    R 400.8125 · .............. R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 01/18/2021, I received a voicemail from Tanya Dallo. Ms. Dallo informed me that she witnessed a caregiver acting inappropriately with a child in the toddler classroom on 01/14/2021. On 01/21/2021, I received an incident report from Ms. Dallo. The incident report stated that on 01/14/2021 at 11:30am, Ms. Dallo entered the toddler classroom and observed Ms. McGinley slap Child A on the hand twice and yank Child A by the arm. On 01/26/2021, I attempted an unannounced on-site inspection. The center was closed due to inclement weather. I contacted Ms. Dallo and scheduled an on-site inspection for 01/27/2021. On 01/26/2021, I received a video recording of the incident from Ms. Dallo. The video recording is of the toddler classroom on 01/14/2021. The camera angle shows the front of the classroom. Two staff members can be seen in the video (Ms. McGinley and Mheriya Singleton) along with 7 children. The video shows Ms. Singleton helping a child wash their hands at the sink. Ms. Singleton's back is towards a group of 6 children standing by the tables. Ms. McGinley is seen approaching Child A who is standing beside a chair that is tipped over on its side. Ms. McGinley picks the chair up and sets it back on its feet and walks away. Child A is seen tipping the chair back over on its side. Ms. McGinley walks back over to Child A and can been seen slapping his left hand two times. Child A then attempts to hit Ms. McGinley with his right hand. Ms. McGinley pushes Child A's right arm away, and aggressively grabs and yanks Child A by his left arm. Ms. McGinley starts to walk Child A towards the door. Child A appears upset and starts to cry. At this point, Ms. McGinley stands still and Ms. Dallo is seen in the frame holding her arm up as if signaling for Ms. McGinley to stop. Both Ms. Dallo and Ms. McGinley walk to the other side of the classroom to talk and the video clip ends. On 01/26/2021, I spoke with Child A's mother via telephone. Child A's mother stated that Ms. Dallo did not inform her of the incident until 01/19/2021, when she dropped Child A off at the center in the morning. Child A only attends the program Tuesdays and Thursdays. Ms. Dallo told her that she wanted to speak to her in person regarding the incident and that is why she waited until 01/19/2021. Child A's mother said that Ms. Dallo told her that Child A had thrown a chair down twice, and that Ms. McGinley had hit Child A on the hand. Child A then tried to hit Ms. McGinley back and Ms. McGinley responded by aggressively pulling Child A by the arm. Child A's mother stated that Child A's father went to the center later that day and watched the video recording of the incident. Child A's mother was informed that Ms. McGinley is no longer employed at the center. Child A's mother indicated that she felt that Ms. Dallo handled the situation properly and addressed all her concerns. Child A's mother had no past or current concerns and Child A is still enrolled at the center. 3 On 01/27/2021, I conducted an announced on-site inspection. I interviewed Tanya Dallo (owner/program director) and Mheriya Singleton (lead toddler caregiver). The interviews were conducted privately. Ms. Dallo stated that on 01/14/2021, at around 11:30pm, she was on the telephone in her office. Ms. McGinley stopped by the doorway but signaled that she would come back later to speak with her. When Ms. Dallo got off the phone, she walked down to the toddler room to see what Ms. McGinley wanted. Ms. Dallo stepped into the classroom but neither caregiver (Ms. McGinley or Ms. Singleton) saw her enter. While Ms. Dallo was standing by the doorway, she saw Child A tip a chair over. Ms. McGinley went over and set the chair back up, but Child A proceeded to tip the chair over again. Ms. Dallo observed Ms. McGinley walk over to Child A and say, "Don't do that." She then smacked Child A on the hand two times. Child A attempted to hit Ms. McGinley back. Ms. McGinley pushed Child A's arm away and then grabbed his other a
