(3) Non-severe and developmentally appropriate discipline or restraint may be used when reasonably necessary, based on a child's development, to prevent a child from harming himself or herself or to prevent a child from harming other persons or property, excluding those forms of punishment prohibited by subrule (2) of this rule.

    On 04/17/2023, I interviewed Child A's Mother who stated that when she drops him off at the center, occasionally he will "throw a fit" and she has to leave for work while he remains upset. On 04/11/2023, when she dropped him off, she observed him standing at the door attempting to run after her. She added that this occurs frequently. When she arrived to pick him up at the end of the day, CCSM1 notified her after she left, "he threw himself to the ground, and so I stood over him and clenched him in between my legs to stop him from moving. Then I tried to pull him off of the floor and that's when he hit me on my chest and grabbed my necklace." She informed Ms. Hiler of the incident and was told that she would get back with her once she looked into it further. She is unclear on why she was not able to review the cameras during the time of the incident. He did not obtain any mark, injury, or medical treatment. On 04/20/2023, I completed an unannounced onsite inspection at the center from 1:25 pm — 2:40 pm and interviewed Ms. Hiler and CCSM1. Ms. Hiler received a text message from Child A's Mother in the evening of 04/11/2023 and was notified of her concerns. She spoke with CCSM1 who confirmed that she only restrained Child A to prevent him from leaving the room and the building and potentially hurting himself by throwing his head onto the floor. She confirmed that the videos were not available from that day as they are on a loop and are not taped. Ms. Hiler added that she would follow up with Child A's Mother and come up with a written plan on how to better address his difficulties when he is dropped off at the center, to prevent future issues. She has never observed CCSM utilize inappropriate discipline with a child. CCSM1 confirmed that when Child A's Mother dropped him off at the center on the morning of 04/11/2023 he began kicking and running toward his mother as she was exiting the building. CCSM1 tried to redirect him unsuccessfully as he threw himself to the floor while kicking the air, in an attempt to kick her. He then reached up and grabbed and pulled on her necklace, resulting in it breaking. He then hit her hard on her chest. He was thrashing his arms, legs, and head. She was concerned for his safety; in that he could obtain a head injury by banging his head on the floor. This all occurred in the doorway of the entrance to the room, with the door exiting the center in close proximity. To prevent him from potentially injuring himself or running out of the center, she stood over him and gently clenched his legs with hers to prevent any further movement that could cause an injury. A few seconds later he stopped, and she was able to comfort him. He did not present any complaints or injuries to her. She stated that she has never inappropriately disciplined a child. On 05/09/2023, I left a voicemail message for CCSM's 2 and 3 and could not leave a voicemail for CCSM 4, as the cell phone was not accepting such. I called the center 3 and spoke with Ms. Hiler who stated that she would have CCSM3 call me back later in the day and CCSM's 2 and 4 would call me tomorrow, as they were not at the center. CCSM3 confirmed that Child A often kicks and hits other children and CCSM's. She did not observe the incident on 04/11/2023 as she was caring for other children. She heard a bit of noise but was not concerned as she knew CCSM1 would manage any scenario. She has never witnessed CCSM1 inappropriately discipline a child. On 05/10/2023, I called the center in the afternoon, when I did not receive a call from CCSM's 2 or 4. Ms. Hiler stated that she misunderstood and did not have them call as she thought I would be calling the center. CCSM2 confirmed that she was not at the center at the time of the incident, as she was dropping her child off at school. She has never witnessed CCSM1 inappropriately discipline a child.     On January 29, 2021, licensing consultant Juli Gohl interviewed the complainant. She was at the center (in the foyer area) on 1/25/2021 and overheard through a closed door a female adult, she thinks a child care staff member (CCSM) (as parents are not allowed in the building), yell at the children on the "big kid side" (did not recall what was said, just that she was yelling in a loud voice and mean). The complaint was not sure which CCSM or child(ren) were involved. She texted program director Venita Hilier the same day and notified her. She also stated that at approximately 12-1 pm on 1/27/2021, again through the closed door on the big kid side, she overheard a female adult, she thinks a CCSM, say that she wanted to punch the kids in their face. On February 2, 2021, I made an unannounced onsite inspection to the child care center. I interviewed licensee designee and program director Venita Hilier. Ms. Hilier stated that a parent had texted her about a CCSM raising her voice to children but there was nothing specific in terms of what the CCSM said and the parent did not know who the CCSM was. While Ms. Hilier admitted that sometimes staff raise their voices to children in care, she denied ever hearing anything inappropriate and she was not aware that it was alleged that a CCSM threatened to punch a child in the face. Ms. Hilier stated that there has been issues with behaviors with the older children and she has reached out to Melanie Berry at Child Care Connect regarding assistance with dealing with challenging 3 behaviors. She stated that Ms. Berry is currently virtual only and has not been able to physically be at the center for this. Ms. Hilier said that she can hear most of what is going on in the older children's classrooms as her office is on that side of the child care. While at the center, I was able to obtain attendance records to determine which CCSMs and children were present during the dates that the complainant indicated she had heard a caregiver yell and threaten a child/children. While at the center, I was able to interview the three CCSMs who were working in the older children's classrooms on both dates. Kaisha Buchanan stated that she works in the Preschool and School age-areas of the building and that she has had to raise her voice when children were fighting. She said that there are about four children that have a tendency to fight so she has had to yell at them to stop, but she denied that she ever threatened a child or heard anyone other CCSM doing this. Imani Brooks stated that she is a floater that works in the big kids' area of the center, although tends to be on the infant/toddler side more often. She denied threatening a child or hearing another CCSM do this. She stated that she sometimes has to raise her voice to the children but denied yelling or that she has heard another CCSM do this. She stated that discipline is taking a child to the side and talking to them and getting Ms. Hiller involved. Parents are contacted as a last resort for behavior issues. Maria Ramsey denied ever yelling at or threatening children and has never heard another CCSM do this. She has heard a CCSM raise their voice and say something like "guys, settle down." Discipline is to have a child go to the office and contacting parents. I attempted to contact the parents of 13 children that attend the child care and are in the preschool and/or school-age classrooms and were present on at least one of the dates where it was alleged a CCSM yelled at or threatened a child. As of the date of this report, I have only heard back from one parent. Child L and M's Mother denied ever hearing a CCSM yell at or threaten a child. Neither of her children have ever disclosed that this has occurred. Child L and M had no concerns regarding any of the CCSMs working at the center.
