On June 28, 2023, I interviewed Witness 1, who stated that Ms. Nash comes to work and drinks on the job. She will walk around with a Styrofoam cup with Patron (Tequila) in it. This has been going on for a while. She has even asked her to drink with her at the end of the day. Her boyfriend is also there frequently. He brings her the alcohol and drinks with her too. She acts inappropriately and dresses inappropriately in a sports bra and shorts. She has not reported this behavior to anyone else or to licensing before. On June 30, 2023, I completed an unannounced onsite inspection at the child care center from 8:09am to 11:30am. Ms. Nash was on vacation and not present. I interviewed CCSM1, CCSM2 and CCSM3. CCSM1-3 all denied seeing or hearing that Ms. Nash drinks alcohol while at the center. They all denied that there are any Styrofoam cups in the center. CCSM1 stated that Ms. Nash's boyfriend will come to the center, but usually to help bring in food and groceries. He isn't caring for the children or doing anything inappropriate. CCSM2 stated that Witness1 used to close the facility with Ms. Nash each day. She has never seen a Styrofoam cup or smelled/seen alcohol at the center. She has never seen Ms. Nash act drunk or inappropriately. She never heard another staff or parent indicate this was a concern. Ms. Nash's boyfriend pops in and out sometimes. He will bring lunch to them or Ms. Nash, he has picked up a pizza before. He isn't a caregiver and doesn't have any interaction with the children typically. CCSM3 denied that Ms. Nash and her boyfriend drink at the center. He is only there for a little bit, usually to help out or bring something. During the inspection I did not observe any Styrofoam cups in the center, or in the kitchen area. On June 30, 2023, I interviewed Child A's Mother. She denied ever seeing Ms. Nash or any of the staff act inappropriately. She denied ever seeing Ms. Nash holding a cup or drinking anything at pick up time. On June 30, 2023, I interviewed Ms. Nash. She denied that she drinks alcohol at the center. She acknowledged that her boyfriend comes to the center but denied that he has ever brough alcohol or would drink there. He helps carry in grocery supplies, does chores and is usually only there a short time. He doesn't hang out. She indicated that Witness1 was just terminated from the center three days ago because she was out of line and they got into it during a staff meeting. This is a direct retaliation against her and she is making false allegations. She denied that she ever dresses inappropriately or acts inappropriately. 3 On August 09, 2023, I attempted a second onsite inspection at the facility. According to CCSM1, Ms. Nash was not present.
Program director and owner Fadrika Nash is intoxicated at the center and caring for children. Her boyfriend brings her alcohol and drinks with her. On June 27, 2023, Ms. Nash cussed at Child A (male, age 6) and told him to shut up. Ms. Nash is out of ratio in the mornings when the opening staff is alone with 12 children. Ms. Nash is never at the center. She isn't there the required amount of time that a director should be.

On June 28, 2023, Witness1 stated that she observed Ms. Nash yell at Child A during nap time during their staff meeting on June 27, 2023. They were having a staff meeting in the center at naptime and Ms. Nash was yelling at them all because their licensing consultant Ms. Millar had just completed their renewal and there were 16 violations. Ms. Nash was yelling at all of the staff and blaming them for all of the violations. Some of the children were asleep, but not all of them. Child A was laying there and must have said or done something (she wasn't sure) and Ms. Nash turned around and yelled at him, saying "get out of my motherfucking mouth." He didn't respond, he just laid there. CCSM1-3 all witnessed it. Ms. Nash continued to rant at them about following the rules and threatened to "go after their blood if something ever happens to one of the kids." She continued to curse at them about "the same shit" like cleaning and pulling their weight. It was very unprofessional and the children seen it. The center also has cameras. On June 30, 2023, CCSM1-3 denied that Ms. Nash yelled at Child A. CCSM1 stated that they were having a quick discussion while the children were sleeping. Ms. Nash was telling them what she wanted them to do. They should listen to her, be on time etc. Witness1 kept arguing with her and then it got heated. Finally, Ms. Nash told her "you can get the fuck out of here." She wasn't screaming at first, until she finally had enough. She wasn't yelling at any of the children because they were all asleep. They were in between each room so they were by the children, and they were all asleep. CCSM2 stated that they were having a staff meeting to address their productivity at work and everyone pulling their weight. Ms. Nash started to get really upset once Witness1 started pushing back at her. She used the word "motherfucker" a lot and did get loud. She didn't recall Child A being awake and she definitely didn't see Ms. Nash yell at him. She wasn't totally sure, but she thinks all of the children were sleeping 4 during the meeting. CCSM3 stated that Ms. Nash had a meeting and was telling everyone to work the way they should, respect each other, stay in their rooms etc. At first, she wasn't upset, until she got mad at Witness1. There may have been some cussing but she isn't sure. None of the children were awake at the time. Child A wasn't awake and wasn't even near where they were. On June 30, 2023, Child A was not present during the onsite inspection. On June 30, 2023, I interviewed Ms. Nash. She denied that she yelled at Child A on that day, or any other day. She emphatically denied that she would ever yell at a child or act that way towards them. She acknowledged that she got upset during the staff meeting. She got heated towards Witness1 because she was challenging her authority and she self-admittedly lost her cool. None of the children were awake at that time. They were in the room between both areas and could see all of the children. Child A wasn't even near the area. She later apologized to her staff because of the way she acted. She shouldn't have let Witness1 upset her so much. Ms. Nash stated that the facility has camera's but there is no audio. Because she is out of town right now, she will check the cameras when she returns to see if they still have the footage from that afternoon. On June 30, 2023, I interviewed Child A's Mother. She stated that Child A loves going to the center. He has never said that anyone yelled at him or cussed at him. Just hearing the allegations doesn't even make sense to her. She did not believe the allegations against Ms. Nash. She indicated that she would talk to him and if he said anything she would let me know. She has never had any concerns regarding the care that he receives there. On July 24, 2023, Ms. Nash sent me a five second clip of the facility during naptime on June 27, 2023. On June 28, 2023, Witness1 stated that she has come into work several times and CCSM1 is alone with children with 12 children. The center is out of ratio. She did not have specific dates or which children were present. On June 30, 2023, when I arrived at 8:09am, there were three children present and CCSM1 and CCSM2, which was within the appropriate staff: child ratio. CCSM3 arrived shortly thereafter when more children were arriving. On June 30, 2023, CCSM1 stated that a couple times she was alone with the children because Witness1 didn't come to work on time like she should, but she did not know how many or when. She doesn't think she was out of ratio, but Witness1 was still expected to be there in her room. She didn't recall if she was alone in the center or just in her room. She denied that she has ever been alone with 12 children. On June 30, 2023, CCSM3 stated that maybe one or two times she has come in and CCSM1 was alone with a few kids. Usually, Ms. Nash is on her way though and it's because someone is running late or called in. On June 30, 2023, CCSM2 denied that the center is out of ratio or having knowledge of CCSM1 working alone with 12 children. On June 30, 2023, Ms. Nash denied that CCSM1 has ever been alone with 12 children. She acknowledged that Witness 1 has called in or would come in late several times, but there were already staff there and they were within ratio. This was partly the reason for her termination because she just did what she wanted to do all the time. Ms. Nash submitted her attendance records for the week of June 12-16, 2023. The records showed that there was adequate staff there for the number of children present and therefore they were within ratio. I explained the licensing rule regarding ratio and the number of staff required for each room and the number of staff needed at opening/closing time. Ms. Nash indicated that she is aware of the rules and she had it covered. She was unaware of a date/time when this has happened.

On June 28, 2023, Witness1 stated that Ms. Nash is "barely at the center." Other employees are always asking where she is. She comes in late in the afternoon or around lunchtime. She will do circle time "for a minute" and then just go in her office. On June 30, 2023, CCSM1-3 denied that Ms. Nash isn't at the center the required amount of time. CCSM1 stated that Ms. Nash comes in maybe around 10am and works just like they do. She pulls her weight and does her paperwork. She isn't sure about her set schedule but she thinks she is there the required amount. CCSM2 stated that Ms. Nash comes in around lunchtime and stays until the end of the day. She is in and out sometimes but usually there. CCSM3 stated that Ms. Nash is usually there, but she doesn't know her schedule. She was unaware that a director has a certain amount of time they must be there, she thought they were just on call. On June 30, 2023, Ms. Nash denied that she is not at the center 50% of the time that it is operating. She keeps a schedule of her timesheet and attendance. Usually, she will 7 work 10:00am to 5:30pm, but sometimes it fluctuates based on staffing needs. Although the center is licensed for the hours of 5:30am to 10:30pm, the children are only there from about 6:00am to 6:00pm, so she is required to be there six hours. She is aware that she has to be there half of the time they are open. As the director she does her administrative duties as well as chores, acting as a caregiver, cooking or whatever is needed. She reiterated that Witness1 is making these allegations up and they are all false. On July 24, 2023, I received copies of Ms. Nash's attendance records for the month of June working in the center. The following dates and times of attendance were recorded: • June 01, 2023, 9:30am - 4:30pm • June 02, 2023, 9:30am - 4:30pm • June 05, 2023, to June 06, 2023, 9:30am to 4:30pm • June 07, 2023, to June 09, 2023, 9:30am to 5:30pm • June 12, 2023, to June 14, 2023, 9:30am to 4:30pm • June 15, 2023, 10:00am to 5:30pm • June 16, 2023, 10:00am to 4:30pm • June 19, HOLIDAY • June 20, 2023, 9:30am to 3:30pm • June 21, 2023, 9:30am to 4:30pm • June 22, 2023, 8:00am to 5:30pm • June 23, 2023, 8:00am to 4:30pm • June 26, 2023, 8:00am to 5:30pm • June 27, 2023, 8:00am to 5:30pm • June 28, 2023, 8:00am to 5:30pm On August 10, 2023, I completed an exit conference with Ms. Nash. I provided Ms. Nash consultation about having a staff meeting during a time when children are there and her getting upset and yelling/cursing. Although the children were asleep, she acknowledged that she could have done better and she will not repeat that behavior again.
