On June 8, 2023, an anonymous complaint was received regarding concerns at the facility. The allegations include that a child has been bitten more than once at the facility. When the child was bitten, they were told by the new director that the child has been acting up in class and blamed the child's behavior for being bitten. The director blamed the child's injuries on the child's behavior. When biting happened with the previous director, the situation would be explained including steps to prevent it from happening again. The complaint source was contacted previously regarding incidents in the building and at that time did not have any concerns because the previous director handled it professionally. No identifying information was provided in the complaint, including the name of the child, or the identification of the new director. I was unable to follow up with the complaint source to ask any clarifying questions. On June 12, 2023, I completed an unannounced onsite inspection at the facility. I interviewed Child Care Staff Member (CCSM) 1. CCSM 1 acknowledged there has been some biting behavior in the Beginners Classroom. This classroom is for children aged 2.5-3 years of age. When there is a biting incident in the classroom, the children are separated and it is explained to the biter that biting hurts, and we do not want to hurt our friends. CCSM 1 denied she has ever heard a child care staff member tell a child that they deserved to be bitten because of behavior in the classroom. The classroom typically has two child care staff members and eight children. Typically, CCSM 2 and CCSM 3 are in the classroom. CCSM 4 also floats in the classroom in the afternoon. Children who show repeat biting behavior are removed from the classroom for 2-3 days per center policy, which may also lead to disenrollment. CCSM 1 provided me with a copy of the facility biting policy during the onsite inspection. A child was removed from the facility for 2-3 days last week for repeat biting behavior. The facility also works to have a child care staff member shadow a child who is showing repeat biting behaviors to try and prevent the behavior from occurring. CCSM 1 does not have any concerns regarding the care and supervision provided at the facility. 3 On June 12, 2023, I interviewed CCSM 2. CCSM 2 works in the Beginners Classroom. A child was sent home last week for repeated biting behavior. Biting has not been a major issue, but some biting has occurred. Generally, it is when children are upset with each other over materials or toys. When a child bites another child a report is written, and first aid applied. If a child breaks the skin the child who did the biting is sent home. CCSM 2 has not heard any child care staff members tell a child that they deserved to be bitten. CCSM 2 has not observed any staff member make demeaning remarks toward a child care child. The child care staff try to determine why a child is biting and work to stop the behavior. They might also try and keep the children involved separated and engaged in separate activities. Last week Child A's Father expressed concern that Child A was bitten in the face. The biting behavior appears more random and is not regarding specific children. CCSM 2 does not have any concerns regarding the care and supervision provided at the facility. On June 12, 2023, I interviewed CCSM 3. Biting does occur in the classroom out of aggression. One child has also tried to bite child care staff members. Last week a child was removed from the facility for biting behavior for a few days. If needed child care staff will call the office for assistance in the classroom. CCSM 3 has not heard a child care staff member tell a child that they deserved to be bitten. Last week Child A was bitten in the face and his father expressed concern regarding the incident. Children in this classroom get upset over toys and sometimes become aggressive. Redirection is used as well as phrases like "teeth are for biting food."

On March 10, 2023, I interviewed . She made contact with i and i A's Mother at their "omeRoayR.RiMs other stated that Child A was crying yesterday because of an incident that occurred on the playground. When she picked him up from the center, Child A was upset, and she was told that he had to sit down because he had run into someone while playing. Child A later told her that he had accidentally hit another child with snow and CCSM1 and CCSM2 had gotten in his face saying, "why did you do this." Then CCSM1 grabbed him and put his arm behind his back. forensically interviewed Child A while at his home. Competency was established but several times Child A appeared confused, mixing up names and exact timelines. He reported that he was playing in the snow with a friend and accidently kicked snow in a girl's face. The little girl started crying and Sharicka (the program director) said "why would you do that" and Sharicka had his arms behind his back and was pulling them. Today she grabbed his arm and pulled him to the office. When asked to clarify the days, he remained insistent that it happened "today" even though he didn't attend the center today. CCSM1 will yell at the kids. CCSM 1 and CCSM2 "postured at him" like they were going to hit him. On March 14, 2023, I completed an unannounced onsite inspection at the center with at 1:40p.m. We interviewed program director Sharicka Bogan regarding the allegations. She stated that she wasn't at the center on March 09, 2023, when the incident with Child A occurred, so she couldn't have been the person he was referring to. Her assistant director, CCSM3, made a note for her that Child A was brought into the office for negative behaviors by CCSM1. He was kicking snow at another child while on the playground. He was crying, screaming, and punching the wall. He was asked to calm down several times and took a seat in the office. His mother came to the facility to pick him up, asking what happened. She then became upset about why he was crying. She continually escalated until she ended up calling the police. responded and spoke to CCSM1, CCSM2 and s. Bogan indicated that a formal criminal complaint was made against CCSM1. According to Ms. Bogan, Child A started attending the center on February 02, 2023. He has had some negative behaviors since then, but he is generally a good kid. He also is . It wasn't until last week that things got 3 much worse after the alleged incident with CCSM1. Ms. Bogan denied ever seeing CCSM1 grab a child by their arm or act inappropriately in front of her. She walks the floor all the time and observes the staff while they are working in the classrooms. None of the staff or children have previously complained about her. She is not sure what to believe, since Child A can be dramatic at times. Ms. Bogan indicated that there are no cameras in the play area, but there are cameras on the inside of the facility. During the onsite inspection, , Ms. Bogan, and I reviewed the video camera footage from March 09, 2023, around the time that CCSM1 brought Child A in from the playground. It shows her opening the outside door and holding onto his jacket (near his shoulder) with her fingers as she guides him into the building. She does not have a hold of his arm. His arms are at his sides. They walk through the door, through the building and into the hallway, where the footage stops near the office. At no time does she grab his arm or appear to be holding his arm behind his back. Ms. Bogan stated that CCSM1 is working today, but CCSM2 is not. On March 14, 2023, we interviewed CCSM4. She recalled being outside when Child A kicked snow at two children's faces. She observed CCSM1 and CCSM2 both intervene to stop the behavior and CCSM1 brought him inside. He tried to run away from her and was dodging her while she tried to bring him in. She did not see her grab or bend his arm. She denied that she has ever seen CCSM1 hit or grab a child before, including Child A. On March 14, 2023, we in

A lady named Sharicka was telling the kids to run over his foot and telling kids to tell him to shut up. One of the children told him to "shut 1f On March 10, 2023, Child A's Mother reported to her that when she picked him Child A on March 09, 2023, she observed CCSM1 standing outside at the top of the slide like she was "over" all the children. Child A has told her that CCSM 1 has also made another child run over his foot with a scooter or bike and had all the children calling him names. On March 14, 2023, Ms. Bogan denied that she has been a direct caregiver for Child A and has never had another child run over his foot with a riding toy. She wasn't present in the center when the incident with CCSM1 occurred. She wasn't on the playground with them when it happened. On March 14, 2023, CCSM1, CCSM4 and CCSM5 denied that any of the staff who work in the center tell the children to hit each other or have each other step on other people's toes. CCSM1 denied that she has ever made a child run over Child A's toes or to hit him. CCSM4 denied every hearing CCSM1 say "hit them back" and has not heard any swearing or curse words towards the children. She denied that Child A is bullied at the facility. CCSM5 denied that CCSM1 has had other children hit Child A or other children. She has never heard CCSM1 say "hit them back" and has not heard any swear words. On March 22, 2023, and I interviewed forensically interviewed Child B. He denied that any of the staff make the children do bad things to each other. On April 03, 2023, I had email contact with She documented that she had interviewed CCSM2 on March 30, 2023, while visiting the center. CCSM2 denied that any staff tell the children to kick other children back. She has not seen any type of retaliation or yelling or swearing with staff against children. She denied ever seeing anything inappropriate with CCSM 1 and the children at the facility. .................

On December 1, 2021, I interviewed the complainant. She said that there are usually two caregivers on the infant side and two caregivers on the toddler side of the infant/toddler classroom that is divided by a half wall. She wasn't sure how many children are usually present on each side, however. On December 2, 2021, I made an unannounced onsite inspection to the child care center. I interview program director Sharika Boden. She stated that the center has always been within proper caregiver to child ratios since she started at the center on 3 September 20, 2021. The infant/toddler classroom has been closely monitored since the last complaint and that they have hired three new caregivers since then. She confirmed that the capacity on each side of the classroom is eight children. When I observed the classroom there were four children with one caregiver on each side. This is within proper caregiver to child ratios. While at the center, I interviewed infant caregiver Kim Edwards and toddler caregiver Jada Beaver. Both Ms. Edwards and Ms. Beaver denied being out of ratio. I attempted to contact nine parents of children currently enrolled in the infant/toddler room. As of the date of this report, I have heard back from five parents. Child A's mother said that there are usually six children with two caregivers on each side of the infant/toddler classroom. Child D's mother, Child E's mother, Child G's mother, and Child H's mother couldn't give a specific number of children and caregivers in the infant/toddler classroom but none of them had any concerns about there being too many children for the number of caregivers present.

Program director Sharicka Boden denied any knowledge of utensils being used for more than one child in the infant/toddler room. She said that no one had complained about this, and she had never witnessed this. While at the center, I interviewed infant room child care staff member Kim Edwards. She denied ever using a utensil for more than one child. She said when she feeds toddlers, she puts the plates close to another but always has a specific spoon for each child. I also interviewed Jada Beaver, who works on the toddler side of the infant/toddler room. She denied ever using a utensil for more than one child and denied seeing any other caregivers do this. I interviewed five parents of children in the infant/toddler room and the only one who stated that they had witnessed this was the complainant. While at the center, I was able 4 to observe the window through which the complainant stated that she saw this. It is difficult to see into the infant/toddler classroom from the front window as it is approximately 5 ft. from the sidewalk that parents use. While I did observe a feeding table near the window, it would be difficult to accurately see children being fed.

On September 14, 2021, I received a text message from Child A's Guardian that he had an unexplained bruise on his back that she discovered during bath time that evening. She did not know where the bruise came from. The text also included a picture of a quarter sized bruise on his back. On September 15, 2021, I interviewed Child A's Guardian. She stated that since Child A is non-verbal, he is unable to state what happened to him or how he obtained the bruise. When she picked him up from the center yesterday, he was in the office with Ms. Jones and Ms. Garland, which is not typical. She asked if anything had happened or why he was in there and she was told that there was no reason. The next day she took him to the doctor to be assessed and treated. The doctor could not verify where the mark came from or what could have caused it. He informed her that it appeared fresh and was "an abrasion" of some sort." The next day she informed Ms. Walker that he had been treated at his doctor's office for the mark on his back. She also spoke with his caregiver, Ms. Garland, who informed her that Child A was "lunging" while on the diaper changing station and might have sustained the bruise during this time. This is a typical behavior for him during diaper changing, when he does not want to be changed. Although she is skeptical of the center's explanation, she cannot ultimately say how he obtained the bruise. She was not aware of the bruise before that day. On September 22, 2021, I completed an onsite inspection at the center. Ms. Jones, Ms. Walker and Ms. Garland were not present or available for interview. I interviewed Ms. Breckenridge and Ms. Bogan regarding the bruise on Child A. They were vaguely aware of the bruise but explained that they were both new to the center since Ms. Jones is no longer program director at the center. They were informed that Child A may be leaving the center soon (due to ongoing concerns from Guardian 1) while new child care is being secured. Ms. Walker was working when bruise was brought to their attention, but she is not working and is off on personal leave for the moment. Ms. Breckenridge spoke with Ms. Garland, who had said when she was changing him, he was trying to get off the table. He has had this behavior before and he thrashes around. She would not rj have noticed a mark since it was on his back and no one would see a mark on his back while diapering him laying down. Neither staff member was aware that medical treatment had been sought to assess the bruise. They did not report that medical treatment had been sought because they did not have reason to believe that the injury had been sustained at the center. On September 23, 2021, I attempted to contact Ms. Walker but she did not answer. I left her a voice message. In addition, I called Ms. Garland and was unable to leave a voice message. On October 08, 2021, Department of Health and Human Services worker Elvira Hernandez contacted me regarding the bruise on Child A. Ms. Hernandez stated that she was investigating the mark on Child A. Child A is no longer attending the child care center. On October 13, 2021, I interviewed Ms. Hernandez. She received a copy of the medical records for Child A and the bruise was unable to be established as a result of abuse. It was diagnosed as a linear bruise with redness and the child was able to perform a full range of motion. Child A is unable to verbalize what happened due to his limited capacity for verbal communication.

On August 20, 2021, the complainant stated that Ms. Abron was caught sleeping by Ms. Chambers next to a toddler at naptime and she was verbally reprimanded for this. This was two weeks before she was terminated. Ms. Jones has also slept next to the toddlers during naptime. This was the day after her birthday and she was hungover. The children are not being supervised when the staff are sleeping. On August 25, 2021, I interviewed Ms. Jones. She has never observed Ms. Garland or Ms. Abron high on the job or observed them smelling like this. She denied ever sleeping on the job during naptime. One time Ms. Chambers observed Ms. Abron sleeping on the 10 job during nap time and she was given a verbal warning. They do not perform drug tests on staff members prior to working in the center. On August 25, 2021, I interviewed Ms. Chambers. She denied ever smelling pot on any of the staff at the center. She did not recall anyone sleeping on the job. One time she was walking through the center and observed Ms. Mosley with her eyes closed. On August 25, 2021, I interviewed Ms. Walker. She has smelled "pot" on Ms. Garland but she did not think she was high though. She observed Ms. Abron laying on the floor one time during nap time and she needed to remind her to get up. Staff need to stay busy during naptime or else they get lazy or sleepy themselves. They are expected to clean and pick up once the children are all asleep. She observed Ms. Jones lay down a couple of times when she was assisting with the children during naptime. She never seen her sleeping though. On August 25, 2021, I interviewed Ms. Garland. She denied ever being "high" at work. One of her relatives drops her off at work and they smoke pot in the car, so she probably smells like it from them. She denied ever sleeping on the job or during nap time. She admitted that she lays down with the children to help them fall asleep. Ms. Jones has told her that she laid there too long and that she needs to get up and clean or do other work. On August 25, 2021, I interviewed Ms. Edwards. She has observed Ms. Abron sleeping at work before many times during nap time. The office personnel (Ms. Chambers or Ms. Jones) would come down and say something since they can see the staff on the cameras. Nothing ever happened though. She has smelled pot on both Ms. Garland and Ms. Abron. Ms. Garland is always dancing around the room and acting extra silly, so she is not sure what this behavior comes from. On August 25, 2021, I interviewed Ms. Mosley. She has observed Ms. Garland, Ms. Abron, Ms. Jones, and other previous workers sleeping by the children when they nap. They just lay down next to the children and pretend they are patting them and putting them to sleep. Then they lay there and sleep too. She has smelled pot on Ms. Garland and Ms. Abron many times. On August 25, 2021, I interviewed Ms. Bieber. She heard Ms. Abron and Ms. Garland talk about "being high" all the time. She observed them to physically act like they were out of it. They would tell Ms. Jones about it and she would get high too. Multiple staff would sleep on the job at naptimes. She observed Ms. Garland and Ms. Abron grab extra blankets from the office and take them with them to lay down with the children so they could sleep. Ms. Jones laid down in the office one time because she was tired from whatever she did the night before. On September 03, 2021, I interviewed Ms. Elliott. She denied seeing any staff sleep during naptime or come to work high. 11

On August 20, 2021, I interviewed the complainant. The complainant stated that there was a recent outbreak of HFM disease and that the center staff did nothing to contain it. They were not deep cleaning the center and they continued to allow children to attend even once they had it. The staff are super lazy about cleaning and only spray items down with bleach water and do not follow the three-step process of proper sanitization. On August 25, 2021, I interviewed Ms. Mosley. Recently they have had HFM go around the center. There has not been a deep cleaning. They are using the normal bleach spray bottle and vacuum occasionally. They have had thousands of ants on the carpet for a long time. They have had 2 mice in the break room. Child B still has a current case of HFM and is attending the program today. On August 25, 2021, I interviewed Ms. Jones. Recently they had an outbreak of HFM in the infant and toddler room. She and Ms. Walker came in and performed a deep clean of the building. Last week she helped clean during nap time and before they opened. The staff have been cleaning and sanitizing everything. She posted that HFM was going around in all of the rooms. Per their sickness policy, they do not allow children to attend the center if they have a current case of HFM disease because it is so contagious. On August 25, 2021, I observed Child B. She had several dozen small bumps and marks all over her face, torso, back and arms. Ms. Jones denied that Child B has HFM currently. Her parents say that it is eczema and she has a doctor's note for this. I was provided with a doctor note dated August 22, 2021, that Child B has eczema. On August 25, 2021, I interviewed Ms. Walker, Ms. Garland, and Ms. Chambers. They all acknowledged that they recently had a HFM outbreak in the center. They have been cleaning and sanitizing the rooms. They posted the note for parents to see. Ms. Chambers stated that she deep cleaned the center with Ms. Jones when it first started. IN addition, they had the carpets done over the weekend. They have sprayed and sanitized the toys. Ms. Garland stated that they took the toys off of the shelves, wiped and sanitized 12 all of the mats and equipment. They even closed the preschool room down when they first found out it started in there. On September 03, 202, I interviewed Child B's Mother. Child B has caught HFM from the center recently and this has caused her eczema to flare up. She has instructed the staff not to allow her in the sandbox because it makes it worse, and she still comes home sandy and dirty. She recently took her to the doctors for medical treatment for both the HFM and eczema, but she no longer has hand foot and mouth. On September 03, 2021, I interviewed Child D's Mother. Recently Child D caught hand foot and mouth from the center. There was a note on the classroom door that it was going around. She chose to keep him home while it cleared up, but she observed other children with it. She does not believe that the staff send all children home if they have it, like you are supposed to. She is aware that is it very contagious. On September 22, 2021, I completed a second onsite inspection of the center. Ms. Bogan and Ms. Breckenridge indicated that HFM was still going around. Ms. Breckenridge stated that recently a pediatrician informed her that "HFM is going around bad this year" and that many children are getting it. She stated that they have been cleaning and sanitizing the center even more so with the recent outbreak.

On April 21, 2021, I interviewed the complainant. She saw the bite on Child A's hip the day after he was picked up from the child care center (April 15, 2 2021). She said that Relative 1 picked up Child A on the 15th and they were not notified that he had been bit, only that Child A had had a meltdown. She stated that Relative 1 did not notice the bite on Child A until the next day. On April 21, 2021, I interviewed Child A's Mother. She confirmed that Relative 1 picked Child A up from the center on April 15, 2021 and noticed the bite on April 16, 2021. She called the center and stated that they were not aware of any bite. She did not see the bite on Child A until April 17, 2021 and stated that it was round and had teeth marks. It was located on his flank and she said that it appeared to be bruised. She said that there are usually 5-6 children in Child A's 3-year-old classroom with one child care staff member. Child A's Mother sent me a digital photograph of Child A's bite mark. In the picture, it appears an oval, slightly raised mark was present on Child A's left side. The mark appeared to be consistent with a bite mark from a 2-3 year old child. The skin did not appear to be broken. The photograph was reported to have been taken approximately two days after Child A had last attended the child care. On April 23, 2021, I made an unannounced onsite inspection to the child care center. I interviewed child care staff member Allyson Walker. Program director Sadiyah Jones was not present. She stated that on Monday, April 19, 2021, Child A's Mother called the center and said that Child A had been bitten at the center the prior week but did not notice it until over the weekend. Ms. Walker stated that none of the child care staff members that had worked in the room with Child A recall any knowledge of Child A being bitten. I reviewed Child A's file while at the center and did not see any previous bite reports. Child A was in attendance at the center from 2:00pm until 5:30pm on April 15, 2021. While at the center, I observed Child A's classroom. It is a large classroom divided by a half wall. I interviewed child care staff member Tia Gardner. She was present in the classroom on April 15, 2021. She was not aware of Child A being bitten at the child care center on April 15, 2021. She stated that she could not recall the last time there had been a biting incident in the classroom. She stated that Child A will hit and scream if anyone hits him, and that Child A would have told someone if he had been bitten as he tells on everything that happens. While at the center, I also spoke to child care staff member Kamari Nelson. She confirmed that she was also in the classroom with Child A on April 15, 2021. She did not recall any incident of biting with Child A. She stated that if something happens to Child A, he would have told them. She stated that Child A went outside from approximately 3:30pm — 4:00pm but that he came in early due to breaking a bin and was being cared for in the office until pick up. On April 29, 2021, I interviewed program director Sadiyah Jones. She stated that Child A's Mother informed her on April 19, 2021 that Child A had been bit at the center the previous week. She reviewed the camera footage for the date and time that Child A 3 was present at the center on that day and did not see him being bitten. She stated that Child A did go outside that day and that cameras do not record outside so that she spoke to the other child care staff that were outside with their classes and none of them witnessed anything. While outside Child A was in the care of his assigned classroom child care staff members. Multiple classrooms were outside during the same time. She said that Child A's Grandmother brought him up to the center on April 20, 2021 but Child A was not able to verbalize what had happened. Per Ms. Jones, she had been informed by Child A's Grandmother that Child A said he had been bitten by a girl, but Ms. Jones stated that Chi

On 01/20/2021 during an unannounced onsite inspection I spoke with Ms. Jones regarding the allegation. She stated on 01/13/2021 she was informed by Staff Member 3 that Staff Member 1 had witnessed Staff Member 2 spank Child A in the hallway between Gym 1 and Gym 2. Staff Member 3 took Child A down to the office with her and he had no marks on him from the incident. Ms. Jones looked at the footage on video, however, the incident was not caught on tape. Ms. Jones then interviewed Staff Member 1 and Staff Member 2. She stated that Staff Member 2 denied spanking Child A. Ms. Jones also contacted Child A's Father of the incident and informed him that Staff Member 2 was fired following the incident. She stated that Child A's Father contacted the police regarding the incident. Ms. Jones is not aware of what police agency was contacted; however, she was told by Child A's Father that the police declined to investigate because there was no video proof of the incident. Ms. Jones stated that Staff Member 2 has only worked at the center for about one month and she denied that Staff Member 2 has ever been disciplined in the past for any inappropriate behaviors towards the children at the center. Ms. Jones stated that Staff Member 3 usually worked in the classroom with Staff Member 2. On 01/20/2021 during the onsite inspection I spoke with Staff Member 3 regarding the allegation. She stated that she has never witnessed Staff Member 2 use any type of physical discipline towards the children at the center. She stated that the Beginners classroom has very active children and on occasion Staff Member 2 would appear to be overwhelmed but would always ask for a break or for someone to come into her room and help her out. On 01/26/2021 I spoke with Child A's Father regarding the allegation. He stated that he was informed immediately of the situation. He stated that the day of the incident he was shown the video of the hallway where Child A was allegedly spanked. He stated that there was nothing on the video showing the incident but was informed that Staff Member 2 was fired immediately following the incident. Child A's Father stated that Child A had no injuries from the incident and did not appear to be traumatized by the incident. He stated he has kept Child A home with him for a short period of time but intends to return Child A to the center for care because he has never had any concerns or issues with the center prior to this incident. (Child A did return to the center for care on 02/01/2021 per Ms. Jones). 3 On 01/26/2021 I spoke with Child B's Mother regarding the allegation. She stated that she has never had any issues or concerns with the care and supervision that Child B receives while she is at the center. On 01/26/2021 I spoke with Staff Member 2 regarding the allegation. She denied ever spanking Child A or any other child at the center. She stated that she has been working with children of all ages at different centers since 1990 and has never been accused of using physical discipline on a child. She stated that she loves children and enjoys working with them and would never lay a hand on a child. She stated that she was sitting with Child A on her lap during nap time because he did not want to nap on this day. She was then called down to the office and informed about the allegation. On 02/23/2021 I spoke with Staff Member 1 regarding the allegation. She stated that on the day of the incident (1/13/2021) she was in the Beginners Room (3-4- year-old children) with Staff Member 2. She stated that the children were getting ready to go down for a nap and Child A did not want to nap. Child A stated that he had to use the bathroom. Staff Member 2 told Child A that he needed to lay down and take a nap. Child A then ran out of the room and hid in the hallway. Staff Member 2 immediately followed him out into the hallway and spanked him one time on his bottom. Staff Member 1 stated that she saw this through the window in the classroom. No other s
