. She stated that Child B is usually very picky about his food. The center has always accommodated his nutritional needs. They serve him almond milk and make sure he gets what he needs. She did not have any concerns about food being re-served. On January 25, 2023, Ms. Haywood stated that Ms. Styker came back to the center on January 19, 2023, and completed another inspection, there were no violations found

On November 04, 2022, the complaint stated that there is old milk in the refrigerator dated since June 2022. No other information was provided. On November 15, 2022, Ms. Styker denied seeing any concerns with the milk during her inspections of the center. She indicated that centers are not allowed to use milk past the expiration date. On November 15, 2022, I observed a half-opened gallon of half percent low-fat milk that did not have an opened date written on it. The expiration date was October 31, 2022. Another gallon of milk was dated "best by 11/12" and it was labeled as opened on 11/14/2022. Ms. Burnett stated that she didn't serve the milk dated from October 31, 2022, she just forgot to throw it out yet. She checks the milk expiration dates weekly and will throw out the expired milk when she sees it is past due. She stated that milk is usually good for 7 days after you open it. I instructed Ms. Burnett to throw out the expired milk and she agreed to comply. On November 15, 2022, I advised Ms. Haywood about the expired milk in the refrigerator. She stated that Ms. Burnett typically handles the food service now, and she was unaware of any outdated milk still in the refrigerator. She stated that any old 7 milk gets pulled out. Even if it is expired, she they usually have new milk to use, so it wouldn't get served. She will ensure that all of her staff are aware of this.

On November 04, 2022, the complaint stated that "the center is understaffed, a 16-year- old works unsupervised and closes the center." No other details were provided. On November 15, 2022, I observed 10 children present in the center. Four of the children were infants and toddlers, who were with Ms. Sparkman in her classroom. This is within the required staff care staff member: child ratio of 1:4. There were six children (ages 2.5 and older) present in the preschool room with Ms. Jones, which was within staff care staff member: child ratio of 1:8, based on their ages. Ms. Burnett was working in the kitchen and covering lunches. Mrs. Haywood had just left for a while. Ms. Sparkman, Ms. Burnett, and Ms. Jones are all adults. On November 15, 2022, Ms. Sparkman acknowledged that CCSM 1 is a minor and works in the center. She comes after school only and helps close the center usually when the latchkey children are there. There is always an adult there with her, usually Ms. Burnett or the other closing staff. She denied that the center is understaffed. There are plenty of staff who work there. Ms. Burnett was most recently hired, and she covers breaks, and does the cooking and cleaning. Their enrollment has been low lately and they have enough staff to cover the children that attend. On November 15, 2022, Ms. Jones stated that CCSM 1 is a minor and works in the center. She comes after school and typically relieves her position so she can go home. She denied that the center is understaffed. Ms. Burnett helps cover the classrooms when needed. She typically closes the center with Ms. Burnett. On November 15, 2022, Ms. Burnett stated that she oftentimes works with CCSM1 to close the center. CCSM1 provides care to the children and helps clean etc. She is never alone in the center. She denied that the center is understaffed. They are always within ratio. On November 15, 2022, Mrs. Haywood denied that the center is short-staffed or out of ratio. Ms. Burnett and CCSM1 have recently been hired and have helped with the schedule a lot. Their enrollment is lower than usual, so they have enough staff there at all times. On November 15, 2022, I reviewed the staff schedule and children's attendance records from the last week. I did not see that the center was out of ratio for child care staff member and children during that time. On November 15, 2022, I interviewed CCSM1. She denied that she works alone. She works part-time, after school and typically with Ms. Burnett or other staff. She stated that she is not allowed to work alone, per Ms. Haywood's policy. Usually, they are down to one or two children left when it is her and an adult left in the center. They are always within ratio. On November 21, 2022, Child A's Mother stated that she usually see's at least two workers during pick up time. She denied seeing a young girl working alone there. On November 21, 2022, Child B's Mother stated that she goes into the center in the evenings to pick up Child B, who is sometimes there last. There are always two people working. Usually, it is Ms. Burnett and a younger girl (she was not sure who that was).
