    R 400.8110 · R 400.8110 Applicant; licensee; licensee designee; requirements. (7) A child shall only be released to persons authorized by the child's parent or guardian.

    On 05/05/2022, 1 received an email from program director Chanda Toal notifying me that a child was released to an individual that was not on 2 the child's emergency card. This occurred at the time of parent pick up and the child was accidentally placed into the wrong vehicle. The car never left the parking lot and the child was placed in the correct vehicle. She stated that she would follow up on 05/06/2022 with a written report of the incident. On 05/06/2022, I emailed Ms. Toal, confirming that I received her email notification regarding the incident. Later that day I received the written incident report from Ms. Toal which stated that at the time of parent pick-up, child care staff member (CCSM) Laura Baker had mouthed to a male and female in a vehicle if they were there for Child A; the male affirmed by nodding. Ms. Baker used the handheld radio receiver and notified CCSM Barbara Rouse that she could bring Child A out to the vehicle. Ms. Rouse did so and spoke to the female passenger and confirmed that she was Child A's Grandmother and the driver was Child A's Grandfather. Ms. Rouse clarified that Child A called the male papa and spoke with him. The female buckled Child A into the back seat of the vehicle. Meanwhile, Child A's Mother pulled in front of this vehicle and Ms. Baker approached the vehicle and said, "Child A is with Grandpa." Child A's Mother replied "What?" Ms. Baker started toward the vehicle that Child A was in and held her hands up as in motioning them to stay put. The male opened his window and Ms. Baker told him that Child A's Mother was here. The male replied that they were there for Child B (male, 4 years). At this time, Child A's Mother approached this vehicle, opened the door, and got Child A out. The male and female apologized to Child A's Mother as she took Child A to her vehicle. It was determined that the male and female were Child B's Grandfather and Grandmother. On 05/06/2022, I interviewed Child A's Mother who explained that on 05/05/2022 she arrived at the center earlier than she normally does, at approximately 3:27 pm. She noticed another vehicle was in front of her and another one was behind her. An unknown CCSM came to her vehicle's window and told her that Child A was already picked up and motioned to the vehicle behind her. She watched this CCSM walk up to this vehicle's window and heard her say to the male and female in the car, "You have the wrong child." She heard the female in the car say, "This is our grandson." Child A's Mother already got out of her vehicle and approached their vehicle, so was in close proximity, and opened the door of the vehicle to remove Child A. Then she heard the female in the vehicle say "Oh, I wouldn't have left with him." She was frustrated so did not stay and listen to the explanations. She had to leave to go and pick up her other child from his bus. She explained later that day that she received calls from two different people from the Genesee Intermediate School District. It was explained to her that their vehicle and the vehicle that Child A's Grandfather, who often picks up Child A, looked alike and the male in the other car also looked like Child A's Grandfather. She does not understand this explanation, as their car was black and Child A's Grandfather drives a gold car. On 05/08/2022, Ms. Toal submitted a written safety plan stating that she would meet with all CCSM's to review the updated pick-up procedures that they implemented immediately. 3 On 05/10/2022, I completed an unannounced onsite inspection at the center from 2:22 pm — 3:30 pm and interviewed Ms. Toal, Ms. Baker, and Ms. Rouse. Ms. Toal explained that on 05/05/2022, she was outside assisting with parent pick up. As soon as Child A's Mother pulled up, she heard Ms. Baker tell her that Child A was back there, motioning to the vehicle behind Child A's Mother. She observed that Child A's Mother looked concerned, immediately got out of her vehicle, quickly went to the vehicle behind her and go

    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 02/18/2021, I received a telephone call from Paula Scott, Early Childhood Education Manager with the Genesee Intermediate School District (GISD) who notified me that on 02/17/2021 CCSM Deja Anderson reported that she saw CCSM Marissa Evans "pop" Child A and Child B on their hands. Ms. Scott did not have any additional details as the GISD was still gathering information and she stated that a written Incident Report would be submitted to me. Ms. Scott added that Child A and Child B did not obtain any marks or injuries from the alleged incident and did not receive any medical treatment. Ms. Scott stated that Child A and Child B's parents were notified of the allegations. On 02/19/2021, I received the Incident Report from the GISD. The written report did not address the alleged feeding incident regarding Ms. Evans and Child A or the alleged incident regarding Ms. Evans hitting Child A's buttocks. On 02/22/2021, I completed an unannounced onsite inspection at the facility from 12:20 pm - 3:30 pm and interviewed program director Chanda Toal, Ms. Fecher and Child Care Staff Members (CCSM) Deja Anderson, Jamie Roy, Roxanne Turnbow, Brianna Haywood, and Tina Ishmael. Ms. Toal stated that she was not involved with the reported incidents and although she is approved as the program director for the facility, she acts in this role only for the early childhood portion of the license and not the child care portion. Ms. Toal clarified that Child A and Child B attend the child care portion of the license and she thought that Ms. Turnbow was the program director over that portion of the license. Ms. Toal was not notified of the allegations regarding Ms. Evans "popping" Child A and Child B's hands until 02/18/2021. Ms. Toal stated that Ms. Fecher arrived at the building and told her that Ms. Scott was on her way to the center and would update her on the allegations. Ms. Toal stated that when Ms. Scott arrived at the center, she was updated on the incident. Ms. Toal confirmed that she has never observed any inappropriate or physical discipline with any CCSM's. Ms. Toal clarified that she was made aware of two different scenarios: Ms. Anderson observed Ms. Evans "pop" both Child A and Child B's hands and the other scenario was that Ms. Anderson only observed Ms. Evans "pop" Child A's hand and heard what she thought was Ms. Evans "popping" Child B's hand. Ms. Toal understood that "popping" was referring to slapping with an open hand. Ms. Toal was not aware of any other reported incidents. Ms. Fecher stated that she comes to the facility a couple of times a week and works only with the child care portion of the license. Ms. Fecher clarified that she was notified by Ms. Turnbow that Ms. Anderson saw one incident in which Ms. Evans "popped" Child A's hand and heard the other incident in which she thought Ms. Evans "popped" Child B's hand. Ms. Fecher added that she understood "popping: to be slapping. Ms. Fecher reported that Ms. Anderson told her that she observed both incidents. Ms. Fecher stated that she and Ms. Scott discussed the inconsistencies in observing both incidents or observing one incident and hearing the other incident. Ms. Fecher stated that Ms. Anderson frequently went back and forth regarding her recollection of what she observed and/or heard, regarding the incidents. Ms. Fecher overheard Ms. Anderson say that the week of 02/08/2021 she also observed Ms. 4 Evans place Child A over her arm and "pop" her on the buttocks with an open hand over her clothes/diaper. Ms. Fecher was not aware of the allegations regarding Ms. Evans shoving food into Child A's mouth or shoving Child C's thumb into his mouth. Ms. Fecher clarified that she has not spoken to any other CCSM's about the reported incidents. Ms. Fecher reported that she never observed Ms. Evans or anyone else in the center raise a hand to a child or use any form of physical discipline.
