On 11/11/2024, CCSM-1 provided appropriate care and supervision of Child A. During morning circle time, Child A experienced a tantrum in which he threw himself backward and struck the half-wall divider. CCSM-1 followed the center’s policy and completed an incident report.

On 07/27/2022 1 received an incident report from Lindsay Towne (program director). The incident report stated that on 07/27/2022 at 9:30am Ms. Towne received a phone call from Child B's mother. Child B's mother said that Child B disclosed to her the previous night, that he and Child A had locked themselves 2 into the bathroom together and showed each other their penises. Child B said that Child A then asked him to "try sucking on his penis" but indicated that he responded by saying no. Child B said that he and Child A had showed each other their penises on numerous occasions in the past but this was the first time that Child A asked him to "suck on his penis". It is unknown when this incident occurred. On 07/27/2022 I interviewed Ms. Towne via telephone. Ms. Towne stated that Child B was recently moved to the school-age classroom due to ongoing behavioral issues. Ms. Towne indicated that the school-age bathrooms are the only classroom bathrooms in the center that have locks on them. Ms. Towne said that staff members give the school-age children privacy while using the bathroom but indicated that most children do not lock the doors. Ms. Towne said that there are not usually issues with the children trying to go into the bathrooms together and denied receiving any complaints prior to this incident. Ms. Towne stated that Child B has a history of behavioral issues and has been on their behavioral plan (ABC chart) to document his behaviors and communicate with his parents. Ms. Towne denied having any past issues regarding Child A's behavior. Ms. Towne stated that she has no concerns with the staff members that work in the school-age classroom and believes that they supervise the children appropriately. On 07/28/2022 I spoke with Child A's mother. Child A's mother stated that she spoke with Child A regarding the allegations. Child A told her that Child B came into the bathroom with him and started to take his clothes off, at which time Child A left the bathroom. Child A did not mention anything about either of them showing each other their penises, or that this type of behavior had previously occurred in the bathroom or anywhere else at the Center. Child A did not disclose any inappropriate sexual touching. Child A's mother stated that she does not believe this incident occurred at the center and has no concerns with the care and supervision provided by the center. On 07/28/2022, I conducted an unannounced on-site inspection. I interviewed Emily Ellegood (lead preK caregiver), Elizabeth Norris (school-age caregiver), and Vindya Wikkramaarachchige (school-age caregiver). Ms. Ellegood stated that Child B was in the preK classroom until recently. Child B has been having ongoing behavioral issues and is on a behavioral plan. Child B grabs and hits staff members and had previously grabbed her breast and punched her in the stomach. On 07/20/2022, Child B was moved to the school-age classroom due to these behavioral issues. This recent classroom move, in addition to daily reports of Child B's behavior and behavioral charts, are sent home with him at the end of each day. Ms. Ellegood stated that Child B also has a history of walking into the bathroom while other children are using the facilities and attempting to take his clothes off and run around the classroom. Ms. Ellegood denied ever observing or hearing about an incident involving Child B touching another child inappropriately or being touched by another child. Ms. Ellegood stated that the school-age classroom has locks on their bathroom doors but indicated that the staff members have keys to 3 the bathrooms in case a child gets locked inside. She denied having any concerns with the school-age caregivers' abilities to supervision the children. Ms. Norris stated that she works in the school-age classroom and indicated that the children use the bathroom one at a time. On 03/04/2022, I received an incident report from Lindsay Towne (program director). The incident report stated that Child A is claiming that Ms. Vindya grabbed his ear while he was parking the blue bicycle by the door in the gymnasium. Child A stated that it hurt when Ms. Vindya grabbed his ear and that it made him cry. Child A's parents sent Ms. Towne pictures of a mark on Child A's ear as well as marks on Child A's arm and back. Child A is in the preschool classroom, and the incident happened while the children were in the gymnasium around 10:30am. On 03/07/2022, I interviewed Ms. Towne via telephone. Ms. Towne stated that on 03/03/2022, she returned a voicemail from Child A's mother around 6:00pm. Child A's mother informed her that Child A told her that Ms. Vindya pulled his ear while he was parking his bicycle in the gymnasium. Child A's mother claimed that this ear pulling resulting in a mark on Child A's right ear. Child A's mother sent photographs later that evening of a red mark on the back side of Child A's right ear, in addition to a red mark on his upper right arm and a scratch on the posterior of his right shoulder blade area. Ms. Towne spoke to Child A's mother on 03/04/2022 and was told that Child A also indicated that Ms. Vindya hurt him in the abdomen area. Ms. Towne stated that Child A has a history of being aggressive with other children and that staff members routinely separate Child A from the other children because he plays too rough with them. Ms. Towne denied any past concerns with Ms. Vindya and said that she has never received any complaints from parents or other staff members about Ms. Vindya's behavior towards the children. On 03/07/2022 I received the photographs of Child A's injuries from Ms. Towne. On the first photograph, a small red mark on the upper backside of Child A's right arm, right above the elbow level, is visible. The second photograph shows a small red mark on the backside of Child A's ear, right above the earlobe. A third photograph reveals red scratches on the side of Child A's upper back, at the posterior of the right shoulder blade. On 03/07/2022, I spoke with Child A's mother who stated that Child A's father picked him up from the center on 03/03/2022. On the way home, Child A was tugging at his ear and told his father that Ms. Vindya pulled his ear while he was parking the blue bicycle. Child A's mother said that later that evening while she was giving Child A a bath she noticed a red mark on the back side of his right ear, a scrape on the right side of his back, and bruising on his right upper arm. When asked what had caused these marks, Child A mentioned Ms. Vindya's name but would not give any additional information as to what may have happened. Child A's mother did mention that Ms. Towne had told her that a few of Child A's classmates got into a fight over the blue bicycle in the gymnasium and that is where some of the marks could have come from. Child A's mother said that she wishes a staff member would have looked 3 over Child A after the incident with the bicycle and maybe then they would have noticed the marks. Child A's mother stated that there were no past concerns or incidents with the center and said that Child A still attends the program. On 03/10/2022, I conducted an unannounced inspection interviewed Erica Regentin (lead discovery preschool caregiver), Ms. Vindya (Kahandawa-Wikkramaarachchige) (assistant preschool 1 caregiver), Mia Walker (assistant floater caregiver), and Sarah Miller (lead preschool 1 caregiver). Interviews were conducted privately in the program director's office. Ms. Regentin stated that Ms. Vindya works with her on a regular basis as her assistant caregiver. Ms. Regentin was in the preschool 1 classroom during naptime with Ms. Vindya. Ms. Regentin denied seeing any marks on Child A or that Child A complained about any injuries. Ms. Regentin was shocked when she heard the allegations that Ms. Vindya had grabbed Child A's ear. Ms. Regentin said

On 8/23/21, Child A's mother stated that on 8/18/21, when she went to pick up Child A from the center at about 5 pm, a child care staff member handed an incident report to her which stated that Child A was bitten on her left forearm. The report stated that Child A was playing in the tunnel on the playground when the other child bit Child A. Child A's mother said that the incident report said that the incident occurred at 4 pm and the center did not call her right away. They waited for the pickup time to report the incident. After coming back home, Child A's mother examined the bite on the left forearm and found three more bite marks; one on the back of the right shoulder, one in the armpit area and the other on the right forearm. The bite mark on the spine had broken skin. Child A's mother said that she had not seen any of these bruises/bitemarks previously. She said that she could tell that they were all bitemarks because there were sucking marks on them. She could see teeth on the most recent one on the left arm. They were deep impressions and probably happened on the same day and same time. Child A's mother had not seen any bite marks on Child A before this incident. Child A is not currently attending child care due to this incident. Child A's mother said that she took Child A to the doctor the next day and the doctor agreed that they were all bite marks. Child A's mother said that she told Ms. Towne the next morning (8/19/21) at 8 am that she took Child A to the doctor, and at about 11 am she told them that she was not bringing Child A back to the center anymore. Child A's mother provided a doctor's report and the photos of the bite marks on 10/11/21. On 10/11/21, I reviewed the doctor's report that states that there were four bitemarks consistent with the size and shape of a mouth and teeth marks by another child. The three bites on the arms and shoulder are consistent with bruising but no break in skin. There are little abrasions on the bite on the mid back but no break in skin. I 611 W. OTTAWA. P.O. Child A's mother said that she disenrolled Child A from the center since this was the second time that she had noticed lack of proper supervision. On 3/23/21, when she went to pick up her daughter, she saw that a toddler rammed his shopping cart into Child A's legs two or three times and pinned her to the brick wall. None of the staff members saw this incident since all four staff members were chatting on the playground in the shade. She said that she called out to the staff and asked them to take care of Child A since Child A was crying. Later she got a phone call from the program director, Ms. Hughes, who apologized and stated that the lead caregiver, Ms. Anderson would be on a corrective action plan for the same. On 8/27/21, I conducted an unannounced onsite inspection at the center, The center has cameras in all the child use space but does not record the events. I inspected the outdoor play area with the play structure and saw the tunnel that was attached to the playscape. The tunnel is approximately 3 to 4 feet long. On 8/27/21, I interviewed the acting program director Ms. Towne who stated that she was gone for the day when the incident occurred at the center. She said that on 8/18/21, she saw the message electronically from Child A's mother asking questions as to how Child A was bitten and wanted an explanation for the bite. Ms. Towne replied to her messages and stated that she would find out more answers the next day when she arrived at the center. The following day, Ms. Towne spoke to the lead caregiver, Ms. Regentin, and the assistant program director, Ms. Miller, who had spoken to Child A's mother the previous day. They said that they were only aware of one bite and did not know anything about the other bites. Ms. Towne said that Child A has the h

On 8/27/21, Child A's mother stated that she did not receive reports about diaper changes several times. She said that there were at least 5 occasions when Child A's diaper was not changed timely or reported on the daily report. Child A's mother sent daily reports provided by the center and found them to be inaccurate on 5/4/21, 5/5/21, 5/7/21 and 7/29/21. I also received a copy of the correspondence regarding the diaper changes for these dates from the assistant director/current acting program director, Ms. Towne. On 10/4/21, I reviewed the daily reports for Child A and found the following: 5/4/21 There were no diaper changes documented between 11:30 am and 2:51 pm since it was nap time and Child A was changed after nap time. However, there was no documentation of how long Child A slept on this day. The amount of food eaten was indicated by most and some which does not quantify the amount of food eaten. 5/5/21 There were no diaper changes documented between 9:13 am and 2:57 pm. The communication from Ms. Towne indicated that the diaper was changed but not documented. 5/7/21 There were no diaper changes documented between 9:15 am and 2:43 pm. Ms. Towne acknowledged the lack of a diaper change entry and assured that diaper changes would be accurately entered as they are done. 7/29/21 Child A's mother indicated that Child A's diaper had feces when she was picked up. The daily record indicated that Child A's diaper was 611 W. OTTAWA. P.O. BOX 30664. LANSING, MICHIGAN 48909 www.michigan.gov/lara . 517-335-1980 changed at 3 pm and she was picked up at 4:20 pm. The communication from Ms. Hughes indicated that the staff members checked her diaper before she was picked up, but it was dry. As I reviewed the daily reports, I found some additional discrepancies regarding the Documentation of food intake and amount: 5/4/21 There were no entries for lunch. 6/10/21 There were no entries for breakfast. 7/14/21 There were no entries for breakfast. None of the above- mentioned daily reports had a time of food intake for breakfast, lunch, and afternoon snack. All the entries for food indicated Most, Some or All which do not quantify the amount of food eaten.

On 8/27/21, the department received a complaint stating that the child care staff member, Child B's mother, used corporal punishment (hitting and flicking) with her own child (Child B) while at the center in front of other children. There was no more information available since the complainant did not provide any further details. On 9/15/21, I interviewed Ms. Towne who stated that Child B's mother works at the center. In the beginning of August, Ms. Anderson came to her and informed her that she had concerns about Child B's mother. Ms. Anderson said that she had seen Child B's mother hitting her daughter (Child B), flicking her and grabbing her. Within the same conversation the story changed several times in terms of location, time, and dates. Ms. Towne spoke to some of the other staff members, and nobody had seen anything. Ms. Towne had not seen anything herself. Ms. Towne said that she had discussed the matter with Ms. Hughes, and they did not take any action since 611 W. OTTAWA. P.O. BOX 30664. LANSING, MICHIGAN 48909 www.michigan.gov/lara . 517-335-1980 there was no proof that Child B's mother used any corporal punishment in front of the other children. On 8/20/21, she spoke to Child B's mother and asked her about the incidents. Child B's mother denied any of the allegations and said that she was not using corporal punishment with her child. Ms. Towne said that she provided the Child guidance Learning and Discipline policy to Child B's mother and talked to her about positive discipline with the children. On 9/15/21, I reviewed the signed document by Child B's mother stating that she will only use positive guidance with the children. Ms. Anderson did not return my call after leaving a voice message for her. On 9/15/21, I interviewed Ms. Regentin who said that she had not seen any physical punishment by Child B's mother personally, but Ms. Anderson told her that Child B's mother took Child B into the bathroom and hit her with her purse strap. Ms. Regentin said that she had never seen Child B's mother use any physical punishment with Child B or any other children. She said that Child B's mother is sometimes stern in her tone of voice but never uses any inappropriate language. Ms. Regentin said that ever since Child B had transitioned to her classroom since the beginning of the month, she had started to document the biting behaviors and it has reduced. The amount and frequency have both reduced. On 9/15/21, I interviewed Child B's mother who said that on several occasions, Ms. Anderson and Ms. Towne would tell her that Child B was biting in the classroom. Child B's mother preferred that the staff members in Child B's classroom would handle the situation without telling her all the time that her daughter was biting. Child B's mother said that she had received several reports of her daughter biting different children. Child B's mother said that she had received reports since March 2021, and she was frustrated. Child B's favorite staff member left in March, and since then she had been biting the children. She felt that Ms. Anderson was overdoing it by writing so many negative reports about Child B and calling her every time there was an issue with Child B. On the day before her birthday, Child B had bit her at home since she was very excited about her birthday. Child B's mother had explained to her that biting was bad and that she had to refrain from doing that when she was emotional. On the day of her birthday (8/3/21), she bit another child again and she was on the other end of the playground for biting a child. When Child B saw Child B's mother, she started crying and kept saying that she wanted to go home. Child B's mother was so upset with Child B that she thumped her on her shoulder. Child B's mother said that she had never done this before at the center. She said that she had threatened Child B that she would "pop" her with the purse strap or the belt at home, but she had never done it. Child B's mother said that there wer

On 9/15/21, I interviewed Ms. Regentin who said that she was that Child B's mother had slept while she was taking care of the children, but she had not witnessed it personally. On 9/15/21, I interviewed Child B's mother who said that she fell asleep once or twice in 2019 when she was 8 months pregnant. Child B's mother said that she fell asleep only when children were in nap time. It was for about 5 minutes both times and the other staff members in the room told her that she could not do that. Child B's mother said that she had not done that since then. On 9/15/21, I interviewed Ms. Towne who said that she had received a complaint in 2019 when Child B's mother had fallen asleep during nap time and in the bathroom. Ms. Towne said that it happened only once in the classroom, and she only heard about the bathroom and did not know the details of it. Ms. Towne said that Ms. Hughes handled the situation. 611 W. LANSING, MICHIGAN 48909 www.michigan.gov/lara . 517-335-1980 On 9/15/21, I interviewed Ms. Bushi, and Ms. Signorelli who said that they worked with Child B's mother for nearly 2 years, and they had not seen her falling asleep during care of the children. They said that they carry infants/toddlers to put them to sleep and close their eyes and the babies follow them and close their eyes too. Both indicated that it could be that someone had seen Child B's mother do that and assumed that she was asleep. Child B's mother is a floater but works mostly in the infant room. On 9/15/21, I interviewed Ms. Benglian who said that Child B's mother does not work with her now but used to work with her about a year ago. Ms. Benglian said that she had seen her doze off twice at different times of the day when she worked with the children. Ms. Benglian said that she recalled a specific incident once when Child B's mother dozed off after breakfast time. Ms. Benglian had to wake her up and it was a very short period. Child B's mother was not pregnant when these incidents occurred. On 9/29/21, I interviewed Ms. Hughes who said that she had never heard of Child B's mother sleeping while she was working with the children. She got a complaint once that Child B's mother was sleeping in the bathroom, and she went in to check. The door was closed. When she knocked, Child B's mother opened the door, but she does not know if she was sleeping in the bathroom. Ms. Hughes did not ask her anything. Child B's mother was pregnant at the time and was working two jobs. Ms. Hughes said that she had never heard of Child B's mother compromising supervision of the children by sleeping in the classroom.
