On 4/14/2026, Teacher 1 and Teacher 2 did not provide appropriate care and supervision of Child A. Child A was left unsupervised in the preschool classroom for approximately 27 minutes.

This was confirmed using the Face to Name sheets that the child care center uses to sign children and staff in and out daily.

On 9/23/2024, I observed nine children with two child care staff members present in the infant classroom. According to the attendance records, the Infant 1 room was not within required ratios on the following dates: 9/9/25, 9/12/25, 9/17/25, 9/18/25, 9/19/25, 9/20/25, 9/24/25, 9/25/25, 9/26/25 and 9/27/25.

On 09/15/2022 I spoke with Child E's Mother. She stated on 09/14/2022 she was watching the center's camera feed of the preschool classroom. The children in the classroom were finishing their lunches and getting ready for naptime. Child E was lying on a cot, and Ms. Belanger grabbed Child E by the arm and threw the blanket over Child E. Child E's Mother stated she spoke with the assistant director Ms. Whitne Campbell who stated they reviewed the camera footage and did not see Ms. Belanger do anything wrong. On 09/19/2022 I completed an on-site inspection to the center and interviewed program director Kristy Carmichael. I asked Ms. Carmichael if she had reported this allegation to Licensing. She stated she had left a voicemail message for consultant Jennifer Koluch on 09/15/2022. I confirmed with Ms. Koluch that Ms. Carmichael had left a voicemail for her on 09/15/2022. I advised Ms. Carmichael to send a written incident report about this allegation, which she emailed me on 09/19/2022. Ms. Carmichael stated she was not at the center on 09/14/2022 when the alleged incident occurred, but assistant program director Whitne Campbell was at the center at the time. Ms. Campbell told her Child E's Mother showed up at the center on 09/14/2022 at naptime and spoke with Ms. Belanger and Ms. Campbell. Ms. Campbell informed her (Ms. Carmichael) that Child E's Mother felt Ms. Belanger was "singling out" Child E because there were other children also not settling down at naptime; however, Ms. Belanger focused on Child E. Ms. Carmichael stated after Child E's Mother spoke with Ms. Belanger and Ms. Campbell she left. Child E stayed at the center for the rest of the day. Ms. Carmichael stated since that day Child E has been attending daily. Child E's Mother asked Ms. Carmichael if Child E could be moved to a different classroom. Ms. Carmichael told Child E's Mother that she (Ms. Carmichael) did not want to put Child E back in a toddler classroom and there were no other preschool classrooms to move Child E, so Child E has remained in Ms. Belanger's preschool classroom. Ms. Carmichael stated she has not heard of any further concerns from Child E's Mother. Ms. Carmichael informed me that Child E wears hearing aids, which staff take off during naptime. I asked Ms. Carmichael the reason staff take off Child E's hearing aids at naptime. She stated all she knew was Child E's Mother asked staff to do this. I asked Ms. Carmichael if Child E was able to hear anything when the hearing aids were removed. Ms. Carmichael stated she did not know. Ms. Carmichael stated she spoke with Ms. Belanger the next day 09/15/2022. Ms. Belanger stated at naptime she told Child E to go to her cot and then took off Child E's hearing aids. Ms. 3 Belanger stated she did go over to Child E, but she did not make a face at Child E or grab Child E. During the on-site inspection, I observed the preschool classroom around 1:00pm. The children, including Child E, were all lying on cots. Child E was asleep. Ms. Belanger was sitting at a table in the classroom. I interviewed staff Sara Belanger. She has worked since January 2021 in the preschool classroom. Child E moved into the preschool classroom at the end of August 2022. Ms. Belanger stated she typically has to ask Child E multiple times to do something, but Child E has no major behavior issues. Ms. Belanger stated Child E wears hearing aids which she and other staff take off at naptime as requested by Child E's Mother. I asked Ms. Belanger if she knew the reason for this and Ms. Belanger stated she was not sure if it was so Child E would rest better or for some other reason. Ms. Belanger stated she usually works alone in the preschool classroom, but if a second staff is needed to maintain ratio, she works with Trina Girty or Brittany Appiah. Ms. Belanger stated 09/14/2022 was a typical day. She was the only staff in the preschool classroom during lunch and at the beginning of naptime. The children were using the bathroom after the

Based on my review of video footage of the preschool classroom from 09/14/2022, my observation of the staff interactions with the children in the preschool classroom, and interviews with staff; Ms. Belanger did not use any prohibited punishment with Child E.

On 05/3112022, Ms. Carmichael (program director) submitted an incident. The incident report said that on 05/27/2022 Child A told his parents that Staff Member A touched him inappropriately on the playground. Staff Member A was placed on administrative leave during the investigation. On 06/07/2022 I met with Child A's mother and ChildA's father. Child As mother stated tha ild A has recently started having nightmares. On 05,27/2022 Child A became "hysterical" when they tried to turn off his night light at bedtime. When Child A's mother asked him to tell her why he was so upset he said, "I can't tell you". Then Child A's mother asked if Child A cannot tell her "because someone told him not to tell her?" Child A responded by saying that Staff Member A said, "Don't tell nobody". Child A's mother then asked Child A if someone had touched him? Child A then said that Staff Member A "rubbed in the middle on my while they were outside on the playground. The area he described on the y ground was by the fence facing the parking lot. Child A's mother and father denied having any past issues or concerns with the center or Staff Member A. On 06/13/2022 an announced on-site inspection was completed at Tutor Time Learning Center. We interviewed ris y Carmichael programWirec ), Staff Member B, Staff Member C, and Staff Member D. Interviews were conducted privately in the program director's office. Ms. Carmichael stated that on 05/3112022 around 9:00am, Child A's mother and Child A's father came into the center and approached her with some concerns. They stated that Child A had been having nightmares for weeks and not wanting to be Ica alone. Child A disclosed to them that Staff Member A had touched his under his clothes. They believe this occurred while on the playground outside. They also stated that Staff Member A told Child A not to tell anyone. Child A's parents were unable to tell Ms. Carmichael an estimate of when this incident might have occurred. Child A is enrolled in the PreK classroom. Child A's parents kept Child A home from the center for a week but decided to have Child A return to the program. Staff Member A is still on administrative leave. Ms. Carmichael denied having any current or past concerns with Staff Member A's behavior towards any of the children. Ms. Carmichael denied receiving any parent or staff complaints involving Staff Member A. Ms. Carmichael stated that she was shocked when she heard the allegations. Staff Member B stated that she has worked with Staff Member A since 02/2022. Staff Member B denied ever having concerns with the way Staff Member A interacts with the children and denied that she ever witnessed Staff Member A touching a child inappropriately. Staff Member B stated that there is usually more than one class outside on the playground at a time, and there are typically 40 children with 4 staff members. All staff members spread out so that the children are within their sights. Staff Member B denied that she saw Child A acting differently or scared of Staff Member A. Staff Member B stated that she would find it hard to believe that Staff Member A would ever touch a child inappropriately. Staff Member C stated that she never saw any of the PreK staff members touch or act inappropriately with any child. Staff Member C denied ever hearing complaints about Staff Member A. Staff Member C stated that the preschool classroom often goes outside with the PreK classroom, and they sometimes combine classes when their attendance is low. Staff Member C stated that when the children are outside on the playground, the staff members position themselves around the playground so that they can visually see all the children. Staff Member D stated that she has never seen Staff Member A act inappropriately with any of the children, though she did state that she sometimes hears Staff Member A talk to the children in "harsh tones". On 10/8/21, Child A's mother called to state that on 9/17/21, Child A came home with wet clothes since her diaper was soaking wet with urine. Child A's mother said that this had happened a couple of times earlier, but she had not mentioned it to anybody at the time. Child A's mother said that Child A had a urinary tract infection because of this. After the incident on 9/17/21, she brought this to the attention of the program director, Ms. Black who told her that she would find out about it. Child A's mother was not sure of the dates of the previous incidents and did not know the names of the staff members in Child A's classroom. Child A's mother said that since this was an ongoing problem, she was pulling Child A from care at the center. Child A's mother said that she always got all details about the diapering when Child A was in the 2-year-old classroom. Ever since Child A had been moved up to the 3-year-old classroom, there is no documentation of times of diapering. Child A's mother said that she got the report for 9/17/21 where the diaper was changed at 9:23 am and no diaper change was recorded after that. Child A was at the center on 9/17/21 from 9:23 am to 4:30 pm. Child A's mother confirmed that Child A wears pull ups. On 10/13/21, I conducted an unannounced, onsite inspection at the center. Kristy Carmichael is the current program director. Ms. Carmichael said that she was on maternity leave and was not aware of the situation. She indicated that Kimberly Black was the acting program director. On 10/13/21, I checked the ratio of the number for children in the classroom to the number of staff members for 9/17/21 and the ratio was appropriate. Child A was in the Early Preschool classroom from 9:23 am to 10 am and moved to the preschool room at 10 am. A diaper change was documented at 9:23 am. From 10 am onwards she was in the preschool room until she was picked up. On 10/13/21, I interviewed Sara Belanger who said that she was the assistant staff member in the classroom but was acting as a lead caregiver since the lead caregiver was not present. She said that a lot of children in the class are in pull-ups, and they check them every day when the children arrive, 11 am, 12:45 pm before nap time and after nap time. She said that she did not recall if she changed Child A's pull-up that day or somebody else did it. Ms. Belanger said that Child A's mother had never made a complaint about this previously or brought it to her attention at any time. Ms. Belanger said that Child A's father had sent a message on the school network (Brightwheel) asking about the pull-up change on 9/17/21, late in the evening. The next day, the acting director had asked about the pull-up change for Child A, and she told her that she mostly changed the children in the morning hours and was not sure about the afternoon. Ms. Belanger said that she never had any contact with Child A's parents about the incident. Ms. Belanger said that management recommends they document the changes for older children, but it is not always done. Ms. Belanger said that Child A had transitioned into their room only about 3 weeks ago. On 10/13/21, I interviewed Ms. Girty who said that she was a floater and that when she was in the preschool room, she changes any child that the staff member tells her to change. Ms. Girty said that usually the diaper/pull-up changes are at about 9 am, 11 am, before nap time, after nap time and 5 pm. Ms. Girty said that she was not sure if she changed Child A's pull-ups on 9/17/21. Ms. Girty said that she tries to remember to document a all changes in the preschool room but may have forgotten to document it. On 10/13/21, I interviewed Ms. Hall who said that she was the one that does diapers/pull-up changes in the preschool room. Ms. Hall said that most of the childre
